P. Pfeiffer, <br />Commissioners Frank G. Baker, W. A. Stabs, Jr., Tom W. <br />Osburn and Russell Shepherd. <br />MEMBERS OF THE COMMISSION ABSENT: None. <br />OTHER CITY OFFICIALS PRESE[~T: City Attorney C. L. Pitman, <br />City Clerk Clovis D. Mann, City Engineer H. Carlos Smith, <br />Chief of Police Herbert Freeman and Water Superintendent <br />Lyman Cunningham. <br /> PRESIDING: Mayor H. P. Pfeiffer. <br /> + + + <br /> 1. Minutes of the Regular meeting of January 4, 1865, were <br />® read and approved. <br /> + + + <br /> 2. Attorney Will Sears, representing Mr. Bert Brandt, ! <br /> appeared before the Commission requesting that Donaldson j <br />• ~ Avenue be recognized as a Street, and that it be opened <br /> by removing a fence that had been construc ted in the <br /> alleged street. <br />W <br />~ Mr. Sears stated that there was no question, legally, <br />Q about the existence of a dedicated street; that the City <br />W Zoning map shows the street; that it did not make any <br />~- difference as to whether the dedication was ever filed for <br />d5 record; that "Lowrance" owned the land at the time and <br />~ sold Lots 5 and 6 according to the dedication. <br /> <br />CL' Mr. W. H. Gray, 716 S. Blackwell, stated to the Commission <br />o that when he bought his property on S. Blackwell, that the <br />® purchase was made with the understanding that the street <br />~ was open to the Bay. <br />Attorney John McDonald, representing the Morrow heirs, <br />stated that his law firm represented the Morrow heirs at <br />the time the tract under question was purchased; that a <br />search of the records revealed that at the time the <br />dedicator filed the dedication for record, the dedicator <br />did not own the land; that the City had never accepted <br />any supposed dedication or acted thereupon. <br />City Attorney Pitman stated that there had been neither <br />use, nor proper dedication of the supposed street; that <br />he could not recommend that the City spend tax money in <br />a suit for determination. <br />26'7 <br />APPROVAL OF <br />MINUTES <br />OPENING OF <br />"DONALDSON AVE. <br />
