AN ORDINANCE AMENDING CHAPTER 18 "AVIATION" OF THE CODE OF
ORDINANCES OF THE CITY OF LA PORTE BY REVISING STANDARDS AND
REGULATIONS RELATED TO THE LA PORTE AIRPORT ADVISORY BOARD;
PROVIDING A REPEALING CLAUSE; CONTAINING A SEVERABILITY CLAUSE;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS:
Section 1: That Chapter 18, "Aviation," Article II "Administration", Division 2 "Airport
Advisory Board" is hereby amended in its entirety and shall hereinafter read as follows:
"Sec. 18-51. - Airport advisory board established.
(a) The city council hereby establishes an airport advisory board forthe city municipal airport. The airport
advisory board shall consist of seven (7) persons chosen in accordance with the qualifications established
immediately below, each of whore shall serve for a three-year term, or until a successor shall have been
appointed and duly qualified, to -wit:
(1) Position 1: shall be a fixed base operator lessee at the city municipal airport.
(2) Position 2: shall be a licensed pilot with an aircraft housed at the city municipal airport.
(3) Position 3: shall be a licensed pilot who is a resident of the city with ail aircraft housed at
the city municipal airport.
(4) Position 4: shall be a licensed pilot with an aircraft housed at the city municipal airport.
(5) Position 5: shall be a resident of the City or owner of real property situated within the City
limits, or an individual who owns or operates a business within the city.
(6) Position 6: shall be a resident of the City or owner of real property situated within the City
limits, or an individual who owns or operates a business within the city.
(7) Position 7: shall be a member of City Council.
(b) Appointments to the board shall be made by the City Council under the same method and at the usual
time as other routine appointments to city boards, committees, and commissions.
(c) Each year the members of the airport advisory board shall elect from among their number a chairperson
and avice-chairperson, which positions shall be held during their respective three-year terms. A person
elected as chairperson or vice -chairperson is not eligible to serve in such capacity for consecutive terms.
Sec. 18-52. - Functions.
It is the intent and purpose of the city Council that the airport advisory board advise City Council from
time to time on matters relating to the most desirable and efficient operation of the city illunicipal airport.
To this end, it is the desire of the city council that the airport manager operate as a staff liaison to the
airport advisory board and provide guidance on matters relating to the operation of the city municipal
airport.
Further, it is the desire of the city Connell that the airport advisory board review, from tilne to time, but
no less thail every ten (10) years, the city airport master plait, and recommend to City Council ally Updates
or revisions to Such airport master plan. It is the desire of city council that the airport advisory board
make recommendations to City Council oil such hatters as Iā¢Liles and regulations, and traffic patterns for
operations at the city municipal airport, and for any needed improvements to the facilities at the airport,
including Such matters as navigational aids, zoning requests, height restrictions, Community
development, and the like, as well as any other improvements which the board determines would enhance
the utility of the city municipal airport to its users and to the Community at large.
Sec. 18-53. Meeting Frequency.
The Airport Advisory Board shall convene a meeting no less than once every three (3) months.
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided, however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative of other ordinances
regulating and governing the subj ect matter covered by this ordinance.
Section 3: Should any section or part of this ordinance be held unconstitutional, illegal, or invalid,
or the application to any person or circumstance for any reasons thereof ineffective or inapplicable,
such unconstitutionality, illegality, invalidity, or ineffectiveness of such section or part shall in no
way affect, impair or invalidate the remaining portions thereof; but as to such remaining portion
or portions, the same shall be and remain in full force and effect and to this end the provisions of
this ordinance are declared to be severable.
Section 4. The City Council officially finds, determines, recites and declares that a sufficient
written notice of the date, hour, place and subject of this meeting of the City Council is posted at
a place convenient to the public at the City Hall of the city for the time required by law preceding
this meeting, as required by Chapter 551, Tx. Gov't Code; and that this meeting has been open to
the public as required by law at all times during which this ordinance and the subject matter thereof
has been discussed, considered and formally acted upon. The City Council further ratifies,
approves and confirms such written notice and the contents and posting thereof.
Section 5. This ordinance shall be effective upon its passage and approval.
