Preliminary Plat

Requested For: A 15.0780 Acre Tract of land being Outlots 702 and 703 to the W. B.
Lawrence Subdivision, Volume 83, Page 344, H.C.D.R. out of the William
M. Jones Survey, A-482, LaPorte, Harris County, Texas.
Present Zoning: Low Density Residential (R-1)
Requested Use: Residential Subdivision
Background: Summer Winds is a residential subdivision located off Underwood Road and
located between Spencer Highway and Fairmont Parkway. Section II
includes 4 blocks, 561ots and one restricted reserve.
Analysis: For general information purposes, staff has listed items below that need to be
addressed by the developer with the submittal of the final plat.
• A reference that the detention pond ownership and maintenance by the
Homeowner's Association shall be stated in writing on the final plat.
Language in the convenants and on the face of the plat shall
dedicate/transfer ownership of the detention reserve to the Homeowners
Association.
• A reference that the developer is responsible for construction and
installation of sidewalks within the subdivision should be stated in
writing on the front of the final plat. (If sidewalks are required by the
Planning &Zoning Commission)
• A HL&P street light layout plan and letter stating costs from HL&P is
provided for review by the City.
• Payment for street lighting cost should be made to the City.
• Approval from the franchise utilities regarding the size and location of
the proposed utility easements are provided for City review and
approval.

• Payment to the City for street sign installation costs ($280.89).
• On Section II, a payment of $9,800.00 is due the City in lieu of parkland
dedication. This figure is based on a $175.00 per dwelling unit basis.
The money will be placed in an escrow account and will only be used for
the acquisition or improvements of public park land or facilities located
in Park Zone 1, the zone in which Summer Winds is located.
• Subdivision covenantsldeed restrictions for Section II are provided to the
City for review and approval.
• Subdivision construction plans are provided for review and approval by
the City.
• Title Certificate is provided for review by the City.
Conclusion: Development Ordinance, Section 4.03.B requires that "following review
of the Preliminary Plat, the commission shall ... Take one of the following
actions."
1. Approve the Preliminary Plat as filed;
2. Conditionally Approve the Preliminary Plat as filed, provided, the
reasons are stated in writing and a copy of the statement is signed
by the Chairman of the Planning Commission.
Disapprove the Preliminary Plat as filed, provided, the reasons for
such disapproval are stated in writing and a copy of the statement
is signed by the Chairman of the Planning Commission.
Using Appendix D of Development Ordinance No. 1444, staff has reviewed
the preliminary plat and finds it complies with applicable ordinance
requirements. The completed checklist is attached and follows this report.
Staff therefore, recommends Approval of the Summer Winds, Section II
Preliminary Plat.
If the Planning and Zoning Commission approves the Preliminary Plat we
recommend the motion include the following:
• Confirmation by the Planning and Zoning Commission that sidewalks
are required in Summer Winds, Section II.
• The Planning and Zoning Commission requests that staff notify the
developer of the items referenced in this report that need to be addressed
prior to or with the submittal of the final plat.

Reauested For: Approximately 23.7 acres being all of Blocks 839, 859, 870, 869, 896, Parts
of Blocks 833, 860, 895, and Streets and Alleys enclosed therein, Town of
La Porte, J. Hunter Survey, A 35, La Porte, Harris County, Texas. This
property is also known as the 1900 Block of Avenue H at 16~' Street.
Present Zoning: Heavy Industrial (H.I.)
Requested Use: Development of a Pharmaceutical Unit (SIC #2834)
Background: PPG Industries, Inc. is planning an expansion (within their existing fenced
site) which would include a pharmaceutical unit. The structure needed to
house the required equipment would exceed the current maximum forty-five
feet building height for a H.I. Zone. A site exhibit follows this report.
The Commission, in their August 20, 1998 meeting, reviewed a proposed
zoning regulation change to allow buildings exceeding the maximum forty-
five feet height to be considered a "Conditional Use". The Commission's
favorable recommendation has been forwarded on to the La Porte City
Council for their consideration.
Analysis: Staff has confirmed that this development would not be in conflict with the
City's Airspace Plan. Also, the extra building needed to house the
manufacturing equipment is not unusual within plant facilities.
Conclusion: The Commission's recommendation on SCU #98-002 will be forwarded to
City Council for their review at the September 14, 1998 meeting.
