ADJOURN • `~ BONCOSKY TRUCKING TERMINAL (PLANNED UNIT DEVELOPMENT) GENERAL PLAN • • Stafl'Report Boncosky Trucking Terminal May 1, 1997 General Plan Reauested Bv: John Boncosky of Boncosky Services Reauested For: A 6.3192 acre tract of land out of a portion of Blocks 1203 and 1204; Town of La Porte, now known as Tract 1K, Johnson Hunter, Abst. 35, and a portion of Tracts 37A & 37B, George B. Mc Kinstry, Abst. 47, which is further described as being located in the 1700 Block of South 16~' Street, La Porte, Texas. Present Zoning: Planned Unit Development (P.U.D.) with Special Conditional Use Permit #SCU 96-003. Reauested Use: Trucking Operation with Tank Truck Cleaning Background: The General Plan for this development was reviewed by the Planning & Zoning Commission at their April 17, 1997 meeting. -- On April 15~' the applicant submitted an amended general plan which corrected many of the items referenced in staff s original April 17~' report. Based on that new submittal, staff changed their recommendation from "Disapproval" to "Conditional Approval". Subsequently, the Commission granted "Conditional Approval" during the April 17~' meeting. The applicant has now submitted an "amended" General Plan of the development and is asking for the Commission's approval. The new "amended" General Plan is identified as Exhibit A. On October 17, 1996, a Planning & Zoning Commission public hearing was held to consider Zone Change Request #R96-004. The Commission recommended an Intra-District P.U.D. with a Special Conditional Use Permit (#SCUP 96-003) ubject to specific conditions. This recommendation was approved by City Council at their November 11, 1996 meeting with the adoption of Ordinance 1501-V. As requested, the conditions of #SCUP 96-003 are stated on the "amended" General Plan identified as Exhibit A. A copy of the General Plan Checklist follows this report. Any outstanding items will be reviewed at the preliminary and final plat submittal of each of the development phases. Conclusion: As noted above, remaining issues will be addressed at the prelirttiflary and final plat submittal stage. Staff recommends the _ General Plan be "Approved" with the following conditions. 1. Correct the required reference to #SCUP 96-003 on the face of the plat. This reference should be as follows: On November 11, 1996, City Council considered Zone Change Request #896-004 and Ordinance 1501-V was approved by Council granting the P.U.D. with Special Conditional Use Permit #SCUP 96-003. 2. Delete condition number six since it was satisfied with the granting of #SCUP 96-003. There will be eleven remaining conditions. 3. Amend General Plan as per checklist. 4. The original approved mylar of the General Plan ,signed by the developer and planning consultant, shall be provided to the City for placement in the official files of the Planning & Zoning Commission. Staff Report Boncosky Trucking Terminal May 1, 1997 Preliminary Plat Reauested Bv: John Boncosky of Boncosky Services Reauested For: A 6.3192 acre tract of land out of a portion of Blocks 1203 and 1204; Town of La Porte, now known as Tract 1K, Johnson Hunter, Abst. 35, and a portion of Tracts 37A & 37B, George B. Present Zoning: Planned Unit Development (P.U.D.) with Special Conditional Use Permit #96-003. Requested Use: Trucking Operation with Tank Truck Cleaning Background: The Planning & Zoning Commission at their April 17, 1997 meeting granted Conditional Approval of the General Plan for this development. This allowed the applicant to submit an "Amended" General Plan and a Preliminary Plat for review by the Commission. The "Amended" General Plan is being considered as a separate item on the agenda. The General Plan requires approval before the Commission can approve the Preliminary Plat. Based on their review of the "Amended" General Plan, staff recommends approval of the General Plan with minor changes. Analysis: Using Appendix D of the City's Development Ordinance 1444 as a guide, staff reviewed the Preliminary Plat and found it complies with City's requirements. A copy of the Preliminary Plat Checklist follows this report. Approval of the Preliminary Plat by the Commission authorizes the developer to file a Final Plat. Conditional Approval of the Preliminary Plat by the Commission requires submission of an amended Preliminary Plat and additional documentation as specified by the Commission for final Commission approval. Conclusion: There are remaining issues that need to be addressed. These issues will have to be satisfied prior to the approval of the Final Plat. Conditional approval of the Preliminary Plat will allow the applicant to resubmit an "Amended" Preliminary Plat along with the Final Plat. This will enable the applicant to meet with City staff to resolving any outstanding issues. Staff recommends "Conditional Approval" with the following conditions. 1. The original approved mylar of the General Plan, signed by the developer and planning consultant, shall be provided to the City for the official files of the Planning & Zoning Commission. 2. Water and sewer routing, construction and design shall be approved by the City. 3. The Final Plat shall reflect the property owner's signature authorizing the platting of the property. 4. Drainage plans shall be approved by Harris County and the City of La Porte. 5. Detention shall be approved by the City. 6. Proposed landscaping shall be subject to approval by the Director of Planning. 