AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA
PORTE, CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING
ORDINANCE OF THE CITY OF LA PORTE, BY GRANTING SPECIAL CONDITIONAL
USE PERMIT NO. SCUP-2024-0011, TO ALLOW FOR 1) VARIOUS COMMERICAL
AND INDUSTRIAL USES AS PERMITTED WITH CONDITIONS AND PERMITTED
WITH APPROVAL OF A SCUP WITHIN THE PLANNED UNIT DEVELOPMENT (PUD)
ZONING DISTRICT ON 58.42-ACRES OF LAND OUT OF THE 130.56-ACRE TRACT OF
LAND LOCATED AT 11921 W. FAIRMONT PKWY. (ALONG SPENCER HWY. AND W.
FAIRMONT PKWY.) AND 2) FOR VARIOUS COMMERCIAL NAICS CODE USES AS
PERMITTED TO PROVIDE GOODS AND SERVICES TO NEIGHBORING RESIDENTS
ON 72-ACRES OUT OF THE 130.56-ACRE TRACT OF LAND (ALONG BAY AREA
BLVD.), LOCATED AT 11921 W. FAIRMONT PKWY., AND LEGALLY DESCRIBED AS
TRACTS 2A, 3, 4, 4A & TRACT 23D BAYPORT U/R SECTION ]ABSTRACT 625 R
PEARSALL; HARRIS COUNTY, TEXAS; MAKING CERTAIN FINDINGS OF FACT
RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN
MEETINGS ACT; AND PROVIDING AN EFFECTIVE DATE HEREOF;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS:
Section 1. Chapter 106 "Zoning" ofthe Code of Ordinances is hereby amended by granting Special
Conditional Use Permit #SCUP-2024-0011 attached hereto as Exhibit A and incorporated by
reference for all purposes, to allow for 1) various commercial and industrial uses as permitted with
conditions and permitted with approval of a SCUP in the Planned Unit Development (PUD)
zoning district, on approx. 58.42-acres out of the 130.56-acre tract of land located at 11921 W.
Fairmont Pkwy. (along Spencer Hwy. and W. Fairmont Pkwy.); and 2) for various Commercial
NAICS code uses as permitted to provide goods and services to neighboring residents, on approx.
72-acres out of the 130.56-acre tract of land (along Bay Area Blvd.), located at 11921 W. Fairmont
Pkwy., and legally described as Tracts 2A, 3, 4, 4A & Tract 23D Bayport U/R Section I Abstract
625 R Pearsall, Hams County, Texas.
Section 2. All ordinances or parts of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided, however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this ordinance.
Section 3. Should any section or part of this ordinance be held unconstitutional, illegal, or invalid,
or the application to any person or circumstance for any reasons thereof ineffective or inapplicable,
such unconstitutionality, illegality, invalidity, or ineffectiveness of such section or part shall in no
way affect, impair or invalidate the remaining portions thereof; but as to such remaining portion
or portions, the same shall be and remain in full force and effect and to this end the provisions of
this ordinance are declared to be severable.
Section 4. The City Council officially finds, determines, recites and declares that a sufficient
written notice of the date, hour, place and subject of this meeting of the City Council is posted at
a place convenient to the public at the City Hall of the city for the time required by law preceding
this meeting, as required by Chapter 551, TX. Gov't Code; and that this meeting bas been open to
the public as required bylaw at all times during which this ordinance and the subject matter thereof
has been discussed, considered and formally acted upon. The City Council further mtifies,
approves and confirms such written notice and the contents and posting thereof.
Section 5. The City Council of the City of La Porte hereby finds that public notice was properly
mailed to all owners of all properties located within three hundred feet (300') of the properties
under consideration.
Section 6. The City Council of the City of La Porte hereby finds, determines, and declares that all
prerequisites of law have been satisfied and hereby determines and declares that the
amendments to the City of La Porte Zoning Classification contained in this Ordinance as
amendments thereto are desirable and in furtherance of the goals and objectives stated in the
City of La Porte's Comprehensive Plan.
Section 7. This ordinance shall be effective after its passage and approval.

Permit Conditions:
This Special Conditional Use Permit (SCUP) is applicable for the subject property, a copy of which
shall be maintained in the files of the City's Planning and Development Department upon approval.
Project development shall be in accordance with the following conditions:
1. A site development plan shall be submitted, if necessary, in accordance with applicable
requirements of the city of La Porte's development ordinance and shall comply with all provisions
of chapter 106 "zoning" of the city's code of ordinances, and all other department reviews and
applicable laws and ordinances of the city of La Porte, and the state of Texas.
2. All necessary documentation for building permit review must be submitted in conjunction with the
city's building permit application process for any proposed building improvements.
3. Reserve 1 is approximately 15.42-acres along W. Fairmont Pkwy. and will have an underlying
zoning district of Business Industrial (BI).
4. Reserve 2 is approximately 43-acres along Spencer Hwy. and will have an underlying zoning
district of Business Industrial (BI).
5. Reserve 3 is approximately 72-acres along Bay Area Blvd. and will have an underlying zoning
district of General Commercial (GC).
6. No building shall be larger than 85,000 ft' in total Floor area in Reserves 1 and 2.
7. Architectural design guidelines for facades and buildings:
(a) Building Form.
(1) All buildings shall be designed and constructed in tri-partite architecture so
that they have a distinct base, middle and top (paint or texture can be used to satisfy
the tri-partite architecture requirement).
(b) Building Articulation.
(1) Primary facades clearly visible from a public street or along an active
storefront shall meet the following minimum standards for articulation:
a. Horizontal Articulation. No building wall shall extend for a distance equal to
three times the wall's height without having a minimum off -set of 5 feet, and
that new plane shall extend for a distance equal to at least 25% of the
maximum length of the first plane.
b. Vertical Articulation. No horizontal wall shall extend for a distance greater
than three times the height of the wall without changing height by a minimum
of 5 feet.

