remaining in account number 003-9890-612-7120 (Wastewater Equipment Replacement) that is
available for transfer into an account to be created for Lift Station 6.
SUMMARY & RECOMMENDATION
Reconstructing Lift Station #6, located at South 8 and West L Street, is a high priority capital
improvement proj ect for the City of La Porte. On January 14, 2008, City Council authorized $60,000
for design. The design was completed in 2009.
Appromately two-thirds of the esting lift station is located in the South 8 Street right-of-way
and one-third is located on portions of two parcels that are owned by the Harris County Flood
Control District (HCFCD). The lift station is proposed to be expanded further into the county-owned
parcels. (Plan and aerial views are attached.)
In 2009, Steve Gillett, then Public Works Director, approached HCFCD and asked that the county
sell a 2,000-square feet (sf easement to accommodate the expanded lift station. The county
preferred to sell the entire parcel, which would also necessitate a full appraisal, etc. Public Works
staff later suggested that the county consider trading the parcels needed for the City lift station for
two equivalent-sized parcels that are held by the City as trustee and located near the Harris County
parcels. The City does not yet have clear title to the property.
Obtaining clear title involves paying off the back taxes and associated fees that total $1696.75. Of
this amount, $358.59 comes back to the City of La Porte and $579.12 is paid to the La Porte ISD. (A
cost summary is attached.)
On the staff level, obtaining clear title is the last remaining county hurdle to navigate. Final approval
though rests with the County Commission Court in addition to City Council.
Action Required bv Council:
Authorize the expenditure of appromately $1696.75 necessary to provide the City of La Porte clear
title to LOTS 12 AND 13, BLOCK 1129. Also to authorize the exchange of these LOTS 12 AND 13
for LOTS 15 AND 16, BLOCK 1130.

SUMMARY & RECOMIVNDATION
The Brookglen Sprayground project is complete; however, there are unused contingency funds left
in the account 015-9892-728-ll00 in the amount of $22,929.70. Staff is in the process of an in-house
remodel of the recreation center at Brookglen Park. When the foundation work was done, the company
installed new piers under the foundation, in the restrooms. As a result, the ceramic tile needs to be replaced
in the restrooms, which was not anticipated as part of the remodel project. While staff is accomplishing that
work, we would prefer to re-tile the entire building with ceramic tile as we did for Jennie Riley Center which
would reduce maintenance and improve the building appearance. The low bid we received for the project,
including some carpentry work and painting, is $12,000.
In addition, the Lomax Arena Roof Repair project is complete; however, there are unused funds left
in the account 015-9892-608-ll00 in the amount of $46,050. With the drought conditions in the area, we are
having difficulty keeping the arena watered down to prevent dust and loose dirt on the floor. Staff has
researched the situation and have found a solution that will allow for automatic watering, using a reel
sprinkler system, that has proven effective in various other rodeo arenas in the area. The Rodeo Association
is in support of this solution and will construct a small storage container in the north end of the Arena to
store the equipment when it is not in use. There will be a need to extend a 2" waterline to the north end of the
Arena to provide water to the reel system. The cost of the unit, storage, and utility extension, is expected to
be approximately $10,000.

SUMMARY & RECOMMENDATION
At the July 11, 2011 City Council meeting, United Services Partners, Inc. presented Council with the
details of a warranty program that is designed to insure residential property owners against the cost
of sewer and water service line repairs from the publicly-maintained portion of the line to the
residence.
Some of the program highlights follow:
• This would be an o tp ional program for residents (only).
• The contract is between the property owner and the warranty company (USP).
• Monthly fees $4.50 for water, $5.50 for sanitary sewer. The contract duration may be one
year or month to month as desired by the homeowner.
• No deductible. $4,000 cap per incident. No cap to the number of incidents or claims.
• USP utilizes local, private contractors.
• 24/7 service.
• The agreement between the City and USP would allow USP to use the city logo with their
introductory letters to the residents.
Council directed staff to follow up with information regarding the use of the City logo by other
entities and payment schedules for the plumbing contractors used by USP. The City Attorney will
describe any legal considerations associated with the use of the city logo by a private entity at this
meeting. Staff also contacted a couple of contractors who have done wark for the warranty
company. The feedback from them was positive as was the feedback from the cities staff contacted.
USP states that plumbing contractors are paid within 30 days.
Should Council desire to move forward, staff has attached the agreement that did not include the City
revenue component, which will result in a 12% decrease in premiums to the participating residents.
Action Required bv Council:
Moving forward would require a Council resolution providing the City Manager with the authority to
enter into an agreement with NCTCOG and a separate agreement with USP for the purpose of
allowing USP to utilize the City of La Porte logo in their campaign to promote a residential sewer
and water service line warranty program.

