ORDINANCE NO.2025-4085 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE CITY OF LA PORTE, BY GRANTING SPECIAL CONDITIONAL USE PERMIT NO. SCUP-2025-0017, FOR AN AMENDMENT TO SCUP-2024-0011 WHICH WAS ADOPTED BY CITY COUNCIL AS ORDINANCE 2025-4047 ON FEBRUARY 10, 2025 TO: 1) ADD NAICS 4238 — MACHINERY, EQUIPMENT, AND SUPPLIES MERCHANT WHOLESALERS AS A PERMITTED USE WITHIN RESERVE 2; 2) CLARIFY WHICH REGULATIONS ARE APPLICABLE TO DEVELOPMENT FOR EACH RESERVE; 3) ADD OFFICES ONLY FOR ANY USE CODE TO THE PERMITTED USES WITHIN RESERVES 1 AND 2; 4) ADD CONDITION NUMBERS TO NAICS, WHERE APPLICABLE; 5) ADD THE NAICS TITLE TO PROPOSED USES; AND 6) UPDATE FOOTNOTE 15 CONDITION (AS ADOPTED BY ORDINANCE 2025-4054); LOCATED AT 11921 W. FAIRMONT PKWY., AND LEGALLY DESCRIBED AS TRACTS 2A, 39 49 4A & TRACT 23D BAYPORT U/R SECTION 1 ABSTRACT 625 R PEARSALL; HARRIS COUNTY, TEXAS; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS ACT; AND PROVIDING AN EFFECTIVE DATE HEREOF; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: Section 1. Chapter 106 "Zoning" of the Code of Ordinances is hereby amended by granting Special Conditional Use Permit #SCUP-2025-0017 attached hereto as Exhibit A and incorporated by reference for all purposes, for an amendment to SCUP-2024-0011 which was adopted by City Council as Ordinance 2025-4047 on February 10, 2025 to: • add NAICS 4238 — Machinery, Equipment, and Supplies Merchant Wholesalers as a permitted use within Reserve 2, • clarify which regulations are applicable to development for each reserve, • add Offices only for any use code to the permitted uses within Reserves 1 and 2, • add condition numbers to the NAICS, where applicable, • add the NAICS Title to proposed uses, and • update footnote 15 condition (as adopted by Ordinance 2025-4054) in the Planned Unit Development (PUD) zoning district, on a 130.56-acre tract of land, located at 11921 W Fairmont Pkwy., and legally described as Tracts 2A 3 4 4A & Tract 23D Bayport U/R Section 1 Abstract 625 R Pearsall, Harris County, Texas. Section 2. All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3. Should any section or part of this ordinance be held unconstitutional, illegal, or invalid, or the application to any person or circumstance for any reasons thereof ineffective or inapplicable, such unconstitutionality, illegality, invalidity, or ineffectiveness of such section or part shall in no way affect, impair or invalidate the remaining portions thereof; but as to such remaining portion or portions, the same shall be and remain in full force and effect and to this end the provisions of this ordinance are declared to be severable. Section 4. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council is posted at a place convenient to the public at the City Hall of the city for the time required by law preceding this meeting, as required by Chapter 551, TX. Gov't Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 5. The City Council of the City of La Porte hereby finds that public notice was properly mailed to all owners of all properties located within three hundred feet (300') of the properties under consideration. Section 6. The City Council of the City of La Porte hereby finds, determines, and declares that all prerequisites of law have been satisfied and hereby determines and declares that the amendments to the City of La Porte Zoning Classification contained in this Ordinance as amendments thereto are desirable and in furtherance of the goals and objectives stated in the City of La Porte's Comprehensive Plan. Project development shall be in accordance with the following conditions: 1. A site development plan shall be submitted, if necessary, in accordance with applicable requirements of the city of La Porte's development ordinance and shall comply with all provisions of chapter 106 "zoning" of the city's code of ordinances, and all other department reviews and applicable laws and ordinances of the city of La Porte, and the state of Texas. 2. All necessary documentation for building permit review must be submitted in conjunction with the city's building permit application process for any proposed building improvements. 3. Reserve 1 is approximately 15.42-acres along W. Fairmont Pkwy. and will have an underlying zoning district of Business Industrial (BI) and are subject to regulations applicable to development within BI zoning district, except as specifically provided otherwise in this SCUP. The purpose of the BI district is to provide for the establishment of industrial development that is compatible with surrounding or abutting residential districts and to encourage high level performance standards. Development in the BI district is limited to administrative, wholesaling, manufacturing and related compatible uses, with suitable open spaces, landscaping and parking area. 4. Reserve 2 is approximately 43-acres along Spencer Hwy. and will have an underlying zoning district of Business Industrial (BI) and are subject to regulations applicable to development within BI zoning district, except as specifically provided otherwise in this SCUP. The purpose of the BI district is to provide for the establishment of industrial development that is compatible with surrounding or abutting residential districts and to encourage high level performance standards. Development in the BI district is limited to administrative, wholesaling, manufacturing and related compatible uses, with suitable open spaces, landscaping and parking area. Page 97 of 198 5. Reserve 3 is approximately 72-acres along Bay Area Blvd. and will have an underlying zoning district of General Commercial (GC) and are subject to regulations applicable to development within GC zoning district, except as specifically provided otherwise in this SCUP. The purpose of the GC district is to provide for low intensity, retail or service outlets which deal directly with the customer for whom the foods or services are furnished. The uses allowed in this district are to provide goods and services on a community market scale and located in areas which are well served by collector or arterial street facilities. 