AN ORDINANCE APPROVING AN AMENDMENT TO THE BUDGET FOR THE CITY
OF LA PORTE, TEXAS, FOR THE PERIOD OF OCTOBER 1, 2024, THROUGH
SEPTEMBER 30, 2025; FINDING THAT ALL THINGS REQUISITE AND NECESSARY
HAVE BEEN DONE IN PREPARATION AND PRESENTMENT OF SAID BUDGET;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF
WHEREAS, the Charter of the City of La Porte, Texas, and the Statutes of the State of Texas,
require that an annual budget be prepared and presented to the City Council of the City of LaPorte,
Texas, prior to the beginning of the fiscal year of said City, and that a public hearing be held prior
to the adoption of said budget; and
WHEREAS, the budget for the fiscal year October 1, 2024, through September 30, 2025, (the
"Budget" herein) has heretofore been presented to the City Council and due deliberation had
thereon, was filed in the office of the City Secretary on July 22, 2024, and a public hearing
scheduled for September 9, 2024, was duly advertised and held, and said Budget was finally
approved by ordinance on September 9, 2024; and
WHEREAS, Subsection (b) of Section 102.009 of the Texas Local Government Code provides
that, after final adoption of the budget, the governing body of the municipality may spend
municipal funds only in strict compliance with the budget, except in emergency, where in such
cases the governing body of the municipality may authorize an emergency expenditure as an
amendment to the original budget only in the case of grave public necessity to meet an unusual
and unforeseen condition that could not have been included in the original budget through the use
of reasonably diligent thought and attention; and
WHEREAS, Section 102.010 of the Texas Local Government Code provides that the governing
body of a municipality may make changes to its budget for municipal purposes; and
WHEREAS, the adoption of this ordinance and the amendment of the Budget is necessary for and
in the best interest of the health, safety and general welfare of the inhabitants of the City.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
LA PORTE, TEXAS:
SECTION 1. A grave public necessity exists and to meet an unusual and unforeseen condition
that could not have been included in the original Budget through the use of reasonably diligent
thought and attention, the Budget must be amended and revised with respect to those
appropriations set forth in Exhibit C, attached hereto by reference and made part hereof. In support
thereof, the City Council finds that additional expenditures are necessary for the following
purpose: $106,838.00 in the general fund for procurement of professional design services to repair
the Sylvan Beach Pier for damages sustained from Hurricane Beryl in July of 2024. Such
additional expenditures are more specifically described on Exhibit C.
SECTION 2. That the Budget for the City of La Porte, Texas, now before the said City Council
for consideration, a complete copy of which is on file with the City Secretary and a summary of
which is attached hereto by reference as Exhibit "A", is hereby amended as reflected on the
amended budget summary document, attached hereto by reference as Exhibit `B", as the Budget
for the said City of La Porte, Texas, for the period of October 1, 2024, through September 30,
2025.
SECTION 3. The several amounts stated in Exhibit C as the requested additional expenditures are
hereby appropriated to and for the objects and purposes therein named and are found to be for
municipal purposes.
SECTION 4. The amended and revised expenditures contained in the Budget, do not exceed the
resources of each fund, as so amended and revised.
SECTION 5. The City Council finds that all things requisite and necessary to the adoption of said
Budget and the amendments made hereto have been performed as required by charter or statute.
SECTION 6. Upon the passage and adoption of this ordinance, a copy of the ordinance shall be
filed with the City Secretary, who shall attach a copy of same to the original budget.
SECTION 7. The City Council officially finds, determines, recites and declares that a sufficient
written notice of the date, hour, place and subject of this meeting of the City Council was posted
at a place convenient to the public at the City Hall ofthe City for the time required by law preceding
this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and
that this meeting has been open to the public as required by law at all times during which this
Ordinance and the subject matter thereof has been discussed, considered and formally acted upon.
The City Council further ratifies, approves and confirms such written notice and the contents and
posting thereof.
SECTION 8. This ordinance shall be in effect from and after its passage and approval.

