HomeMy WebLinkAboutO-2023-3926ORDINANCE NO.2023-3926 AN ORDINANCE DETERMINING THE POPULATION OF THE CITY OF LA PORTE, TEXAS, AND OF EACH OF THE SIX (6) SINGLE -MEMBER COUNCIL DISTRICTS, AS ESTABLISHED BY THE 2020 U.S. CENSUS; FINDING THAT THE DISTRIBUTION OF POPULATION AMONG THE CITY COUNCIL SINGLE -MEMBER DISTRICTS IS MATERIALLY UNBALANCED; FINDING COMPLIANCE WITH THE OPEN MEETINGS ACT; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, Section 2.01(b) of the City Charter of the City of La Porte, Texas, requires the City Council to conduct an investigation and determine the population of each of the districts from which councilpersons are to be elected, and that such determination be expressed in an ordinance; and WHEREAS, Section 2.01(b) of the City Charter of the City of La Porte, Texas, requires that the determination of population of each council district be based on the best available data, including, but not limited to, the most recent federal census; and WHEREAS, Section 2.01(b) of the City Charter of the City of La Porte, Texas, mandates that the City Council establish new council district boundaries for the election of district councilpersons if the determination of the city population reveals that the distribution of population among the various districts is materially unbalanced; and WHEREAS, the City Council is in receipt of the U.S. Census Bureau's official population data for the 2020 U.S. Census — commonly known as "PL 94-171" data — which includes population and demographic information for the City of La Porte, Texas, as of April 1, 2020; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: Section 1. That the facts and recitations set forth in the preamble of this ordinance are true and correct. Section 2. The City Council of the City of La Porte finds that the population of the City of La Porte, as determined by the 2020 U.S. Census, is 35,134. The City Council of the City of La Porte additionally finds that the population of each of the six (6) single -member council districts, as determined by the 2020 U.S. Census, is as follows: Council District No. 1 -- 6264; Council District No. 2 - 5733; Council District No. 3 - 5520; Council District No. 4 — 5402; Council District No. 5 -- 6652; and Council District No. 6 — 5563, and that under applicable legal principles and guidelines for redistricting such single -member council districts are materially unbalanced. Section 3. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council is posted at a place convenient to the public at the City Hall of the city for the time required by law preceding this meeting, as required by Chapter 551, Tx. Gov't Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms 'such written notice and the contents and posting thereof. Section 4.
