HomeMy WebLinkAboutResolution 2024-12RESOLUTION 2024-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, RESOLVING TO RESALE PROPERTY FORECLOSED ON THROUGH A DELINQUENT TAX LAWSUIT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, the City of La Porte remains unpaid after exhausting all legal means to satisfy the collection of the delinquent taxes due and owing to the City of LaPorte, including conducting a public auction of the property by the Harris County Constables whereby the property was struck off to the City of La Porte and; WHEREAS, being no bids for the property at the tax sale on May 6, 2014, the City of La Porte now holds the property in trust to secure the payment of taxes, penalties, interest and costs owed to the City of La Porte; and WHEREAS, the property held in trust by the City of La Porte is exempt from taxation and it is in the best interest of the City of La Porte to have the property returned to the active tax roll as a taxable property and the City of La Porte has received an offer of $13,720.18 to purchase the property from Matthew Childress; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, THAT: Section 1. All of the above paragraphs are true, correct and in the best interest of the City of La Porte and as such they are hereby incorporated in full and made a part of this Resolution and the City of La Porte accepts the tax resale offer by Matthew Childress and authorizes the City Manager of the City of La Porte to sign and execute the deed on behalf of the City of La Porte to transfer title to the person submitting the offer to purchase the property. Section 2. All resolutions or parts of resolutions of the City of La Porte, Texas, in conflict with any provision contained herein is hereby repealed to the extent of any conflict. Section 3. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this Resolution shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this Resolution; and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase, or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase, or clause, or part thereof, may be declared invalid. Section 4. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Act, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 5.
