Also present were City Secretary Patrice Fogarty, Assistant City Manager Traci Leach; and Randy Strong, substitute attorney for Assistant City Attorney Clark Askins. 2. INVOCATION - The invocation was given by Dee Spears of Fairmont Park Church. 3. PLEDGE OF ALLEGIANCE - The pledge of allegiance was led by Councilmember Tommy Moser. 4. PRESENTATIONS, PROCLAMATIONS AND RECOGNITIONS (a) Sherry Lowe with the La Porte Civic Community Club presented the City of La Porte with an appreciation plaque for the Juneteenth festivities. Garza City Engineer Julian Garza discussed the Concrete Street Program in the City of La Porte. (c) Discussion or other action regarding adoption of a Water Service Line Protection program through Utility Service Partners, Inc. and the North Central Texas Council of Governments that would offer water and sanitary sewer service line repair coverage to homeowners within the City of La Porte — T. Leach/D. Mick Assistant City Manager Traci Leach and Public Works Director Dave Mick discussed adoption of a Water Service Line Protection program through Utility Service Partners, Inc. and the North Central Texas Council of Governments that would offer water and sanitary sewer service line repair coverage to homeowners within the City of La Porte. Councilmember Kaminski asked staff to verify with the City Attorney if Utility Service Partners, Inc. is allowed to use the City's logo on promotional materials. Councilmember Moser asked the time-frame as to when Utility Service Partners, Inc., would pay participating plumbers for their work. Staff will find out and report back to Council. Councilmember Zemanek commented it is not a good idea to have other companies use the City's logo. Dave Mick advised Council there will be answers regarding the logo and timeframe of paying plumbers at the July 25 Council Meeting. Council directed staff to bring this item back at the July 25 Council Meeting as a workshop and possible action item. (d) Discussion or other action regarding of the acceptance of property donation to the City of La Porte from the La Porte Main Street Association, for Lots 29 and 30, Block 39 on Main St. in La Porte — S. Osborne Page 2 of 5 July 11, 2011, City Council Meeting Minutes Economic Development Coordinator Stacey Osborne discussed acceptance of this property donation to the City of La Porte from the La Porte Main Street Association for Lots 29 and 30, Block 39 on Main St. in La Porte. Councilmember Leonard filed a conflict of affidavit with City Secretary Patrice Fogarty. Councilmember Moser asked to find out if there are taxes owed on the property and how much it would cost to build a parking lot on the property and the number of spaces a parking lot would provide. Councilmember Martin questioned if the property is accepted, would the City pay the delinquent taxes. Ms. Osborne answered, yes. Councilmember Moser moved to table the item until the next meeting. Councilmember Kaminski seconded. MOTION PASSED. PUBLIC HEARING AND ASSOCIATED ORDINANCE (a) Public Hearing to receive comments regarding revisions and amendments to the current La Porte Water Conservation and Drought Contingency Plan (this item was tabled at the meeting of City Council held on June 27, 2011) — D. Mick City Council opened the public hearing at 7:06 p.m. Public Works Director Dave Mick presented amendments to the current La Porte Water Conservation and Drought Contingency Plan. City Council was informed the volunteer reduction worked by lowering water usage. During a Stage 2 Water Condition, door hangers would be issued as a warning, the violation would be documented and then a surcharge would be implemented if violations continued. Mr. Mick also indicated another goal is to mitigate usage spikes. Councilmember Engelken suggested staff to do a better job advising and educating citizens by communicating using Reverse 9-1-1. Councilmember Mosteit also suggested Council avail itself of the provision in the Open Meetings Act regarding posting of an emergency meeting if needed to implement emergency plans. Dave Mick advised staff can make the current plan work. Phillip Hoot, 927 Seabreeze, addressed City Council and suggested citizens be requested to conserve water now if there are indications of imminent drought conditions. Chuck Rosa, 812 S. Virginia, addressed Council and suggested the City contact citizens and notify them the cost of water increases with usage during drought conditions. Ted Powell, 1700 Roscoe, addressed City Council and suggested using the court system to ensure compliance of water conservation. Page 3 of 5 July 11, 2011, City Council Meeting Minutes John Kling, 11025 Pinewood, addressed City Council stating he is not in favor of citizens being fined for non-compliance during drought conditions. John Nolley, 2819 E. Street, addressed City Council advising citizens be notified of drought conditions via Reverse 9-1-1 in addition to adding comments that water will be used during emergency situations such as a Fire. The Public Hearing closed at 7:57 p.m. There was no motion forthcoming on this item. Council moved to the next item. 9. REPORTS Receive report from the Drainage and Flooding Committee — Councilmember Mosteit Chairman Mosteit reported the Drainage and Flooding Committee met and discussed Proposals for Engineering Services for future drainage projects. The committee directed staff not to pursue Northwest Park Diversion Basin (Redirection of F101-06). The committee will meet prior to the first Council Meeting in August. The proposals for Engineering Services will be presented to complete City Council the first meeting in August. At this time, Mayor Rigby requested the