ASKINS TO THE POSITION OF CITY ATTORNEY OF THE CITY OF LA PORTE, TEXAS, IN ACCORDANCE WITH SECTION 3.05 OF THE CITY OF LA PORTE CHARTER; FINDING COMPLIANCE WITH THE OPEN MEETINGS ACT; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, Knox Askins, the City Attorney for the City of La Porte since 1965, has submitted a letter of retirement after almost sixty years of service; and WHEREAS, Section 3.05 of the City Charter of the City of LaPorte, Texas, provides that the City Council shall appoint a competent attorney, duly licensed by the State of Texas, to be city attorney and head of the department of law; and WHEREAS, Section 3.05 of the City Charter of the City of La Porte further provides that the city attorney shall be appointed and removed at the will and pleasure of the council by a majority vote of the entire council, and shall receive compensation as may be fixed by council; and WHEREAS, the City Council desires to appoint Assistant City Attorney Clark T. Askins to the position of city attorney. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: Section 1. That the facts and recitations set forth in the preamble of this ordinance are true and correct. Section 2. The City Council of the City of La Porte hereby appoints Clark T. Askins to the position of City Attorney of the City of La Porte, Texas, who shall serve at the will and pleasure of the City Council, and who shall receive compensation as may be fixed by City Council. Section 3. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council is posted at a place convenient to the public at the City Hall of the city for the time required by law preceding this meeting, as required by Chapter 551, Tx. Gov't Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 4. This Ordinance shall take effect and be in force as of MAY 9, 2023.
