8.DISCUSSION OR OTHER ACTION

Discussion or other action regardingCity smoking regulations –D. Wilmore
Building Official Debbie Wilmore presented a summaryregarding City smoking regulations.
Mayor Rigby commented prior to presenting the proposed ordinance,it should have been
forwarded to the Fire Marshal’s Office for input since thatoffice wouldbe responsible for enforcing
suchanordinance.In addition, Mayor Rigby commented he read a bill has been filed during the
current legislative session that prohibits smoking in public places statewide;and if the bill
passes,it could preclude cities from enforcing such ordinances.Therefore,he would prefer to
wait and see the outcome of the legislators.
Councilmember Leonard commented he had received requestsfrom citizens and business
owners wishing for Council to move forward with an ordinances prohibiting smoking in public
places,and he would like to move forward.
Council directed staff to address any concerns of the Fire Marshal’s Office and incorporate that
input and bring the item back as a workshopitem and for action,if desired.

Public Works Director Dave Mick presented a summaryregarding aRight-of-Way Ordinance and
Utility Permit Process for the City of La Porte.
Councilmember Zemanek moved toapprove the Right-of-Way Ordinance and Utility Permit
Process for the City of La Porte, but then withdrew his motion due to questions from
Councilmember Moser.
Councilmember Moser questioned if certain projects would need to submit drawingsto Public
Works Director Dave Mick for approval. Mr. Mick responded the only time drawings or permits
would be requiredare when there are large projectsor large extensions, butnot for existing lines or
power drops.
Councilmember Mosteit commented the City should remind CenterPoint of critical needs during
major power outages and restoration projects.
Mayor Rigby questioned if the proposed ordinance was a new ordinance or a revision to an existing
ordinance. Public Works Director Dave Mick responded it is a newordinance.

Assistant City Attorney Clark Askins read the caption of AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF LA PORTE AMENDING CHAPTER 62, “STREETS, SIDEWALKS, AND OTHER
PUBLIC PLACES,” OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, BY ADOPTING
REGULATIONS FOR MANAGEMENT OF PUBLIC RIGHTS-OF-WAY IN THE CITY LIMITS; CONTAINING A
REPEALING CLAUSE; CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS
ORDINANCE SHALL BE FINED IN A SUM NOT TO EXCEED FIVE HUNDRED DOLLARS; PROVIDING

Plan of the City of La Porte.
Council directed City Manager Corby Alexander to move forward with the proposedFive-Year
Strategic Plan of the City of La Porte.
Mr. Alexander read the new mission statement for the City of La Porte.

Discussion or other action regarding new Animal Shelter –K. Adcox
Police Chief Ken Adcox andMartha Sengfrom Jackson & Ryan presented a summary regarding
the new Animal Shelter.
Council directed staff to move forward with what was presented.

Councilmember Engelken provided a report of the La Porte Development Corporation Boardin
addition to informing Council the La Porte Development Corporation Board agreed to fund up to
$570,000.00 for Lomax Park and Arena Improvements.

City Manager Corby Alexander provided Administrative Reportsand informed Council staff had
made contact with the ownerof Windsail Apartments and legal representative regarding the
complaints tenants of the apartment complex had made and an inspection of the complex had been
made. Mr. Alexander advised thatstaff would provide updatesof the complex as progress is
made.

Councilmember Martincommented he attended the La Porte Chamber of Commerce Banquet and
congratulated Ms. Jeannie Zemanek on her well deserved “Volunteer of the Year” awardandhis
son Jeffrey’sinstallationas Chairman of the La Porte Chamber of Commerce;and his wishes to
discuss street repairs to prioritize and seek additional funding for repairs; Councilmembers Moser,
Kaminski, Leonard and Mosteit congratulated and thanked all of the employees recognized during
the meeting. Mayor Rigby thanked Finance Director Michael Dolby and staff for the2012
Comprehensive Annual Finance Reportand encouraged all City employees to keep up the good
work.