ordinance caption be read on Consent Item 6B, as it was overlooked at the time of Council action on the Consent Agenda. COUNCIL COMMENTS - Matters appearing on agenda; recognition of community members, city employees, and upcoming events; inquiry of staff regarding specific factual information or existing policy — Councilmembers Moser, Kaminski, Zemanek, Leonard, Engelken, Mosteit, Clausen, Martin and Mayor Rigby. All councilmembers expressed thanks to the La Porte Community Civic Club for the Juneteenth Program, congratulated Nicole Wells and Randy Cernosek, remarked how nice the July 4 th Parade and fireworks were, and thanked Randy Strong for substituting as legal counsel. Additionally, sympathy was expressed to the Askins family on the loss of Knox Askins' brother. Councilmember Clausen congratulated Councilmember Kaminski on her election to office. In addition to comments expressed by other councilmembers, Mayor Rigby thanked Councilmember Leonard for his service as Mayor Pro-Tem, and thanked George Watkins for a job well done on the July 4 Parade. He also asked Parks and Recreation Director Stephen Barr to distribute the Harris County Transit Program pamphlets to senior citizens, and to please check on the palm trees along SH-225. There is an unused balance of $3,473.79 remaining in account number 003-9890-612-7120 (Wastewater Equipment Replacement) that is available for transfer into an account to be created for Lift Station 6. SUMMARY & RECOMMENDATION Reconstructing Lift Station #6, located at South 8 and West L Street, is a high priority capital improvement proj ect for the City of La Porte. On January 14, 2008, City Council authorized $60,000 for design. The design was completed in 2009. Appro�mately two-thirds of the e�sting lift station is located in the South 8 Street right-of-way and one-third is located on portions of two parcels that are owned by the Harris County Flood Control District (HCFCD). The lift station is proposed to be expanded further into the county-owned parcels. (Plan and aerial views are attached.) In 2009, Steve Gillett, then Public Works Director, approached HCFCD and asked that the county sell a 2,000-square feet (sf� easement to accommodate the expanded lift station. The county preferred to sell the entire parcel, which would also necessitate a full appraisal, etc. Public Works staff later suggested that the county consider trading the parcels needed for the City lift station for two equivalent-sized parcels that are held by the City as trustee and located near the Harris County parcels. The City does not yet have clear title to the property. Obtaining clear title involves paying off the back taxes and associated fees that total $1696.75. Of this amount, $358.59 comes back to the City of La Porte and $579.12 is paid to the La Porte ISD. (A cost summary is attached.) On the staff level, obtaining clear title is the last remaining county hurdle to navigate. Final approval though rests with the County Commission Court in addition to City Council. Staff is in the process of an in-house remodel of the recreation center at Brookglen Park. When the foundation work was done, the company installed new piers under the foundation, in the restrooms. As a result, the ceramic tile needs to be replaced in the restrooms, which was not anticipated as part of the remodel project. While staff is accomplishing that work, we would prefer to re-tile the entire building with ceramic tile as we did for Jennie Riley Center which would reduce maintenance and improve the building appearance. The low bid we received for the project, including some carpentry work and painting, is $12,000. In addition, the Lomax Arena Roof Repair project is complete; however, there are unused funds left in the account 015-9892-608-ll00 in the amount of $46,050. With the drought conditions in the area, we are having difficulty keeping the arena watered down to prevent dust and loose dirt on the floor. Staff has researched the situation and have found a solution that will allow for automatic watering, using a reel sprinkler system, that has proven effective in various other rodeo arenas in the area. The Rodeo Association is in support of this solution and will construct a small storage container in the north end of the Arena to store the equipment when it is not in use. There will be a need to extend a 2" waterline to the north end of the Arena to provide water to the reel system. The cost of the unit, storage, and utility extension, is expected to be approximately $10,000. Staff is requesting approval to use a portion of these surplus funds identified above, to complete this work. These additional funds will give us a much better finished product that will be easier to maintain and improve the looks of the building considerably, and provide better service to the riding community. Staff is requesting authorization to utilize a portion of the surplus funds in these two project accounts to accomplish the requested work, in the amount of $22,000 for these two needed projects for the City. The remaining surplus funds in these two accounts will drop to the bottom line and be used for future capital improvement projects. To the extent allowed by law CITY agrees to indemnify, and save and hold LA PORTE harmless, from any such claim for loss or damage by itself, or by any person, firm, corporation, or association, in connection with this agreement. IV. Either party to this agreement may cancel by giving one hundred twenty (120) days written notice to the other party. Such notice will be effective as of midnight of the sixtieth day following the day notice is received by CITY or LA PORTE. � CITY personnel shall