RE: Sylvan Beach Pier Rehabilitation
Mr. Appel:
Cobb, Fendley & Associates, Inc. (CobbFendley) appreciates the opportunity to submit
this proposal to provide professional engineering services to the City of La Porte (City)
for the preparation of plans and specifications to rehabilitate the Sylvan Beach Pier.
This proposal includes our project understanding, scope of work, schedule and fee
provided below.
PROJECT UNDERSTANDING
The Sylvan Beach Pier was heavily damaged by Hurricane Beryl on July 8, 2024 and is
currently closed to the public. After reviewing drone footage provided by the City and
visiting the site, we believe the existing 1000 foot long pier can be rehabilitated by
utilizing most of the existing piles and most of the existing substructure framing. Any
missing or damaged piers or framing would be replaced. However, most of the existing
wood deck is missing or damaged and would need to be totally replaced. Additionally,
the T-head of the pier is severely damaged and would need to be totally reconstructed.
The City has requested the existing wood deck be replaced with'ThruFlow" decking or
similar product to reduce future deck damage during storm events. The use of this
product requires additional framing between piers to adequately support the deck which
will be included in the proposed design. The existing railings are mostly in place and
will be repaired/replaced as needed. We have prepared a preliminary estimate of
construction cost included as Attachment A which identifies a probable construction
cost of $1,560,400.00
SCOPE OF WORK

1. CobbFendley shall prepare all work in accordance with the latest version of
applicable City of La Porte (City), Harris County, and State guidelines and
requirements.
2. CobbFendley shall notify the City prior to entering the park to conduct site visits
and to obtain geotechnical borings. Coordination with the City will ensure

adequate access is obtainable and necessary precautions are identified to
maintain public safety.
3. The Engineer will coordinate with the City and other entities having jurisdiction
or interest in the project (e.g. Harris County, HCFCD, etc.) throughout the
design process.
4. CobbFendley will provide project coordination and oversight to internal design
team(s) and subcontractor(s), CobbFendley will conduct monthly progress
meeting with the City to discuss: the work completed to date, work planned for
the next period, and the project cost updates. These meetings will also be
utilized to obtain clarification or input from the City and will be held via Microsoft
Teams.
5. CobbFendley will review project related technical information (e.g., records/as-
built drawings, engineering reports, topography data, existing permits, etc.) that
the City will provide in order to obtain relevant information and expedite the
design.
6. CobbFendley will perform field work which will include site visits to obtain
additional field data and to conduct geotechnical investigations. One
geotechnical boring is proposed near the pierentrance to identify soil properties
and to obtain necessary design data.
7. CobbFendley will complete designs and prepare construction documents
(Plans, Specifications, and construction cost estimates), for bidding and award
of the Sylvan Beach Pier Rehabilitation. Anticipated plan sheets include:
Cover Sheet, General Notes, Overall Site Plan, Pier Plan and Profile, Pier
Cross -Sections and Details, SW313 and Summary of Quantities.
8. One geotechnical boring will be obtained at the site. Geotest Engineering, Inc.
will be providing geotechnical services and has provided a scope and fee
estimate included as Attachment B.
Bid Phase Services
1. Provide Notice to Bidders (NTB) to the City in an electronic form appropriate
for the City's bid format.
2. Prepare bid package and post to Civcast.
3. Chair pre -bid meeting and attend the Bid Opening.
4. Respond in writing via CivCast to questions from bidders and prepare addenda
as necessary.
5. Prepare Engineers Recommendation of Award Letter that includes the
following required content:
a. Check for math errors and reconcile any mathematical discrepancies
b. Review for unbalanced bid items
c. Certified Bid Tabulation including Engineer's estimate

d. Review of contractor's financial standing, references provided, and all
bid documents required.
e. Recommendation to award
6. Distribute digital plans and specifications for contractors and maintain a plan
holder's list via CivCast.
7. Attend City Council meeting and recommendation for award of Contract for
Construction.
SCHEDULE
CobbFendley anticipates that the proposed scope of work will take 4 months to
complete.
FEE
A detailed man-hour fee estimate is included as Attachment C which identifies a total
fee of $106,838.00
EXCLUSIONS FOR THE SCOPE OF SERVICES
The services described above are the identified BASIC AND ADDITIONAL SERVICES
for this assignment. Other items that may arise during the course of the project that the
City may wish to add to the scope of services shall be deemed as SUPPLEMENTAL
ADDITIONAL SERVICES. CobbFendley shall undertake such supplemental additional
services as assigned by the City upon written direction from the City. Examples of such
items are as follows:
1. Attending or Conducting Public meetings.
2. Electrical Engineering design for conduit and lighting.
3. Environmental Services
4. Construction Administration
5. Construction Management and Quality Control (QC) inspections, full or
part time, during the construction phase of the project.
6. Topographic and Boundary Survey
7. Construction Staking
8. Bidding project more than once.
9. Any other services not specifically included within the description of the
Basic Services and Additional Services as described above.
If supplemental services are requested by the City, CobbFendley will provide the City
with a separate proposal for the supplemental work.
