Martin, Leonard, Kaminski and J. Martin. Also present were City Secretary Patrice Fogarty, City Manager Corby Alexander, and Assistant City Attorney Clark Askins. 2. INVOCATION The invocation was given by Joshua Ojeda, Fairmont Park Church. 3. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilmember Mike Clausen. 4. PRESENTATIONS, PROCLAMATIONS, and RECOGNITIONS (a) Proclamation Parks and Recreation Month Mayor Rigby Mayor Rigby presented a proclamation for Parks and Recreation Month to the City of La Porte Parks and Recreation Department. 5. PUBLIC COMMENTS (Limited to five minutes per person.) Margaret Anderson, 909 Garden Walk, presented a PowerPoint Presentation with pictures and partwork on the Main Street elevated water tank. Kathy Green, 10131 Quiet Hill Rd., addressed Council and informed of the tradition of the bulldog mascot and spoke in favor of the bulldog artwork on the Main Street elevated water tank. Deb Gallington, 222 S. Y Street, addressed Council in favor of the bulldog artwork on the Main Street elevated water tank. Phillip Hoot, 927 Seabreeze, addressed Council thanking them for the prayers and well wishes after his heart attack and EMS for transporting him. In addition, Mr. Hoot thanked Council for considering th to remove the City of La Porte truck route on W. Main Street from 16 Street to Underwood Rd and suggested to include removal to Hwy 146. PUBLIC HEARING AND ASSOCIATED ORDINANCES (a) Public hearing to receive comments regarding the La Porte Fire Control, Prevention and October 1, 2016, as approved by the Board of Directors of the District at its meeting held on June 23, 2016; consider approval of proposed budget of La Porte Fire Control, Prevention and Emergency Medical Services District D. Ladd The public hearing opened at 6:23 p.m. Assistant Fire Chief Donald Ladd presented a summary of the La Porte Fire Control, Prevention Councilmember J. Martin asked if there is an estimate for revenues. Finance Director Michael Dolby responded it is around $1 million. Mayor Rigby asked why the replacement ambulance is not coming out of the Motor Pool Replacement Fund. Mr. Ladd responded the ambulance will be funded by the Board. There being no public comments, the public hearing closed at 6:38 p.m. Councilmember Engelken moved to approve the proposed budget of La Porte Fire Control, Prevention and Emergency Medical Services District for the fiscal year which begins October 1, 2016. Councilmember Zemanek seconded. MOTION PASSED UNANIMOUSLY 9/0. The public hearing closed at 6:41 p.m. Councilmember Earp moved to amend Chapter Ordinances of the City of La Porte by adopting comprehensive guidelines, rules and regulation for subdivision and development of land in the City of La Porte. Councilmember K. Martin seconded. MOTION PASSED UNANIMOUSLY 9/0. Prior to council action, Assistant City Attorney Clark Askins read the caption of Ordinance 2016-3633 AN O ORDINANCES OF THE CITY OF LA PORTE, TEXAS BY ADOPTING COMPREHENSIVE GUIDELINES, RULES AND REGULATIONS FOR SUBDIVISION AND DEVELOPMENT OF LAND IN THE CITY OF LA PORTE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE FINED IN A SUM NOT TO EXCEED TWO THOUSAND DOLLARS; PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF; CONTAINING A REPEALING CLAUSE; CONTAINING A SEVERABILTY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE. 8. AUTHORIZATIONS (a) Consider approval or other action authorizing the City Manager to execute a contract with GreenPlay LLC., for Organizational Audit of the City of La Porte Parks and Recreation Department R. Epting Parks and Recreation Director Rosalyn Epting presented a summary. Mayor Rigby asked who on Staff reviewed the proposals. Ms. Epting responded Parks and Recreation Staff and Assistant City Manager Traci Leach. Councilmember Engelken asked Ms. Epting if she has evaluated the Parks and Recreation Department since her employment with the City; and if so, whether she has any recommendations. Ms. Epting responded yes. Councilmember Engelken asked what areas she sees changes for improvements. Ms. Epting responded Park Maintenance. Councilmember Engelken moved to authorize the City Manager to execute a contract with GreenPlay LLC., for Organizational Audit of the City of La Porte Parks and Recreation Department. DISCUSSION AND POSSIBLE ACTION (a) Discussion and possible action regarding artwork for the Main Street elevated water tank T. Leach City Manager Corby Alexander presented a summary. Councilmember Leonard moved to have the item come back with options for definitive artwork (to include bulldog artwork) for Council to vote on. Councilmember Zemanek seconded. Alexander Page 3 of 5 June 27, 2016, Council Meeting Minutes City Manager Corby Alexander presented a