A RESOLUTION OF THE BOARD OF DIRECTORS OF THE LA PORTS FIRM
CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT
ESTABLISHING THE FISCAL YEAR FOR THE DISTRICT/ SETTING FORTE
PROCEDURES FOR ADOPTING THE DISTRICT'S BUDGET / APPOINTING A GENERAL
MANAGER OF THE DISTRICT / FINDING COMPLIANCE WITH THE OPEN MEETINGS
LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF
WHEREAS, the Board of Directors (the "Board ") of the La Porte
Fire Control, Prevention, and Emergency Medical Services District
(the "District ") is required to establish the fiscal year for the
District and may adopt alternative procedures for adopting a budget
that differ from the procedures outlined in the District's enabling
legislation; and
WHEREAS, prior to the Board adopting any alternative
procedures, the Board is required to hold a public hearing related
to such procedures; and
WHEREAS, on July , 2011, the Board held a public hearing on
the proposed procedures, at the time, date and place published in
the notice therefor; and
WHEREAS, after the public hearing, the Board believes that it
is desirable to adopt alternative budget procedures;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
LA PORTE FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES
DISTRICT:
Section 1. All matters and facts set forth in the recitals
above are found to be true, and are approved as the processes and
procedures which the Board of Directors of the La Porte Fire
Control, Prevention, and Emergency Medical Services District
undertook and completed prior to the adoption of this resolution.
Section 2. The fiscal year of the La Porte Fire Control,
Prevention, and Emergency Medical Services District shall begin on
the first day of October and shall end on the last day of September
of each calendar year. Such fiscal year shall also constitute the
budget and accounting year.
Section 3. The following are the procedures which shall
govern the adopting of a budget for the District by its Board:
a. Public hearing before the Board required. Not later than
the 60th day before the date each fiscal year begins, the
Board shall hold a public hearing on the proposed annual
budget for the upcoming fiscal year. However, it is
recommended that this public hearing be held not later
than the 75th day before the date each fiscal year
begins.
b. Publication of time, date and Place of public hearing.
The Board shall publish notice of the time, date and
place of the public hearing on the proposed budget in a
newspaper with general circulation in the District not
later than the 10th day before the date of the hearing.
c. Public hearing held before the Board. At the public
hearing conducted by the Board, all residents of the
District are entitled to be present and participate in
the hearing.
d. Adoption of budget by the Board. After the public
hearing on the proposed budget, the Board shall adopt a
budget for the upcoming fiscal year. The Board may make
any changes in the proposed budget that in its judgment
the interests of the taxpayers demand. Should the Board
take no final action on or prior to the 60th day before
the date a fiscal year begins, the budget as originally
proposed by the General Manager for the upcoming fiscal
year shall be deemed to have been finally adopted by the
Board.
e. Submission of budget to the City Council of the City of
La Porte. Within 10 days after the budget is adopted or
deemed adopted by the Board, the Board shall submit the
budget to the City Council of the City of La Porte (the
"City Council ").
f. Amendment of the budget. The District's budget may be
amended after the beginning of the fiscal year on
approval of the City Council.
Section 4. Ron Bottoms is appointed as General Manager of the
La Porte Fire Control, Prevention and Emergency Medical Services
District.
Section 5. The Board officially finds, determines, recites,
and declares that a sufficient written notice of the date, hour,
place and subject of this meeting of the Board was posted at a
place convenient to the public at the City Hall of the City of La
Porte for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this resolution and the subject
matter thereof has been discussed, considered and formally acted
upon. The Board further ratifies, approves and confirms such
written notice and the contents and posting thereof.
Section 6. This resolution shall take effect immediately from
and after its passage by the Board of Directors of the La Porte
Fire Control, Prevention, and Emergency Medical Services District.
