AN ORDINANCE REPEALING ORDINANCE 2024-3972, CONCERNING CONDEMNATION OF
THE RESIDENTIAL BUILDING LOCATED ON LOTS 20 & 21 BLOCK 197 LA PORTE, HARRIS
COUNTY, TEXAS, MORE COMMONLY KNOWN AS 114 S. IOWA ST.; AND RPEALING
ORDINANCE 2024-3972 CONTAINING A SERVERABILITY CLAUSE; CONTAINING A
REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPENS MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE THEREOF.
WHEREAS, the City Council of the City of La Porte passed and approved Ordinance 2024-3972
on June 24, 2024, for the purpose of condemning and ordering the removal of the residential building situated
on real property commonly known as 114 S. Iowa St., La Porte, Texas; and
WHEREAS, subsequent to passage of Ordinance 2024-3972 by the La Porte City Council, Waimea
Investments LLC, the owner of real property and the residential building situated thereon, located at the
said 114 S. Iowa St., made contact with the City and requested additional time to repair the building; and
NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS:
SecQgpl, Ordinance 2024-3972 passed by the La Porte City Council on June 24, 2024, is hereby
repealed in its entirety.
Section L2. Should any section or part of this ordinance be held unconstitutional, illegal, or invalid,
or the application to any person or circumstance for any reasons thereof ineffective or inapplicable, such
unconstitutionality, illegality, invalidity, or ineffectiveness of such section or part shall in no way affect,
impair or invalidate the remaining portions thereof; but as to such remaining portion or portions, the same
shall be and remain in full force and effect and to this end the provisions of this ordinance are declared to
be severable.
Section 1, The City Council officially finds, determines, recites and declares that a sufficient
written notice of the date, hour, place and subject of this meeting of the City Council is posted at a place
convenient to the public at the City Hall of the city for the time required by law preceding this meeting, as
required by Chapter 551, TX. Gov't Code; and that this meeting has been open to the public w required by
law at all times during which this ordinance and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 4. This Ordinance shall take effect and be in force beginning on May 27, 2025, at I L00
p.m. CST, subject to the condition that an authorized agent of Waimea Investments LLC, the owner of the
real property at 114 S. Iowa St., is issued a building permit by the City of La Porte for construction work
associated with the residential building located at 114 S. Iowa St., no later than 5:00 p.m. CST on May 27,
2025. Should Waimea Investments LLC and/or its authorized agent fail to receive a building permit for
construction work associated with the residential building located at 114 S. Iowa St. by 5:00 p.m. CST on
May 27, 2025, then in that event this Ordinance shall not take effect and shall be null and void.
