RP--2019. 4.93386 <br /> 11/U /2619 RP2 #•32.00 <br /> f L191(P <br /> EMERGENCY ACCESS EASEMENT <br /> ‘V THE STATE OF TEXAS § <br /> KNOW ALL MEN BY THESE PRESENTS: <br /> COUNTY OF HARRIS § <br /> That HAWTHORNE AT LA PORTE, LLC, a Delaware limited liability company <br /> ("Grantor"), for and in consideration of TEN AND NO/100 DOLLARS ($10.00) and other good <br /> and valuable consideration paid by the CITY OF LA PORTE, TEXAS, a Municipal Corporation - <br /> ("Grantee"),the receipt and sufficiency of which are hereby acknowledged and confessed,has this <br /> day GRANTED, BARGAINED, SOLD AND CONVEYED and by these presents does GRANT, <br /> BARGAIN, SELL AND CONVEY unto said Grantee, its successors and assigns, the perpetual <br /> right, privilege, easement and right-of way over and across the following described real property <br /> and premises, situated in Harris County, Texas,to wit: <br /> SEE ATTACHED EXHIBIT "A" <br /> for the purpose of maintaining and using an emergency access gate. Additionally, this easement <br /> is intended as an easement to the City of La Porte,Texas in its governmental capacity,for purposes <br /> of ingress and egress to provide, without limitation, fire and police protection, ambulances and <br /> rescue services and other lawful governmental or private emergency services to the premises, <br /> owners, occupants and invitees thereof across or on the drive isles throughout the property. The <br /> foregoing easement shall in no way be construed as a dedication of any roadways to the public. <br /> Said ingress and egress access point may be through an Emergency Services Access Gate that shall <br /> be locked at all times and shall be accessed by emergency vehicles only, as more specifically <br /> labeled and shown on the attached Exhibit"B". <br /> TO HAVE AND TO HOLD the above described easement, together with all and singular <br /> the rights and appurtances thereto in anywise belonging unto said Grantee, and its successors or <br /> assigns, in accordance with the terms and conditions hereinabove set forth.
