Chairman Mike Mosteitcalled the meeting to order at 5:09 p.m. Members of the Drainage and
Flooding Committee present: Vice Chairman Mike Clausen and Committee MemberChuck

3. Receive and discuss Proposals for Engineering Services for future Drainage Projects
authorizing staff to present proposals for Engineering Services for Preliminary Engineering
Design to City Council

City Engineer Julian Garzaprovided proposals forEngineering Services for future Drainage
Projects in regards to Battleground Estates, Northwest Park Diversion Basin (Redirection of F101-
06) Channel Improvements to B112 and Shady River in addition to requesting authorization of staff
to present the proposals for Engineering Services for Preliminary Engineering Design to City
Council.

Committee member Zemanek asked questions as to cost, and the restriction isat the Battleground
Estates project at “P” Streetand asked whether the 48 inch pipe would alleviate the current
problems.He also inquired as to the cost to move water in the direction it is currently movingin
reference to the redirection of F101-06. City Engineer Garza commented gravity is the best
direction rather than redirecting the flow.He asked whether the problem was getting water out of
the Shady River sub-division or if it was “tidal” influenced.
Alternate Member Leonard voiced his concerns with the redirection of water flowfrom F101-06. He
said that this may create additional problems to those that currently exist in this areaand could
reverse some of the improvements that have already been made.He is also concerned with a
possible detention pond placed in the area that is currently used for parking area during eventsat
theLomax Rodeo Arena, which would adversely affect the entire city.
Danny Earp, 1827 Lomax School Rd., addressed the Drainage and Flooding Committee suggesting
it would be best to use money to resolve the issue rather than for an Engineering Survey.
Mike Cobb, 109 Summer Winds Dr., addressed the Drainage andFlooding Committeewith
concerns of the proposal and the effects on the parking space at Lomax Arena during events.
Joe Smith, 10802 North H Street, addressed the Drainage and Flooding Committee with concerns
of pipelines and requested water not be redirected the opposite direction, but to use gravity to send
it to the Bay.
The Drainage and Flooding Committee directed staff to exclude the proposal and to work on other
alternatives and come back with another plan regarding Northwest Park Diversion Basin
(Redirection of F101-06).
Committee member Engelken commented there have been too many studies, and it is now time to
resolve the issues. City Engineer Julian Garza responded he is not proposing to do work that has
already be done and informed drainage studies have to be performed before Harris CountyFlood
Control Districtwill provide assistance. Committee member Engelken responded he had heard the
word “study” enough.
The Drainage and Flooding Committee directed staff to not have any more studies done other than
the minimum standards to meet with the standards of Harris County Flood Control.
City Engineer Garza was directed to postpone the Channel Improvements to B112project until the
next meeting.
4. Set date for next Drainage and Flooding Committee Meeting
Chairman Mosteit set the next Drainage andFlooding Committee Meeting on a date prior to the

3. Receive report from City Staff and Harris County Flood Control District regarding Northwest
Park Diversion Basin (Redirection of F101-06)
– J. Garza
City Engineer Julian Garza and Gene Rushing, Jr. of the Project Management Sectionwith Harris
County Flood Control District provided a report regarding Northwest Park Diversion Basin
(Redirection of F101-06).Mr. Rushing reported it wouldbe twelve months before the preliminary
engineering report would be available.
Vice Chairman Clausen questioned who regulates the depth of pipelines. City Engineer Julian
Garza advised the Texas Railroad Commission governs the safety of pipelines.
Chairman Mosteit questioned the expansion on Valleyviewand if there would be any homes
affected. Mr. Rushing advised there were a number of alternatives to be considered in order not to
affect homes. Chairman Mosteit also questioned if the preliminary reporthad been funded. Mr.