6. No building shall be larger than 85,000 ft.z in total floor area in Reserves 1 and 2. 7. Architectural design guidelines for facades and buildings: (a) Building Form. (1) All buildings shall be designed and constructed in tri-partite architecture so that they have a distinct base, middle and top (paint or texture can be used to satisfy the tri-partite architecture requirement). No building wall shall extend for a distance equal to three times the wall's height without having a minimum off -set of 5 feet, and that new plane shall extend for a distance equal to at least 25% of the maximum length of the first plane. b. Vertical Articulation. No horizontal wall shall extend for a distance greater than three times the height of the wall without changing height by a minimum of 5 feet. Architectural design guidelines for facades and buildings in Reserves 1 and 2: (a) Exterior Fagade Materials (1) Allowed exterior materials are categorized into the following three groups, of which at least two materials from different groups shall be used in all exterior facades: a. Group A: Brick and stone. b. Group B: Stucco, architectural concrete block with integrated color (split face CMU), factory primed cementitious fiberboard in the form of lap siding or board and batten, EIFS (above 14 feet from grade only), and painted, colored or stamped tilt -wall. C. Group C: Metal, tile, wood. (2) Prohibited exterior materials include cinder block, vinyl, plastic, aggregate pea -gravel finished surfaces, and pre-engineered metal building siding. (3) Primary fagade treatment standards applicable to buildings. The following shall apply to all exterior walls of buildings which are clearly visible from a public street or along an active storefront: Primary Facades, excluding windows, doors, and other openings, shall be constructed of at least 20 percent Group A materials and up to 80 percent Group B materials. However, accent materials from Group C may be allowed in limited Page 99 of 198 application for architectural features as approved by the director of planning and development or designee. (4) Building color requirements are applicable to buildings in all tiers. The dominant color of all buildings shall be muted shades of color. Black and stark white shall not be used except as an accent color. There are no restrictions on accent colors which comprise less than one percent of the building face, except that fluorescent colors are prohibited. 9. Architectural design guidelines for facades and buildings in Reserve 3: (a) Roofs. (1) Where clearly visible from a public street or along active storefronts, any hip, gable or mansard roofs may only utilize the following materials: metal standing seam, slate, clay or concrete tile (barrel or Roman shape). Minimum three on 12 roof pitch required. (b) Architectural Design Elements. (1) The following is a list of acceptable architectural design elements that must be included into the design of buildings as required in this section. a. Canopies, awnings, porticos with colonnade, or arcades b. Raised pilaster cornices (end columns at corner), or quoin corners C. Vertical elements (tower, cupola, lighthouse, turret, arches, etc.) d. Windows and doors framed with smooth cobble, cast stone, limestone, or other decorative masonry headers and sills; or dormer windows e. Outdoor patios and/or courtyards (landscaped and furnished) f. Decorative ornamentation integrated into the building fagade, such as corbels, medallions (non-signage), functioning clocks, niches, wrought iron, balconettes, gargoyles, or horizontal and rhythm patterned brickwork; or other architectural features approved by the director of planning and development or designee g. Any other architectural design element approved by the director of planning and development or designee (2) All structures shall be designed to incorporate no less than two of the architectural elements above. Buildings over 50,000 square feet must include a minimum of three of the referenced architectural elements above. (c) Exterior Fagade Materials (1) Allowed exterior materials are categorized into the following three groups, of which at least two materials from different groups shall be used in all exterior facades: a. Group A: Brick and stone. b. Group B: Stucco, architectural concrete block with integrated color (split face CMU), factory primed cementitious fiberboard in the form of lap siding or board and batten, EIFS (above 14 feet from grade only), and painted, colored or stamped tilt -wall. (3) The following shall apply to all exterior walls of buildings which are clearly visible from a public street or along an active storefront: a. Primary Fagades, excluding windows, doors, and other openings, shall be constructed of at least 80 percent Group A materials and up to 20 percent Group B materials. However, accent materials from Group C may be allowed in limited application for architectural features as approved by the director of planning and development or designee. b. Buildings over 50,000 square feet may use Split -Face CMU (architectural block) for up to 20 percent of the primary facade, in addition to the 20 percent of Group B materials. (4) Building color requirements are applicable to buildings. The dominant color of all buildings shall be muted shades of color. Black and stark white shall not be used except as an accent color. There are no restrictions on accent colors which comprise less than one percent of the building face, except that fluorescent colors are prohibited. 