DebbieWilmorepresentedtheBoardwithacopyofa03/22/12letteranda03/27/12e-mailreceived fromMarlaStringer.Theletterrelinquished“existing”license/permits#41,44and65;andthee-mail relinquishedtheremaining(3)Committee“approvedbutcurrentlyunfilled”license/permitspots.Two werepreviouslyknownaslicense/permits#42and45;however,onespothadneverbeenfilledso thereisnonumbertoreference. 5.Consideractiontosuspend,cancelorrevokeissued2012WreckerLicense/PermitNumbers41,44 and65aswellasthree(3)Committee“ApprovedbutUnfilled”wreckerlicense/permitsforStringer WreckerService,LLCDBAMcGintyWreckerService. A.Openpublichearing ChairmanTietjensopenedthepublichearingat3:09p.m. B.Staffcomments Mrs.WilmoreadvisedtheCommitteethatTaylorTowingdoesnothavetheirownwreckeryard; so,theirapplicationreflectsutilizingWaltandAnitaJones’yard(A&WJonesCollisionand VehicleStorageFacility)whichwaspreviouslyutilizedbyStringerWreckerService,LLCDBA McGintyWreckerService. C.Publiccomments ChairmanTimTietjensreiteratedthetwoconcernstheBoardneedstoconsider. 1.TaylorTowing’srequesttoaddfour(4)truckstotherotationlistandtheirresponsetime. 2.WhetherJones’“leased”yardcanbeconsideredinlieuofthe“owned”yardrequiredby currentregulations. ClarkAskins,statedperSection78.297oftheCodeofOrdinances,TaylorTowingmustowna yardtooperate.HadMcGintyWreckerServicesimplytransferredtheirpermitstoTaylor Towingratherthanrelinquishingthem,theCommitteecouldhaveconsideredthe“leased”yard shouldtheyfeelTaylorTowingmetallotherconditionsforanewpermit. CharlieHinds,ofCharlieHindsPaintandBody,spokeagainsttherequestbyTaylorTowingfor issuanceoffour(4)emergencyautowreckerpermits. ToddJohnston,ofAppleTowing,spokeagainsttherequestbyTaylorTowingforissuanceoffour (4)emergencyautowreckerpermits. WaltJones,ofA&WJonesCollision/Storage,spokeinfavoroftherequestbyTaylorTowing.Mr. JonesstatedtheiryardwasapprovedbytheCommitteeforusebyMcGinty;so,theyardshould beconsideredacceptableforTaylor. AnitaJones,ofA&WJonesCollision/Storage,spokeinfavoroftherequestbyTaylorTowing. Mrs.Jonesstatedtheyhadoriginallymadeapplicationforwreckerpermitsundertheirname, buttheCityAttorneymadethemchangetheapplicationtoMcGinty.Hadthatchangenotbeen made,theyardwouldn’tbeunderdiscussionatthistime. WreckerCommittee MinutesofMarch27,2012 Page 3of3 Mrs.WilmoreadvisedtheCommitteethattheapplicationMrs.Jonesreferredtorelatedto permitsonthewreckers.SincethewreckerswereownedbyMcGintyandMcGintywouldbe providingtheserviceataccidentscenes,thepermitshadtobeissuedtoMcGinty.TheJones’ leasedyardwasacceptableatthattime(priortoalaterordinancechangethatrequiredyard ownership).TheCityAttorneyandtheCommitteeallowedtheapplicationtobeamended duringthewreckercommitteemeetingandsubsequentlyapprovedthepermitsforMcGinty. Mr.AskinsconfirmedfactsoutlinedbyMrs.Wilmore. ApplicantPaulTaylorspokeinfavoroftheapplication. Mr.Tietjensclosedthepublichearingat3:25p.m. 7.Consideractiontograntordenyfour(4)emergencyautowreckerpermitstoTaylorTowingunder Section78-297oftheLaPorteCodeofOrdinances. Mr.Askinsstatedthatbasedonthecurrentregulations,theCommitteecouldonlyconsider approvalofTaylorTowing’srequestif:(1)TaylorTowingownsavehiclestoragefacilitywithinthe CityofLaPorte;or(2)McGintyhadtransferredtheirpermitstoTaylorTowing.Sinceneither situationexists,existingregulationsprohibittheCommittee’sapprovaloftherequestedpermits. Mr.WaltJonestoldtheCommitteethathadtheyknowntheapplicationchangewouldeliminatethe useoftheyardbyanyoneotherthanMcGinty,theyneverwouldhavemadethechange.Hefeels theCommitteeshould“grandfather”theyardsincetheydidn’tunderstandtheimpactofthe change. Mrs.FogartyaskedstaffifTaylorTowinghadpreviouspermitswithLaPorte.Mrs.Wilmoreadvised theyworkedwithapreviouscardealershipbutthepermitshadbeeninthedealership’snameand Taylorhadprovidedthetrucksandserviceandthecarswerestoredatthedealership.
