HomeMy WebLinkAboutOrd 2025-4051_declaration of unopposed candidates_At Large A & District 4ORDINANCE 2025-4051 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, DECLARING ELECTED THE UNOPPOSED CANDIDATE FOR COUNCHRERSON AT - LARGE, POSITION A AND THE UNOPPPOSED CANDIDATE FOR COUNCH.PERSON- DISTRICT 4, FOR THE GENERAL MUNICIPAL ELECTION THAT WAS TO BE HELD ON THE 3RD DAY OF MAY, 2025, FOR THE PURPOSE OF ELECTING TO OFFICE A COUNCIIRERSON AT -LARGE, POSITION A, AND A COUNCILPERSON-DISTRICT 4 AND THEREBY ENABLING THE CANCELLATION OF THESE RACES IN SAID ELECTION; PROVIDING A SAVINGS CLAUSE; PROVIDING AN OPEN MEETINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, On December 9, 2024, the City Council adopted Ordinance 20244027, calling a general election to be held on May 3, 2025, for the purpose of electing members as Councilperson At -Large Position A, Councilperson-District 4, and Councilperson-District 5; and WHEREAS, Filing for these positions was conducted in accordance with the Texas Election Code and only one candidate, Brandon Lunsford, filed for a place on the ballot in the Councilperson At - Large Position A race and only one candidate, Robert Guerra, filed for a place on the ballot in the Councilperson-District 4 race; and WHEREAS, There were no declarations for write-in candidates; and WHEREAS, The City Council has accepted a Certification of Unopposed Status for Brandon Lansford and Robert Guerra for the said May 3, 2025, general election; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: SECTION 1. Brandon Lansford is hereby declared elected for the office of Councilperson At -Large Position A, subject to the taking of his oath as provided by the laws of the State of Texas. Brandon Lansford shall hold office for the seat's three-year term, which concludes at the time of the holding of the May 2028 general municipal election, and any resulting runoff, for the election of members to the La Porte City Council. SECTION 2. The portion of the general municipal election that was to be held on the 3t° day of May, 2025, in the city, for the purpose of electing to office a Councilperson- At -Large Position A, is hereby cancelled. SECTION 3. Robert Guerra is hereby declared elected for the office of Councilperson-District 4, subject to the taking of his oath as provided by the laws of the State of Texas. Robert Guerra shall hold office for the seat's three-year tens, which concludes at the time of the holding of the May 2028 general municipal election, and any resulting runoff, for the election of members to the La Porte City Council. SECTION 4. The portion of the general municipal election that was to be held on the 3rd day of May, 2025, in the city, for the purpose of electing to office a Councilperson-District 4, is hereby cancelled. SECTION 5. Actions related to this election and its cancellation shall be held in accordance with, and shall be governed by, the election laws of the State of Texas. Additionally, the City Secretary and Mayor are hereby authorized to perform all duties and take all actions as required. The portion of the general municipal election to be held on the 3rd day of May, 2025, for the purpose of electing a Councilperson-District 5, shall be unaffected by these cancellations and shall be held as called. SECTION 6. The City Secretary of the City of La Porte shall post notice of cancellation of said election on the bulletin board at City Hall not later than the twenty -fast (21�) day before election day. Such notice shall remain posted through election day. On election day, this notice will also be placed on the doors of the polling location that was to be used for the election. SECTION 7. The Mayor and/or the City Secretary of the City of La Porte are hereby authorized to execute and/or issue, for and on behalf of the City, such orders, documents, and forms as may, from time to time, be promulgated by the Secretary of State of the State of Texas in conjunction with the election herein ordained. SECTION 8. Each and every provision, paragraph, sentence and clause of this ordinance has been separately considered and passed by the City Council of the City of La Porte, Texas, and each said provision would have been separately passed without any other provision; and if any provision hereof shall be ineffective, invalid or unconstitutional, for any cause, it shall not impair or affect the remaining portion, or any part thereof, but the valid portion shall be in force just as if it had been passed alone. SECTION 9. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place, and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by Texas open meetings law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. SECTION 10.