WHEREASthe City Council of the City of La Porte, Texas,has on its
own motion determined to submit to the qualified voters for adoption
or rejection of certain proposed amendments to the existing Home Rule
Charter of the City of La Porte, Texas, pursuant to Section 9.004(a)
of the Texas Local Government Code; and
WHEREAS, the City Council of the City of La Porte, Texas,hereby calls
a special election toallow the voters to determine whether the
Charter should be amendedas hereinafterset out; and
WHEREAS, Section 9.004 of the Texas Local Government Code provides
that a charter amendment election shallbeheld not less than thirty
(30) days after the passage of theordinance calling forcharter
amendments; and
WHEREAS,Section 9.004 of the Texas Local Government Code provides
thatthecharter amendmentelection shall be held on the first
authorized uniform election date prescribed by the Texas Election
Codeor the earlier of the next general municipal election or the
next Presidential election; and
WHEREAS, the City of La Porte is holding a general municipal election
for election of City Council members on May 11, 2013, which is the
earliest available date to hold a special election for consideration
of proposed charter amendments.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE,TEXAS:
Section 1.
That the facts and recitations contained in the preamble
of this Ordinance are hereby found and declared to be true and correct
legislative findings and are adopted as part of this Ordinance for
all purposes.
Section 2.
That a special election is hereby ordered to be held
within the jurisdiction of theCity of La Porte, Texas, on the 11th
day of May, 2013, pursuant to the lawsof the State of Texas and the
Charter of the City of La Porte, Texas. Saidelection shall be held
for the purpose of amending the City of La Porte, TexasHome Rule
Charter.
Section 3.
That said special election shall be held in conjunction
with the regularly scheduled City Council election on said same date
for the purpose of submitting to the voters of the City of La Porte,
Texas the following propositions for amendments to the Charter of
the City of La Porte, Texas. Voting on the date of the election,
and early voting therefore, shall be by the use of a lawfully approved
voting system. The preparation of the voting equipment to be used
in connection with such voting system and the official ballots for
the election shall conform to the Texas Election Code, as amended,
so as to permit the electors of the City of La Porte to vote“Yes”
or “No” for the home rule charter ballot proposition. Said ballots
shall have printed therein such provisions, markings, and language
as may be required by law;and the propositionsshall be set forth
on said ballots in substantially the following form and language:

Section 5
.Voting at said election, including early voting, shall be
by the use of voting machines, and the ballots of said election shall
conform to the Texas Election Code, as amended.
Section 6
. An Early Voting Ballot Board is hereby created to process
Early Voting results for the election. Peggy Holland is appointed
Presiding Judge of the Early Voting Ballot Board. At least two (2)
other members of the Early Voting Ballot Board shall be appointed by
the Presiding Judge, in the same manner as the precinct election
clerks. Early Voting by personal appearance shall begin on the 12th
day and shall continue through the 4th day preceding the day of
election. Early Voting by mail shall begin on the 45th day preceding
the date of the election, or as soon thereafter as ballots are
available, and shall continue until seven o'clock (7:00) P.M. on
election day.Early Voting shall be conducted by a clerk for Early
Voting, namely, Patrice Fogarty, and the place at which the Early
Voting shall be conducted is designated as the La Porte City Hall, 604
West Fairmont Parkway, La Porte, Texas, to which address ballot
applications and ballots voted by mail may be mailed. Early voting
by personal appearance shall begin on Monday, April 29, 2013 and
continue through Tuesday, May 7,2013. Early voting by personal
appearance shall be conducted on the weekdays of the early voting
period, from 8:00 a.m. to 5:00 p.m., except for the third day and the
final day of the early voting period, from 7:00 a.m. to 7:00 p.m.; and
on the first Saturday of the early voting period, from 8:00 a.m. to
5:00 p.m.
Section 7.
The City Secretary's election office in the La Porte City
Hall is hereby designated as the Central Counting Station to receive
all ballots cast at said election, and Sharon Harris ishereby
appointed the Presiding Manager for said Central Counting Station, and
Yvonne Garrison is hereby appointed the Alternate Presiding Manager
for said Central Counting Station. Said Manager shall appoint any
clerks necessary to assist in receiving ballots and other records and
in performing the other duties of said Manager in this regard. Martha
Gillett is hereby appointed as the Presiding Judge of the Central
Counting Station and Sharon Harris is hereby appointed as Alternate
Presiding Judge for saidCentral Counting Station. The City Secretary
is hereby authorized and directed to obtain, or cause to be obtained,
the necessary electronic tabulating equipment, to arrange for the
testing thereof as provided by law and to employ a duly qualified
managerand a duly qualified tabulation supervisor to perform the
duties respectively imposed on them by law with respect to the
processing and tabulation of ballots at the Central Counting Station.

