Meeting called to order by Chairman Hal Lawler at 6:00 p.m.

Commission.
Public hearing notices were mailed to nine property owners within 200 of the subject

County, Texas. Donald Wayne Giffin, Sr., property owner, seeks
Low Density Residential (R-1) to General Commercial (GC) for proposed expansion of existing
business at 3122 Underwood Road.

City Planner Masood Malik presented the staff report and respond

Public hearing notices were mailed to 12 property owners within 200 of the subject property.
The City received one response in favor of the rezone request.
B. Proponents
J.B. Williamson, as legal representative for Mr. Giffin, addressed the Commission. The
business (Dons Radiator Shop) has been operating since 1983 and is doing very well. Mr.
Giffin, the owner, wants to utilize the lots in the rear of the building to enlarge the bays and
modernize the facility, with no additional ingress/egress planned for Andricks Street. Mr.
Giffin has discussed his request with at least 14 area property owners and all are in favor of
the plan.

Don Giffin, Sr., a lifelong resident of La Porte, addressed the
his business has been operating since 1983. He stated the business currently has access from
Andricks Street, as well as, Underwood Road, but no other driveways along Andricks are being
proposed with this request.

Open Workshop to discuss request for expansion of revitalizationfor

proposed multi-family development by Bonner Carrington.
Planning Director Tim Tietjens presented the staff report. Bonner Carrington is proposing to develop a
tax credit multi-family senior project along Canada Road and is requesting the Cir
designating the subject tract of land as a revitalization area in the Comprehensive PlanCity Council is
currently reviewing an update to the Comprehensive Plan.
Stuart Shaw, President of Bonner Carrington, provided the Commission a product brochure and
offered the following information about the project:
The proposed development, Mariposa Apartment Homes at Pecan Park, is a 180-unit, 1 & 2
bedroom, tax credit, multi-family senior project to be located along Canada Road.
25 million dollar investment in the community.
Prospective tenants will be from lower-middle class to middle class, 55 years and older; no
children.
12-13 years experience developing this type of project throughout Texas and in the Houston
area.
Received full support from the Pecan Crossing neighborhood group.
Project will be developed with long term ownership and maintenance in mind.

Will be aesthetically pleasing, exceeding the Citys landscape requirements.
Will be required to abide by the rules established by the Texas Department of Housing and
Community Affairs (TDHCA) in order to obtain funding.
Will be competing for TDHCA funding with other developments in the Houston region.
Mr. Shaw requested City Council consider including this tract as part of the nearby Revitalization Zone.
The Commission and staff discussed the appropriate avenue for acting on Mr. Shaws request.
Motion by Commissioner Bird directing staff to develop a recommendation to City Council requ
an amendment to Map 2.1 of the Revitalization Plan for the Comprehensive Plan to include the subject
tract, which is located along Canada Road, east of Pecan Park. Second by Commissioner Hoot. Motion
carried.

Discussion Item
Summary:
City Council received an inquiryabout an effective enforcement of the City’s dust free
surface criteria. Council directed staff to study the issue and present it to the Planning and
Zoning Commission for their consideration.At the October 18, 2012, meeting, the
Planning and Zoning Commissionformed a subcommittee,whose members include
Danny Earp, Mark Follis, Phillip Hoot, and Les Bird. The subcommittee worked with the
City’s Planning Director, City Planner, City Engineer, and Sr. Project Engineerto
analyzethe criteria and provide a recommendation for dust free surfacing.
The subcommittee met three times todiscuss measurement criteria for dust free surface
applicable for all zoning districtswithin the City limits. Staff was directed to furnish the
APA’s Planning Advisory Service’s findings on the subject matter. Staff contributed to
facilitate the process. Based on subcommittee’sinput, staff preparedrecommended
options (ExhibitA) for the Commission’s consideration.

Zoning Ordinance & Development Ordinance Review
Background:
Chapter 106 “Zoning” of the City’s Code of Ordinances, Section 106-65 directsthe
Planning and Zoning Commission to conduct a regular comprehensive review of the
Zoning Ordinance together with the Development Ordinance of the City. The purpose
of a review is to determine whether the chapter has become deficient, obsolete, and
inadequate for any reason including the following:
1.Defects in the original text.
2.Defects in the zoning map.
3.Deficiencies created by improper or lax administration and subsequent
amendments to the original ordinance which are inconsistent, conflicting or
ambiguous.
4.Inconsistency with state statutes or judicial decisions.
In addition, the City of La Porte Comprehensive Plan 2020identifiesissues, needs,
assets, and challenges related to redevelopment efforts. The recently completed
Comprehensive PlanUpdate 2012encouragesreview of the zoning and development
ordinances in order to improve use compatibility, conserve natural resources and open
spaces, and contribute to a fiscally responsible pattern of urban growth.
One of the primary action items for implementation is to prepare aUnified
Development Code or modifications of regulatory provisions to ensure an effective
transition from the Comprehensive Plan to the implementing regulations. To move
forward, staff suggestsan overallreview of the current Zoning Ordinance.In addition,
severalchanges/additionsto the Development Ordinanceand subsequentamendments
require the Commission’s review and shouldbe codified to becomepart of the City’s
Code of Ordinances.
