to receive comments on a proposed expenditure of the La Porte Development
Corporation funds to pay for an incentive grant in the amount of $500,000.00 for a project to provide
infrastructure improvements to the InterGulf World Headquarters site on State Highway 146 in the
City of La Porte–S. Osborne
The public hearing was opened at 5:01p.m.Economic Development Coordinator Stacey Osborne
presented a summaryregardinga proposed expenditure of La Porte Development Corporation
funds for an incentive grant in the amount of $500,000.00 fora project to provide infrastructure
improvements to the InterGulf World Headquarters site on State Highway 146 in the City of
LaPorte.
Boardmember Woodard asked ifInterGulf Corporationownsthe property. Economic Development
Coordinator Stacey Osborne responded she was not certain if InterGulf Corporationownsthe
property she only knew they are in the process of purchasing the property. Boardmember
Woodard questioned if the value of the landis based before or after improvements. City Manager
Corby Alexander responded the value isbased on before improvements. Boardmember Woodard
questioned what would be the value of the property after improvements. City Manager Corby
Alexander responded the property would have to be appraised after improvements are completed

no financial information provided for the amount of payback time.

Boardmember Zemanek questioned who would benefit with the proposed closing of the N. 11
Street right-of-way. Economic Development Coordinator Stacey Osborne responded half would
benefit the particular project,and other half would benefit the current owners. Boardmember

Zemanek asked what will be the anticipated City proceeds for closing the 11Street and D Street
rights-of-way. City Manager Corby Alexander responded approximately $32,000.00-$35,000.00 for

Boardmember Engelken questioned why InterGulf Corporation was not present during the meeting.
Economic Development Coordinator Osborne responded InterGulf Corporation was invited to
attend the meeting. They were informed their attendance was not required.

Board member Ojeda made note of a correction to paragraph four of the Background of the
Request for Proposal that the City of La Porte does have a coffee shop (Java Cakes).
Board member Woodard commented he did not think census information should be used in retail
studies.

Attached is the excerpt fromthe Bylaws of the Development Corporation. Article III addresses the
management of the corporation. The second paragraph of Article III, Section 3.02 reads, “The Board of
Directors shall appoint a President and Vice Presidentby October 1 of each year. The President shall be
the presiding officer for meetings and the Vice-President shall act in the President’s absence.”
The Board should consider appointing a President and Vice-President of the Board through October 1,
2012, or until successors shall have been duly appointed.

SUMMARY & RECOMMENDATION
In the 2008-09 budget year, the La Porte Development CorporationBoard agreed to fund an
enhancement grant program for the Main Street Overlay District. The program offered matching
grants of up to $25,000 for businesses in the Main Street Overlay District to improve building
facades. The project was allotted $200,000and $168,000 is currently available. The goals of the
project were to beautify Main Street, to enhance Main Street’s appeal to new businesses and
visitors, and to add value to the City of La Porte. Kathleen Lemon, owner of Eiland, Lemon, and
Pierce, P.C.,was conditionally awarded with a grant not to exceed $17,845 by the La Porte
Development Corporation Board in May 2012.
Ms. Lemon has submitted receipts for the completed work, which totals $36,090 and is slightly
more than what was originally approved by the Board due to additional landscape work. The
attached photos demonstrate that the scope of work proposed in Ms. Lemon’s application has
been completed. Staff is recommending disbursement of $17,845 to Ms. Lemon based on the
originally approved project amount of $35,690. The property does not have any delinquent taxes
owed.

actual award will be one-half of the amount Ms.Coxspends on approved expenses for the
project up to $17,611, and will be contingent upon the project being completed as indicated in
this grant application. Attached is the application that Ms. Coxsubmitted, as well as additional
clarification information on the cost breakdown, as requested by the evaluation committee.
The committee recommends that the Board conditionally award a grant in an amount not to
exceed $17,611, based on receipts and completion of work as indicated.

SUMMARY & RECOMMENDATION
In the 2012budget year, the La Porte Development CorporationBoardagreed to fund
improvements to Lomax Park and Arena.Work was originally scheduled to occur in two phases
and the original budget for Phase One was $1,200,000. Phase One included improvements to the
arena and new improvements to the park, such as a new restroom and concession building. The
EDC included half of this project budget in the FY 12 budget,with the other 50% coming from
the General Fund. Funds have already been expended for design and building demolition,
leaving $1,030,000 for the construction of the new restroom/concession building andthe arena
improvements.
Since that time, the City has been working with an architect to design and bid the project. Bids
were received on July 9 but were $520,000 over the construction budget. As a result of these
bids, staff has been working with Council and the community to value engineer the project and
identify all possible options for the project. On October 8, 2012, staff presented seven project
options to the Council and Scenario F was selected as the new scope of work for the Lomax Park
Improvements (see exhibit). Scenario F includes all work that was originally planned for Phases
One and Two. Total estimated cost for Scenario F is $1,770,000.
During the December 10, 2012 meeting, Council directed staff to approach the EDC regarding
funding the additional $740,000 to construct the project. It is possible that the EDC could be
reimbursed for part or all of this additional funding by the General Fund CIP based on potential
savings from existing projects.

During the budget discussions for the 2012-13 FY, the Board of Directors approved the
expenditure of $25,000 for a retail study for the City of La Porte. Working with the Purchasing
Department, staff prepared a RFP for the study,which was distributed in December 2012.
Proposals were received from 4 firms. An evaluation teamcomprised of La Porte Development
Corporation Board members and City staff interviewed all four firms and hasrecommended
Catalyst Commercial as the highest rated firm based onthe team’sinterviews and the submitted
proposal.
Catalyst was chosen as the top firm based on the following reasons:
Catalyst’s proposal was within the established budget for the project. It was the only proposal to
be within budget.This pricing proposal includes travel and reimburseables.
The team highly valued the fact that Catalyst’s President was very active within the leadership of
ICSC (international Council of Shopping Centers). These connections through ICSC will be key
to recruiting and attracting firms to La Porte.
Catalyst received excellent references from those provided.
The team was also pleased with Catalysts’ philosophy that the job was not done until there was
tangible progress made. Instead of providing the retail study and walking away, Catalyst will
ensure that the study and its contents are used to land retail establishments in La Porte.