7. The applicant is responsible for obtaining a zoning permit. 8. See items noted on the Preliminary Plat Checklist. 9. The declaration of P.U.D. covenants, conditions or restrictions or equivalent shall specify that deeds, leases or documents of conveyance affecting buildings, uses, parcels, and tracts shall. subject said properties to the terms of said declaration. Boncosky Preliminar~lat • 5/1/97 - P&Z Meeting Page 3 of 3 Although this facility is, for the present, to consist of two buildings under single ownership, staffrecommends that the property be bound by covenants, prepared and filed in accordance with the provisions of the preceding paragraphs. Specific terms of the covenants should include the following: • Clear responsibility for maintenance of landscaping, screening, fencing and undeveloped portions of property. • Clear responsibility for maintenance of all stormwater drainage systems located on site including swales, channels and detention facilities. • Clear statement specifying and limiting the future use of undeveloped portions of the property. • The funding mechanism to be used to provide for maintenance items specified by covenants. • A clear statement specifying the parties responsible for administration and enforcement of convenants. These covenants should be submitted for City review and comment. They should not be released for recordation until such time as the City deems them to be satisfactory in terms of form and content. D. Realty Advisors, L.L.C. Requested For: 33.16 Acre Tract, being all of Outlots 34, 35, 46, 47, 54 and 55 and Part of Outlots 36, 45, 66 and 67, La Porte, Volume 59, Page 313, H.C.D.R, situated in the Richard Pearsall Survey, Abstract 625, Harris County, Texas Present Zoning: High Density Residential (R 3) and Low Density Residential (R-1) Requested Use: Residential Subdivision Background: The proposed Spencer Landing is a major subdivision that will be located on the north side of Spencer Highway in the 11,400-11,500 Block of Spencer Highway. (See Exhibit A) The General Plan for this subdivision was `approved by the Commission during their April 17, 1997 meeting. Analysis: ~ By approval of the Section I Final Plat, the $8,925.00 payment of money in lieu of parkland will need to be made. As noted in previous reports, this figure is calculated on a $175.00 per lot basis. The total for the entire subdivision is $24,500.00. This will leave a balance of $15,575.00 due upon development of Section II. A water and sewer extension, at the expense of the property owner to the west of the proposed subdivision, was required for the development of the church site. A pro-rata share of the extension cost will need to be paid to the City so reimbursement can be made to that property owner. Those specific amounts are addressed in subsequent paragraphs. By approval of the Section I Final Plat, the applicant will be responsible for paying sanitary sewer development costs. The applicant's maximum cost exposure will be $7,363.50. This is equal to 50% of the original $14,727.00 extension cost. By approval of the Section I Final Plat, the applicant will be responsible for paying water development costs. The applicant's maximum cost exposure will be $3,439.00. This figure represents the cost that would be involved in tying into the D Street water line in lieu of the existing water line located in the easement which adjoins the west side of the subdivision. Spencer Landing Subdiv. ~liminary Plat • 5/1/97 - P & Z Meeting Page 2 of 3 Upon submittal of the Section I Final Plat, the developer will be responsible for providing covenants or deed restrictions.. Specific terms of the covenants should include the following: • Clear responsibility for maintenance of landscaping, screening, fencing and undeveloped portions of property. • Clear responsibility for maintenance of all stormwater drainage systems located on site including swales, channels and detention facilities. • The funding mechanism to be used to provide for maintenance items specified by covenants. • A clear statement,s~ecifying the parties responsible for administration and enforcement of convenants. These covenants should be submitted for City review and comment. They should not be released for recordation until such time as the City deems them to be satisfactory in terms of form and content. No building permit for the project should be approved or released until the approved covenants have been filed for recordation with Harris County Deed Records.. Conclusion: Staff has reviewed the Spencer Landing, Section I Preliminary Plat and found it complies with many of the requirements of the Development Ordinance. A copy of the Section I Preliminary Plat Checklist follows this report. Some issues remain; therefore, staff recommends that the Preliminary Plat of Section I be "Conditionally Approved" at this time. Conditional Approval by the Commission requires submission of an amended Preliminary Plat and additional documentation as specified by the Commission. As part of the Conditional Approval, the Commission should require the developer's compliance with the list of items shown prior to the submission of an "Amended" Preliminary Plat. The following items should be addressed: 1) Amend the Preliminary Plat as per checklist. 2) Delete reference to proposed 8" sanitary sewer in the utility easement of Block 2.