RE: Marketing Agreement with Utility Service Partners Private Label,
Inc. d/b/a Service Line Warranties of America ("SLWA")
We have discussed entering into a marketing agreement between the City of La
Porte, Texas (the "City" and SLWA.
SLWA provides affordable utility service line warranties to consumers. It is
SLWA's understanding that, in consideration of the License Fee (as defined below) to be
paid by SLWA to City, City has agreed to cooperate with SLWA in marketing SLWA's
services to City's residents and homeowners (the "Residents") as described below:
1. City hereby grants to SLWA a non-exclusive license to use City's name and logos
on letterhead and marketing materials to be sent to the Residents from time to time, and
to be used in advertising, all at SLWA's sole cost and expense and subject to City's prior
review and approval, which will not be unreasonably conditioned, delayed, or withheld.
2. As consideration for such license, SLWA will be liable to pay to City, within 30
days of the end of the final calendar quarter, 12% of the revenue from USP warranty
subscriptions collected from the Residents during such calendar year (the "License Fee"),
together with a statement certifying collections of such USP revenue, so long as this
marketing agreement remains in effect. City will have the right, at its expense, to
conduct an annual audit, upon reasonable notice and during normal business hours, of
SLWA's books and records pertaining to sales and rentals to the Residents while this
marketing agreement is in effect and for one year after any termination of this marketing
agreement.
3. The term of this marketing agreement will be for one year from the date of the
execution of the acknowledgement below and this agreement will then renew on an
annual basis unless one of the parties gives the other advance written notice of at least 90
days that it does not intend to renew this marketing agreement. City may terminate this
marketing agreement 30 days after giving notice to SLWA that SLWA is in material
breach of this agreement if such breach is not cured during such 30-day period. SLWA
will be permitted to complete any marketing initiative initiated or planned prior to the
effective date of any termination of this marketing agreement and shall pay the License
Fee to the City for the calendar year in which this marketing agreement is terminated
after which time, except for SLWA' S obligation to permit City to conduct an audit as
described above, neither party will have any further obligations to the other and the
license described in this letter will terminate.
4. SLWA shall indemnify, hold harmless, and defend City, its elected officials,
appointed officials, and employees from and against any loss, claim, liability, damage, or
expense that any of them may suffer, sustain or become subject to in connection with any
third party claim (each a"Claim") resulting from the negligence or willfulness of SLWA
in connection with, arising out of or by reason of this marketing agreement, provided that
the applicable indemnitee notifies SLWA of any such Claim within a time that does not
prejudice the ability of SLWA to defend against such Claim. Any indemnitee hereunder
may participate in its, his, or her own defense, but will be responsible for all costs
incurred, including reasonable attorneys' fees, in connection with such participation in
such defense.
If City agrees that the foregoing fully and accurately describes the agreement
between City and SLWA, please arrange to have a duly authorized representative of City
execute and date the acknowledgement below in each of the duplicate original versions of
this letter and return one to me in the enclosed self-addressed stamped envelope.
If you have any questions or wish to further discuss this marketing agreement, please do
not hesitate to contact Brian Davis via email at brian@bdaconsultinggroup.com or by

RE: Marketing Agreement with Utility Service Partners Private Label,
Inc. d/b/a Service Line Warranties of America ("SLWA")
We have discussed entering into a marketing agreement between the City of La
Porte, Texas (the "City") and SLWA.
SLWA provides affordable utility service line warranties to consumers. It is
SLWA's understanding that, in consideration of SLWA offering its external sewer and
water line warranties (the "Warranties") at a 12% discount from its standard rates to the
Residents (as defined below) the City has agreed to cooperate with SLWA in marketing
SLWA's services to City's residents and homeowners (the "Residents") as described
below:
2. As consideration for such license, SLWA shall offer the Warranties to the
Residents at a rate that is 12% less than its standard rate for Warranties offered
elsewhere.
SLWA
will be permitted to complete any marketing initiative initiated or planned prior to the
effective date of any termination of this marketing agreement, but otherwise neither party
will have any further obligations to the other and the license described in this letter will
terminate.
If City agrees that the foregoing fully and accurately describes the agreement

this letter and return one to USP in the enclosed self-addressed stamped envelope.

SUMMARY & RECOMMENDATION
Ms. Imogeine Pulleine of La Porte, who was formerly treasurer of the now defunct La Porte
Main Street Association, was served with process in a delinquent tax suit on May 10, 2011 for
the property owned by the Association on Lots 29 and 30, Block 39 on Main Street. Ms. Pulleine
approached City Attorney Knox Askins and asked if the City would be interested in acquiring
the property. The Tax suit is attached, showing a total of $1,112.68 owed in the suit for years
2006-2009 as of April 2011.
This item was tabled at the meeting on July 11, 2011. Council requested a complete list of taxes
owed on the property and an estimate of how much it would cost to pave those lots for parking
on Main Street, and also an estimated number of parking spaces that could be accommodated.
TAXES OWED
The complete list of taxes owed on the property is attached. In summary, the La Porte Main
Street Association owes a total of $1888.53, broken down as follows:
City of La Porte and LPISD $1,371.78
Harris County $516.75
OTHER ACQUISITION COSTS
Court Costs $639.00
Estimate of 2011 prorated taxes $156.88
PARKING
According to Reagan McPhail, those lots could conceivably accommodate up to 11 cars,
accessed from the alley and arranged as 90-degree parking spaces. An estimated cost for an
asphalt lot would be $25,000, while a concrete lot would cost approximately $35,000.
If Council wishes to acquire the properties, the City will need to pay all delinquent taxes on the
in order to have the delinquent tax suit dismissed. The City Attorney will send the deed from the
Main Street Association to the City of La Porte (which has been prepared) to be recorded and
render the property with HCAD as tax exempt.
Action Required bv Council:
Consider accepting property donation (Lots 29 and 30, Block 39, Town of La Porte) for resale or
public use.