10. All truck bays must be located to the rear of any building and screened from view of public right- of-way. 11. All on site areas utilized for storage, parking, or driving must be paved with either concrete or asphalt. 12. Total daily truck traffic to and from the building site shall be limited to a maximum of 10 trucks per day. 13. No shipping containers are permitted to be stored outside. 14. Any outside storage shall be screened from view of adjoining properties with an 8-foot-tall fence that shall be 100% opaque. Vinyl slating in conjunction with a chain -link fence is permitted. 15. Hazardous materials which may or may not require a placard may not be stored on site for any length of time. This prohibition includes hazardous materials stored in the building or on trucks and shipments of hazardous materials that are defined as in transit by the Department of Transportation. 16. 10% landscaping required. DISCUSSION Location: The subject property includes approximately 130.56-acre tract of land, located at 11921 W. Fairmont Pkwy. Background Information: The subject property is zoned Planned Unit Development (PUD). The future land use designation for the property is Business Industrial and Light Industrial. This SCUP is an amendment to SCUP-2024-0011 which was adopted by City Council as Ordinance 2025-4047 on February 10, 2025. The purpose of the proposed amended SCUP is to add NAICS 4238 — Machinery, Equipment, and Supplies Merchant Wholesalers as a permitted use within Reserve 2. Additional items were added or clarified with the amended SCUP by staff. These changes include: • clarifying which regulations are applicable to development for each reserve, • adding Offices only for any use code to the permitted uses within Reserves 1 and 2, Page 121 of 198 Planning and Zoning Commission Regular Meeting May 15, 2024 SCUP-2025-0017 • adding condition numbers to the NAICS, where applicable, • adding the NAICS Title to proposed uses, and • updating footnote 15 condition (as adopted by Ordinance 2025-4054). The subject property is proposed to be developed in 3 categories of uses. Reserves 1 and 2 have commercial and industrial uses. The key difference is that Reserve 1 has access from W. Fairmont Pkwy., which is on the High Frequency Truck Route. Reserve 2 has access from Spencer Hwy. which is not on the High Frequency Truck Route. Reserve 3 is proposed to have general commercial uses which are intended to provide goods and services to the residents of La Porte. As shown below, Reserve 1 is approximately 15.42-acres along W. Fairmont Pkwy. Reserve 2 is approximately 43-acres along Spencer Hwy. Reserve 3 is approximately 72-acres along Bay Area Blvd. Total land area for the subject property is 130.56-acres. The three areas are shown in the image below. The underlying zoning district is used to establish the primary set of regulations that govern how a property can be used and developed. It defines the basic land use category — such as residential, commercial, or industrial —and sets key development standards like building height, setbacks, landscaping and parking. When evaluating a development proposal, planners first assess compliance with the underlying zoning district, then apply any additional requirements. This layered approach allows cities to manage land use more flexibly while maintaining consistency, compatibility between neighboring uses, and alignment with a community's long-term planning goals. This will clarify which regulations are applicable to development for each reserve. Reserves 1 and 2 is proposed to have an underlying zoning district of Business Industrial (BI) and are subject to regulations applicable to development within BI zoning district, except as specifically provided otherwise in this SCUP. Reserve 3 is proposed to have an underlying zoning district of General Commercial (GC) and are subject to regulations applicable to development within GC zoning district, except as specifically provided otherwise in this SCUP. In addition, adding condition numbers to the NAICS, where applicable, adding the NAICS Title to proposed uses, and updating footnote 15 condition (as adopted by Ordinance 2025-4054) will enable staff to better review proposed developments for compliance with the designated underlying zoning district and approved SCUP. Zoning The subject property is zoned Planned Unit Development (PUD). The following describes staff's analysis: 1. Land Use. The future land use designation for the subject property is Business Industrial and Light Industrial. The future land use designation for Reserve 1 is Business Industrial. The future land use designation for Reserve 