ORDINANCE NO.2023-3928 <br />AN ORDINANCE APPOINTING CLARK T. ASKINS TO THE POSITION OF CITY <br />ATTORNEY OF THE CITY OF LA PORTE, TEXAS, IN ACCORDANCE WITH <br />SECTION 3.05 OF THE CITY OF LA PORTE CHARTER; FINDING COMPLIANCE <br />WITH THE OPEN MEETINGS ACT; AND PROVIDING AN EFFECTIVE DATE <br />HEREOF. <br />WHEREAS, Knox Askins, the City Attorney for the City of La Porte since 1965, has <br />submitted a letter of retirement after almost sixty years of service; and <br />WHEREAS, Section 3.05 of the City Charter of the City of LaPorte, Texas, provides that <br />the City Council shall appoint a competent attorney, duly licensed by the State of Texas, to be city <br />attorney and head of the department of law; and <br />WHEREAS, Section 3.05 of the City Charter of the City of La Porte further provides that <br />the city attorney shall be appointed and removed at the will and pleasure of the council by a <br />majority vote of the entire council, and shall receive compensation as may be fixed by council; <br />and <br />WHEREAS, the City Council desires to appoint Assistant City Attorney Clark T. Askins <br />to the position of city attorney. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LA PORTE, TEXAS: <br />Section 1. That the facts and recitations set forth in the preamble of this ordinance are <br />true and correct. <br />Section 2. The City Council of the City of La Porte hereby appoints Clark T. Askins <br />to the position of City Attorney of the City of La Porte, Texas, who shall serve at the will and <br />pleasure of the City Council, and who shall receive compensation as may be fixed by City Council. <br />Section 3. The City Council officially finds, determines, recites and declares that a <br />sufficient written notice of the date, hour, place and subject of this meeting of the City Council is <br />posted at a place convenient to the public at the City Hall of the city for the time required by law <br />preceding this meeting, as required by Chapter 551, Tx. Gov't Code; and that this meeting has <br />been open to the public as required by law at all times during which this ordinance and the subject <br />matter thereof has been discussed, considered and formally acted upon. The City Council further <br />ratifies, approves and confirms such written notice and the contents and posting thereof. <br />Section 4. This Ordinance shall take effect and be in force as of MAY 9, 2023. <br />PASSED AND APPROVED this the 8th day of MAY 2023. <br />