abide by all LA PORTE rules, regulations, and policies, as they now exist, or may be amended hereafter, relating to the services rendered including the use of facilities made available to the CITY under the terms of this agreement. B. EMERGENCY 911 DISPATCH SERVICES I. LA PORTE agrees to receive telephone calls and to dispatch radio calls to CITY Law Enforcement, Fire and EMS units. II. LA PORTE further agrees that a dispatcher will be available at the LA PORTE Police Department to render this service twenty-four (24) hours a day for the duration of this agreement. III. CITY agrees to pay LA PORTE for 911 emergency dispatch services in the amount and manner hereinabove specified. C. JAIL I. LA PORTE agrees to allow CITY to temporarily confine persons arrested by CITY' S law enforcement officers in the LA PORTE City Jail until such time as they can be properly released or conveniently moved by the proper authorities to the Harris County Jail or other facility, as the case may be. II. CITY agrees to keep certifications current of all law enforcement officers, required by the Texas Commission on Law Enforcement standards and education or other appropriate regulatory authority having jurisdiction, and shall provide copies of same to LA PORTE, if so requested. III. CITY will be solely responsible for all medical care for, and all transportation of arrestees brought to and/or being taken from the LA PORTE jail. In addition, CITY shall be solely responsible for the security of the arrestee during said transportation. IV. LA PORTE may suspend service and may refuse to accept an arrestee from CITY, in its sole discretion. V. CITY agrees to pay LA PORTE for j ail services in the amount and manner hereinabove specified. D. FIRE PROTECTION I. LA PORTE agrees to provide fire protection for real and personal property situated within CITY, for the term of this agreement, upon the terms and conditions herein contained. II. Sole discretion will rest with the LA PORTE Fire Chief, or his duly authorized assistants, as to the fire fighters and equipment that will answer each fire alarm, provided that protection will be adequate (meaning reasonable protection, considering available fire fighters and equipment of LAPORTE' S Fire Department). However, in all cases the dispatch of fire fighters and equipment to protect property within CITY will be subordinate to requests for, and rendering of, fire protection within LA PORTE. III. CITY agrees to pay LA PORTE for fire protection services in the amount and manner hereinabove specified. E. EMERGENCY MEDICAL SERVICE I. As part of the consideration expressed herein, LA PORTE agrees to provide emergency medical services within CITY. LA PORTE shall transport patients to one of the nearest hospitals that provide emergency services as defined by the Transport Policy of the LA PORTE Emergency Medical Services, a copy of which is available at the LA PORTE EMS headquarters. LA PORTE shall be permitted to charge, directly to each patient or patient representative, the patient's insurance carrier, or other responsible party, its most current and customary Emergency Medical Service charges as adopted by City Council, and codified in the La Porte Code of Ordinances Chapter 30, Appendix A. II. Sole discretion will rest with the LA PORTE EMS Chief, or his duly authorized assistants, as to the personnel and equipment that will answer each emergency medical services request, provided, emergency medical services protection will be adequate (meaning reasonable protection, considering available personnel and equipment of LA PORTE's Emergency Medical Services). However, in all cases the dispatch of paramedics and equipment to provide emergency medical services within CITY will be subordinate to requests for, and rendering of, emergency medical services within LA PORTE. Some of the program highlights follow: • This would be an o tp ional program for residents (only). • The contract is between the property owner and the warranty company (USP). • Monthly fees $4.50 for water, $5.50 for sanitary sewer. The contract duration may be one year or month to month as desired by the homeowner. • No deductible. $4,000 cap per incident. No cap to the number of incidents or claims. • USP utilizes local, private contractors. • 24/7 service. • The agreement between the City and USP would allow USP to use the city logo with their introductory letters to the residents. Council directed staff to follow up with information regarding the use of the City logo by other entities and payment schedules for the plumbing contractors used by USP. The City Attorney will describe any legal considerations associated with the use of the city logo by a private entity at this meeting. Staff also contacted a couple of contractors who have done wark for the warranty company. The feedback from them was positive as was the feedback from the cities staff contacted. USP states that plumbing contractors are paid within 30 days. Should Council desire to move forward, staff has attached the agreement that did not include the City revenue component, which will result in a 12% decrease in premiums to the participating residents. Ms. Pulleine approached City Attorney Knox Askins and asked if the City would be interested in acquiring the property. The Tax suit is attached, showing a total of $1,112.68 owed in the suit for years 2006-2009 as of April 2011. This item was tabled at the meeting on July 11, 2011. Council requested a complete list of taxes owed on the property and an estimate of how much it would cost to pave those lots for parking on Main Street, and also an estimated number of parking spaces that could be accommodated.