8. Architectural design guidelines for facades and buildings in Reserves 1 and 2:
(a) Exterior Fagade Materials
(1) Allowed exterior materials are categorized into the following three groups, of
which at least two materials from different groups shall be used in all exterior
facades:
a. Group A: Brick and stone.
b. Group B: Stucco, architectural concrete block with integrated color
(split face CMU), factory primed cementitious fiberboard in the form of lap
siding or board and batten, EIFS (above 14 feet from grade only), and
painted, colored or stamped tilt -wall.
C. Group C: Metal, tile, wood.
(2) Prohibited exterior materials include cinder block, vinyl, plastic, aggregate
pea -gravel finished surfaces, and pre-engineered metal building siding.
(3) Primary fagade treatment standards applicable to buildings. The following
shall apply to all exterior walls of buildings which are clearly visible from a public
street or along an active storefront:
Primary Facades, excluding windows, doors, and other openings, shall be
constructed of at least 20 percent Group A materials and up to 80 percent Group B
materials. However, accent materials from Group C may be allowed in limited
application for architectural features as approved by the director of planning and
development or designee.
(4) Building color requirements are applicable to buildings in all tiers. The
dominant color of all buildings shall be muted shades of color. Black and stark white
shall not be used except as an accent color. There are no restrictions on accent
colors which comprise less than one percent of the building face, except that
Fluorescent colors are prohibited.
9. Architectural design guidelines for facades and buildings in Reserve 3:
(a) Roofs.
(1) Where clearly visible from a public street or along active storefronts, any hip,
gable or mansard roofs may only utilize the following materials: metal standing seam,
slate, clay or concrete tile (barrel or Roman shape). Minimum three on 12 roof pitch
required.
(b) Architectural Design Elements.
(1) The following is a list of acceptable architectural design elements that must
be included into the design of buildings as required in this section.
a. Canopies, awnings, porticos with colonnade, or arcades
b. Raised pilaster cornices (end columns at comer), or quoin comers
C. Vertical elements (tower, cupola, lighthouse, turret, arches, etc.)
d. Windows and doors framed with smooth cobble, cast stone,
limestone, or other decorative masonry headers and sills; or dormerwindows
e. Outdoor patios and/or courtyards (landscaped and furnished)
f. Decorative ornamentation integrated into the building fagade, such as
corbels, medallions (non-signage), functioning clocks, niches, wrought iron,
balconettes, gargoyles, or horizontal and rhythm patterned brickwork; or
other architectural features approved by the director of planning and
development or designee
g. Any other architectural design element approved by the director of
planning and development or designee
(2) All structures shall be designed to incorporate no less than two of the
architectural elements above. Buildings over 50,000 square feet must include a
minimum of three of the referenced architectural elements above.
(c) Exterior Fagade Materials
(1) Allowed exterior materials are categorized into the following three groups, of
which at least two materials from different groups shall be used in all exterior
facades:
a. Group A: Brick and stone.
b. Group B: Stucco, architectural concrete block with integrated color

allowed in limited application for architectural features as approved by the
director of planning and development or designee.
b. Buildings over 50,000 square feet may use Split -Face CMU
(architectural block) for up to 20 percent of the primary fagade, in addition to
the 20 percent of Group B materials.
(4) Building color requirements are applicable to buildings. The dominant color
of all buildings shall be muted shades of color. Black and stark white shall not be
used except as an accent color. There are no restrictions on accent colors which
comprise less than one percent of the building face, except that fluorescent colors
are prohibited.
10. All truck bays must be located to the rear of any building and screened from view of public right-
of-way.
11. All on site areas utilized for storage, parking, or driving must be paved with either concrete or
asphalt.
12. Total daily truck traffic to and from the building site shall be limited to a maximum of 10 trucks
per day.
13. No shipping containers are permitted to be stored outside.
14. Any outside storage shall be screened from view of adjoining properties with an 8-foot-tall fence
that shall be 100% opaque. Vinyl slating in conjunction with a chain -link fence is permitted.
15. Hazardous materials which may or may not require a placard may not be stored on site for any
length of time. This prohibition includes hazardous materials stored in the building or on trucks
and shipments of hazardous materials that are defined as in transit by the Department of
Transportation.
16. 10% landscaping required.

Failure to start construction of the site within 5 years (60 months) after issuance shall void the
permit as approved, except upon an extension of time granted after application to the Planning
and Zoning Commission.
If contract or agreement is terminated after completion of any stage and there is ample evidence
that further development is not contemplated, the ordinance establishing such SCUP may be
rescinded by the City Council, upon its own motion or upon the recommendation of the Planning
and Zoning Commission of the City of La Porte, and the previous zoning of the entire tract shall
be in full effect on the portion which is undeveloped.