summary. President of La Porte Boys Baseball Association Heath Patterson spoke and updated Council on the current operations of the association and commented he does not think it is in the best interest for the City of La Porte to take over the La Porte Boys Baseball Association. Councilmember J. Martin asked if the association has an ongoing relationship with the City to effect changes to improve internal controls of financial management. Mr. Patterson advised, as the President of the Board, he has met with City Manager Corby Alexander and Staff and assured any and all information will be shared with the City. Councilmember Engelken commented he thinks a hybrid solution is the best approach: that the City do the finances and the La Porte Boys Baseball Association run the operation part. Councilmember Leonard asked if the La Porte Boys Baseball Association hosts outside league play. Mr. Patterson responded yes. Councilmember Earp commented he is also in favor of the City overseeing the finances of the La Porte Boys Baseball Association. Mr. Patterson advised after he became President of the La Porte Boys Baseball Association in August 2015, he requested a meeting with City Manager Corby Alexander and provided all information to the City and advised if the City had reasons to believe something is missing, he will ask the La Porte Police Department to investigate the matter. Councilmember Zemanek asked Mr. Patterson how soon will he be able to provide financial information for tournaments, Tuesday and Thursday League Play and League Play for the last calendar year to City Council. Mr. Patterson advised within a week. Councilmember Clausen asked how much does it cost to register an 8-9 year old for baseball. Mr. Patterson advised $205.00, which includes candy to sell. Coun over the financials or to assist with the financials. Mr. Alexander responded the discussion is intended for the City to be the financial agent for the La Porte Boys Baseball Association. Mayor Rigby asked City Manager Alexander if the City has ever requested information from the La Porte Boys Baseball Association and was not provided the information. Mr. Alexander responded yes. Mayor Rigby then commented he is in agreement with the City overseeing the finances and the La Porte Boys Association overseeing the baseball operations. Councilmember Engelken moved for City Staff to work out a hybrid solution with the La Porte Boys Baseball Association and come back to City Council with the details. Councilmember Leonard seconded. ADMINISTRATIVE REPORTS City Manager Corby Alexander commented staff will come back with a companion ordinance to remove the section of the roadway from the high frequency truck route corridor. 12. COUNCIL COMMENTS regarding matters appearing on the agenda; recognition of community members, city employees, and upcoming events; inquiry of staff regarding specific factual information. Councilmember Clausen commented the meeting was good tonight; Councilmember J. Martin commented Staff did an excellent job on the quarterly newsletter; thanked Heath Patterson for doing a great job presenting the item to City Council, and thanked Council for approving the Golf Course Concessionaire; Councilmember K. Martin congratulated Parks and Recreation Director th Rosalyn Epting for Parks and Recreation Month and wished everyone a safe and Happy 4 of July; Councilmember Kaminski congratulated Parks and Recreation Director Rosalyn Epting for Parks and Recreation Month; Councilmember Zemanek thanked Council for revisiting and taking action th on the truck route on Spencer Hwy. and wished everyone a safe and Happy 4 of July; Councilmember Leonard informed he just came back from Alaska and commented it is good to be back home in the heat. He also congratulated Parks and Recreation Director Rosalyn Epting for Parks and Recreation Month; and commented Spencer Hwy will be much safer for the students; Councilmember Engelken thanked Heath Patterson for coming and presenting the item with a lot of class and dignity and thanked La Porte Independent School District for their partnership with the bulldog emblem for the Main Street water tower; Councilmember Earp congratulated Parks and Recreation Director Rosalyn Epting and her Staff; thanked Council for their support on the truck th route change and wished everyone a safe and Happy 4 of July; and Mayor Rigby congratulated Parks and Recreation Director Rosalyn Epting for Parks and Recreation Month; commented the Sip and Stroll had plenty of vendors and attendees until the storm came through; wished everyone a thth Happy 4 of July; advised he will not be participating in the 4 of July Parade due to being asked to participate at an event at the Battleship of Texas. 13.
