Date (City Seal) RESOLUTION 2025-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, WITHDRAWING NOMINATION OF CANDIDATES THAT WERE TO BE PLACED ON A BALLOT FOR A POSITION ON THE BOARD OF DIRECTORS OF THE HARRIS CENTRAL APPRAISAL DISTRICT (HCAD); FINDING COMPLIANCE WITH THE OPEN MEETINGS ACT; AND PROVIDING AN EFFECTIVE DATE HEREOF WHEREAS, Those cities and towns other than the City of Houston within the Hams Central Appraisal District (HCAD) have the right to nominate up to five candidates to be listed on a final ballot that will be voted upon by all eligible taxing units who are entitled to vote to appoint five (5) positions on the board of directors of the Harris Central Appraisal District for a term of office commencing on January 1, 2025; and WHEREAS, On September 26, 2024, the City Council nominated Bill Bentley and Nolan Allen as candidates for an appointed position on the board of directors of the Harris Central Appraisal District (HCAD) to be decided by a vote of all eligible taxing units who are entitled to vote to fill five (5) positions on the board of directors of the Harris Central Appraisal District for a term of office to be determined in accordance with the provisions of Senate Bill 2 commencing on January 1, 2025, and notified HCAD of the adoption of Resolution 2024-15, nominating the said Bill Bentley and Nolan Allen as candidates for an appointed position on the board of directors of the Harris Central Appraisal District (HCAD); and WHEREAS, Both aforementioned candidates have indicated to the City their wish to have their nominations withdrawn. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, THAT - Section 1. That the facts and recitations set forth in the preamble of this resolution be, and hereby are, adopted, ratified and confirmed. Section 2. That the nominations of Bill Bentley and Nolan Allen as candidates for an appointed position on the board of directors of the Harris Central Appraisal District to be decided by a vote of all eligible taxing units who are entitled to vote to fill five (5) positions on the board of directors of the Harris Central Appraisal District for a term of office to be determined in accordance with the provisions of Senate Bill 2 commencing on January 1, 2025, as provided for in Resolution 2024-15, be withdrawn, in accordance with the request of the said Bill Bentley and Nolan Allen. Section 3. That the presiding officer of the governing body of this taxing unit be, and he or she is hereby, authorized and directed to deliver, or cause to be delivered, a certified copy of this resolution to the chief appraiser of the Harris Central Appraisal District (HCAD) prior to October 15, 2024. Section 3. All resolutions or parts of resolutions of the City of La Porte, Texas, in conflict with any provision contained herein is hereby repealed to the extent of any conflict. Section 4. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this resolution shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this resolution; and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase, or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase, or clause, or part thereof, may be declared invalid. Section 5. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Act, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 6.