Rushing advised the preliminary report had been funded but funding would be required for
construction of the project.
Chairman Mosteit directed staff to forward a copy of the Northwest Park Diversion Basin
presentation provided by Mr.Rushing to the Drainage and Flooding Committee and other Council
members.
4.Discuss City-Wide Drainage Issues – J. Garza
City Engineer Julian Garza updated the Drainage and Flooding Committee on the progress of
drainage projects.
Committee member Zemanek requested the directiongiven to staff in regards to the Battleground
Estates and Shady River projects. City Engineer Julian Garza responded to move forward for
Council direction onawarding consulting contracts to Klotz and Associates for Battleground Estates
and Civil Tech Engineering for Shady River. Mr. Garza also added the contracts were in phases
and staff would have to bring back any additional work to the Drainage and Flooding Committee
and City Council for authorization before moving forward.
Committee member Engelken requested the status ofhalf of the B-112Channel that was
conducted by Harris County Flood Control Districtin the 1970’s. John Randolph with Harris County
Flood Control District reported there was not any plans to move forward at the presenttime. Mr.
Randolph also informed plans cannot be located onthe project other than the concrete and figures
of the construction performed in-house in the 1970’s. Committee member Engelken questioned if
Harris County Flood Control District had proposed plans for the three thousand foot section that is
now located inthe City of La Porte.Mr. Randolph responded there were not any proposed plans to
his knowledge.Committee member Engelken advised Mr. Randolph he had been informed by
Director Harris County Flood Control District Mike Talbot would be looking at B-112 Channel for
improvements.
Committee member Engelken requested an update on buyoutsin the Brookglen Subdivision. John
Randolph with Harris County Flood Control District reported there are fifty-seven properties within
two blocks affected in the Brookglen Subdivision. Thirty-five had been purchased, four were in
settlement, one in negotiation, one pending, three had withdrawn, five had not responded and eight
did not qualify. Committee member Engelken questioned if there was recourse for citizens with
vacant lots next to their homes. Mr. Randolph advised of interlocal agreements with communities
for parks, landscaping and community gardens at no cost.
Committee member Zemanek questioned if the water coming from the City of Deer Park hasan
effecton the flooding in the Brookglen subdivision. Gary Struzick with Klotz and Associates
responded there was a problem getting water out of the subdivision and into the stream in addition
to older design issues. Committee member Zemanek questioned if there was an issue with large
amounts of water coming from Deer Park into La Porte. Mr. Struzick responded he was not aware
of an issue with large amounts of water coming from Deer Park into La Porte.Committee member
Engelken commented he respectively disagreed with the analysis given by Mr. Struzick on water
getting out of the Brookglen Subdivision due to a survey conducted by the University of New
Orleans and living in the subdivision witnessing water flowing fine out of the channelbut ditches
causing the problem of water getting out of the subdivision.
The committee directed City Engineer Julian Garza to postpone consulting contracts for B-112
Channel Improvements until meeting with the City of Pasadena regarding their development plans
and the impact on projects in the City of La Porte.
Chairman Mosteit directed staffto add an agenda item for Drainage Reports and all future City
Council Meetings.

Chairman Mosteit set the next Drainage andFlooding Committee Meeting for mid December2011.

– The Committee did not have additional comments.
Committee member Engelken thanked Harris County Flood Control District for attending the
meeting and providingareport; the clean-up of the lots in Brookglen and commented on the
appreciative phone calls and emails regarding the Desilting project.Committee member Clausen
thanked staff and Harris County Flood Control District for their reports and everyone for attending
the meeting. Chairman Mosteitthanked staff and Harris County Flood Control District for reports;
directedstaff to add Jack Rodriguez to the distribution list to attend future meetingsandthanked
Councilmember Kaminski for attending the meeting.
7.Executive Session
– There was noexecutive session.

SUMMARY
The Texas Energy Coalition or its membership will present the regulatory framework of the pipeline
industry and address City of La Porte areas of concern including conflicts of existing pipelines with new
drainage facilities and new pipelines across existing drainage facilities, construction practice of pipelines
to insure drainage is not impeded during construction and construction start times.
Action Required:
Receive report from the Texas Energy Coalition or its membership and provide members of the Drainage
Committee and Texas Energy Coalitionthe opportunityto ask questions regarding the regulatory
framework and City of La Porte areas of concern.