Shelly Simon is hereby appointed the assistant tabulation supervisor.
Section 8.
That all election materials including notice of the
election, ballots, instruction cards, affidavits and other forms which
voters may be required to sign and all early voting materials shall
be printed in both English and Spanish, or Spanish translations thereof
shall be made available in the circumstances permitted and in the
manner required by law.
Section 9.
Upon a candidate tendering his application on the form
prescribed, the City Secretary shall furnish to such candidate all
information relative to the qualifications for the office being
sought; the method of placing the candidate's name on the ballot; the
amount of the required filing fee; and any other pertinent information
concerning said election.
Section 10.
Said election shall be held in accordance with the
provisions of the City Charter of the City of La Porte, and the general
election laws of the State of Texas governing general and municipal
elections, so far as same may be applicable thereto.
Section11.
That the City Secretary is hereby ordered and directed
to give notice of the election by publication on the same day in each
of two successive weeks, with the first publication occurring before
the 14th day before the date of the election. The notice shall include
a substantial copy of the proposed amendments.
Section12.
As soon as practicable after the election and the
declaration by the Council that amendments have been approved, the
Mayor or City Manager shall certify to the Secretary of State an
authenticated copy of the amendments under the City’s seal showing
approval by the qualified voters of the municipality.
Section 13.
The City Council officially finds, determines, recites,
and declares that a sufficient written notice of the date, hour, place
and subject of this meeting of the City Council was posted at a place
convenient to the public at the City Hall of the City for the time
required by law preceding this meeting, as required by the Open
Meetings Law, Chapter 551, Texas Government Code; and that this meeting
has been open to the public as required by law at all times during which
this ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further
ratifies, approves and confirms such written notice and the contents
and posting thereof.
Section 14.
If any provision, section, subsection, sentence, clause,
or phrase of this ordinance, or the application of same to any person
or set of circumstances is for any reason held to be unconstitutional,
void or invalid, the validity of the remaining portions of this
ordinance or their application to other persons or sets of
circumstances shall not be affected thereby, it being the intent of
the City Council in adopting this ordinance that no portion hereof
or provision or regulation contained herein shall become inoperative
or fail by reason of any unconstitutionality, vividness or invalidity
of any other portion hereof, and all provisions of this ordinance
are declared to be severable for that purpose.
Section 15.
This Ordinance shall be effective upon its passage and
approval.

SUMMARY & RECOMMENDATION
InDecember 2012, the Fire Department received a new fire truck and on January 14, 2013 that
truck was officially placed into service. With the new truck in service, the current truck housed
at the Fire Training Facility will be rotated out of the City fleet.
For aspiring firefighters, San Jacinto College offers the Firefighter Training Academy, which has
been one of the best training programs in the Houston area and consistently has nearly 100
percent of the graduating students pass the Texas Commission onFire Protection written
certification exam. This program meets and exceeds all State requirements for paid/career
firefighters and provides additional fire-related education and certification opportunities as well
as courses in general education.The addition of a fire engine would greatly enhance the
programming and training offered through this program and the City would directly benefit, as
many of the graduates of this program stay in the area and become paid and volunteer
firefighters.
The City and San Jacinto College have maintained a dialogue about thepossibility to conveying
the retired truck to the College for use in the Firefighter Training Academy. The attached
agreement provides for the title transfer of the fire engine to the College for educational
purposes. The College commits to use the engine exclusively for educational/training purposes
for a period of 5 years and assumes all responsibility for the engine, including maintenance and
repair. After the 5 year period has been satisfied, the College may dispose of the truck as it sees
fit.
Action Required by Council:
Consider approval or other action authorizing the Mayor to execute an agreement between San
Jacinto College and the City of La Porte for the transfer of a fire engine.

SUMMARY & RECOMMENDATION
During the budget discussions for the 2012-13 FY, the La Porte Development Corporation Board
of Directors approved the expenditure of $25,000 for a retail study for the City of La Porte.
Working with the Purchasing Department, staff prepared a RFP for the study, which was
distributed in December 2012.
Proposals were received from 4 firms. An evaluation team comprised of La Porte Development
Corporation Board members and City staff interviewed all four firms and has recommended
Catalyst Commercial as the highest rated firm based on the team’s interviews andthe submitted
proposal.
At the January 21, 2013 EDC meeting, the Board approved the selection of Catalyst Commercial
and pursuant to EDC Bylaws, this item is being presented to Council for approval, as it is over
$15,000.

