• • <br />PLANNING AND ZONING COMMISSION <br />MINUTES OF MAY 20, 1999 <br />Members Present: Betty Waters, Jim Zoller, Michael Jetty, Dottie Kaminski, Hal <br />Lawler, Melton Welters, Sandie Staniszewski <br />Members Absent: <br />City Staff Present: Planning Director Doug Kneupper, City Planner Masood <br />Malik, Engineer I Roxann Hayes, City Attorney Knox Askins, <br />Planning Secretary Peggy Lee <br />I. CALL TO ORDER. <br />The meeting was called to order by Chairperson Waters at 6:00 PM. <br />II. APPROVE MINUTES OF THE APRIL 15, 1999, REGULAR MEETING <br />AND PUBLIC HEARING. <br />Motion by Jim Zoller to approve the minutes of April 15, 1999. Second by <br />Sandie Staniszewski. All were in favor and the motion passed. <br />III. OPEN PUBLIC HEARING TO CONSIDER SPECIAL CONDITIONAL <br />USE PERMIT REQUEST #99-002, SEEKING APPROVAL TO OPERATE <br />AN ON-SITE RECOVERY, FREON RECLAMATION, AND <br />REFRIGERANT SALES WITHIN A LIGHT INDUSTRIAL ZONE. THE <br />PROPERTY IS LOCATED IN THE 300 BLOCK OF NORTH 16T" <br />STREET. <br />Chairperson Waters opened the Public Hearing at 6:01 PM. <br />A. PROPONENTS <br />Holly Sincox, tenant of the building owned by Ken <br />Higginbotham, addressed the Commission. Ms. Sincox <br />stated that the explosion that occurred in the building back in <br />February was determined by Engineers to be caused by tank <br />failure, most likely in the manufacturing of the tank and not <br />by their negligence. New tanks have since been purchased <br />and they have received certification on the tanks. A two- <br />hourfire wall that was requested by the Fire Marshal has <br />been completed. Ms. Sincox also stated that the refrigerant <br />handled at this location is non-hazardous and non- <br />flammable. Landscaping will be completed as soon as road <br />