2 is Light Industrial. The future land use designation for Reserve 3 is Business Industrial to the west along Bay Area Blvd. and Light Industrial to the east. According to the Comprehensive Plan, the Business Industrial Future Land Use designation is for the establishment of industrial development that is compatible with surrounding or abutting residential districts. Uses are limited to administrative, wholesaling, manufacturing, office or industrial business parks, and related compatible uses. Industrial uses with outdoor storage or other operations are not appropriate within this designation. Office and commercial developments are appropriate within this designation. These areas should be located along major thoroughfares for easy transportation access and be screened and buffered from adjacent residential areas. Office and commercial development may be appropriate within this designation to support industrial development. Per Chapter 106 (Zoning) of the City of La Porte's Code of Ordinances, Offices only for any use code is permitted within all industrial zoning districts. The proposed amendment to SCUP-2024-0011 to add Offices only for any use code to the permitted uses within Reserve 2 is compatible with the Future Land Use designation and zoning district regulations. Per Chapter 106 (Zoning) of the City of La Porte's Code of Ordinances, NAICS 4238 — Machinery, Equipment, and Supplies Merchant Wholesalers is not permitted within the Business Industrial zoning district, requires an approved Special Conditional Use Permit within the Light Industrial zoning district and is permitted with footnote 19 within Heavy Industrial zoning district. Footnote 19 adds a limitation that the "total site area may not exceed five acres with a maximum building size of 40,000 sq. ft. A conditional use permit (CUP) may be sought for individual sites in excess of five acres or buildings greater than 40,000 sq. ft." The proposed amendment to SCUP- 2024-0011 to add NAICS 4238 — Machinery, Equipment, and Supplies Merchant Wholesalers to the permitted uses within Reserve 2 is compatible with the Future Land Use designation but is not compatible with the underlying zoning district regulations. However, the approved SCUP-2024- Page 125 of 198 Planning and Zoning Commission Regular Meeting May 15, 2024 SCUP-2025-0017 0011 does include limited building sizes and increased design guidelines to minimize the impact the proposed development will have on neighboring properties. The increased regulations applicable to developments within the SCUP will enhance the quality of the development and provide compatibility. General Commercial land uses are appropriate in both the Business Industrial and Light Industrial Future Land Use designations. Staff worked closely with the property owner to propose uses that would be compatible with surrounding uses and adding reasonable conditions that would minimize the impact on surrounding properties. 2. Access. The site will have access from W. Fairmont Pkwy., Bay Area Blvd., and Spencer Hwy. The number of access points will be determined when the property is developed. 3. Utilities. Development of the property may require infrastructure to be extended and/ or relocated. There are existing water lines along W. Fairmont Pkwy., Bay Area Blvd, and within the property boundary closest to Spencer Hwy. There are existing sewer lines along W. Fairmont Pkwy., and Bay Area Blvd. The sewer line may need to be extended to service the property along Spencer Hwy. Water and sewer services are available to serve the property. Notification Requirements: Staff finds that the public hearing notification requirements outlined in Section 106- 171 were performed in accordance with code provisions, including the following: notice in a newspaper of general circulation at least 15 days prior to the hearing; written notice mailed to owners of real property within 300 feet of the site within 10 days of the hearing; and a sign was posted in the area within 15 days of the hearing. In accordance with state law, notice of the public hearing was also posted at City Hall and on the City's website. Staff sent fifty-six (56) notices of the public hearing to all property owners within 300 feet of the site. As of the date of this writing, no (0) citizen comment sheets have been returned. ODIA submits the application accompanying this letter to request that the SCUP be amended to correct a scrivener's error. Between the time the Planning & Zoning Commission voted to recommend approval of the SCUP and City Council's vote to approve the SCUP, changes were made to Section 18 of the draft SCUP, which is the list of NAICS code uses permitted in Reserve 2, that resulted in the omission of NAICS code 4238 from that list. After discussions with city staff, we believe that the omission was inadvertent and that the use is appropriate within Reserve 2. ODIA has entered into an agreement with a user operating under that NAICS code for the purchase of a portion of Reserve 2 and is requesting this amendment to cause the SCUP to reflect ODIA's agreement and discussions with city staff and the recommendation of P&Z. We believe that this NAICS code in general and the particular user interested in the property are appropriate for the property and consistent with the future land use designation of the property. The user is familiar with the SCUP and is prepared to comply with its terms and conditions.