Over the past several years, the City has assisted the La Porte Chapter of Bay Area Habitat for Humanity
by donating taxforeclosure properties or other properties owned by the City, for the purpose of providing
familiesmeeting specific income requirements the opportunity to fulfill the dream of homeownership.
Home ownership is the single most effective way for many families to build personal wealth. The Habitat
for Humanity program utilizes sweat equity of the recipient families and volunteer labor in construction to
achieve affordability and long term success of the recipients.
The Bay Area Habitat for Humanity has requested the City provide twoadditionalbuilding sites to
facilitate construction of two more homes over the next program year in the north side of La Porte. The
subject properties backtaxes are being paid off in the amount of $25,207.82, per the budget amendment
approved at the January28, 2013,City Council meeting, clearing the way for conveyance.

SUMMARY & RECOMMENDATION
The Pecan Park Sports Complex has centrally located restroom facilities to service the 10 baseball fields located
at the park. This has created hardship for older visitors as well as very young participants who have a substantial
walk to get to the existing facilities.The City issued a design-build project quote to add an additional satellite
restroomfacilityon the north end of the park to accommodate those needs. Staff requested the use of $40,000 in
funding from leftover bond money from the original project, based on an estimate by an outside consultant.

Funding at the $40,000 level was approved in the FY2013 Budget Amendment presented at the January 28
Council meeting.

Three quotes were opened January 31for the design build project.The apparent low quote was received from
Aztec Remodeling and Landscaping
in the amount not to exceed $48,700.There is an unencumbered balance
of $28,000 remaining in Fund 48that could be appropriated to meet this $8,700 budget shortfall.Should
Council approve this additional funding, this change will be included in the next budget amendmentordinance in
April 2013.
Staff recommends appropriating an additional $8,700 to fund a design-build installation of a satellite restroom
facility for Pecan Park Sports Complex.

The attached report is provided in accordance with Article 2.132 (7) of the Texas Code of
Criminal Procedures. The Code requires that the police department annually report, to its
governing body, data collected on the race or ethnicity of individuals stopped for traffic
violations andsubsequently cited, searched and/or arrested.
The report indicatesthat the La Porte Police Department is fully in compliance with all relevant
Texas laws concerning racial profiling, including the existence of a formal policy prohibiting
racial profiling by its officers, officer training, and the collection of data in compliance with the
law. Additionally, a review of internal administrative records indicatedthat during 2012the
department received nocomplaintsthat could be categorized as involving some type of racial
profiling.As a result of this analysis,and the listed statistics,itbelieved that the officersof the
La Porte Police Department are operating appropriately and without bias relating to individual
violator race, ethnicity, or national origin.

AfterIke occurredin September 2008, staff initially identified sixty-two (62) blue tarp cases. Since that time,
numerous meetings with Council were held to discuss the City’s plans to address Ike related matters. At the last
meeting on 01/23/12, Council provided the following direction:
(1) continue to require permits for all Ike related work;
(2) continue to waive permit fees (repair and demo) for all Ike related permits;
(3) continue allowing blue tarps for residential properties (staff should not require blue tarps to be replaced
or removed);
(4) Continue to require non-residential properties to repair/replace the roofs.
In addition to the Council direction above, staff was asked to provide information about various assistance programs
available to affected residents. Staff visitedwith individualsaffected on several occasions. Assistance information
(i.e. Harris County Homeowner Disaster Recovery Program, Neighborhood Centers, St. John’s Episcopal Church,
Catholic Charities, Good Neighbor Next Door Home Repair Program, Harris Co.Housing Authority, Sheltering
Arms, Single Family Home Repair Program, Harris Co.Home Repair Programs, Rebuilding Together-Houston and
Harris Co.Community Services Development –Ike Recovery Funds) was provided via verbal and hand delivery.
TheJanuary 8, 2013report identifies eight (8) remaining roofs that havenot been repaired. Seven (7) of the eight

(8) structures have a blue tarp in poor condition.The structure at 426 S. 4Street no longer has a blue tarp attached;
however, the roof has not been repaired. The nailing strips remain in place and the structure is being considered for
demolition and subsequent replacement under the Harris County Ike funding.
At this time, staff is seeking direction on how staff should proceed regarding permit fees and blue tarps.
