The Texas Enterprise Zone Program is a program in which the State remits some of their portion of sales and use tax back to a business in exchange for capital investment and job creation. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, NOMINATING VALVOLINE LLC TO THE OFFICE OF THE GOVERNOR ECONOMIC HALF ENTERPRISE THE TEXAS ENTERPRISE ZONE ACT, CHAPTER 2303, TEXAS GOVERNMENT CODE th WHEREAS, on the 10 day of May, 2010, the City of La Porte, Texas (City) passed and approved Ordinance No. 2010-3248 electing to participate in the Texas Enterprise Zone Program, and the local incentives offered under this resolution are the same on this date as were outlined in Ordinance No. 2010-3248; and WHEREAS, the Office of the Governor Economic Development and Tourism (OOGEDT) through the Economic Development Bank (Bank) will consider Valvoline LLC as a half enterprise project pursuant to a nomination and an application made by the City; and WHEREAS, the City desires to pursue the creation of the proper economic and social environment in order to induce the investment of private resources in productive business enterprises located in the City and to provide employment to residents of enterprise zones and to other economically disadvantaged individuals and veterans; and WHEREAS, pursuant to Chapter 2303, Subchapter F of the Texas Enterprise Zone Act, Texas Government Code (the "Act"), Valvoline LLC has applied to the City for designation as a half enterprise project; and WHEREAS, the City finds that Valvoline LLC meets the criteria for designation as a half enterprise project under Chapter 2303, Subchapter F of the Act on the following grounds: 1. Valvoline LLC is a "qualified business" under Section 2303.402 of the Act since it will be engaged in the active conduct of a trade or business at a qualified business site inside an enterprise zone, and at least twenty- five percent (25.0%) of the business' new permanent jobs in the enterprise zone will be held by residents of any enterprise zone in this state, economically disadvantaged individuals, or veterans; and 2. There has been and will continue to be a high level of cooperation between public, private, and neighborhood entities within the area; and 3. The designation of Valvoline LLC as a half enterprise project will contribute significantly to the achievement of the plans of the City for development and revitalization of the area. WHEREAS, the City finds that Valvoline LLC meets the criteria for tax relief and shall pay sales tax when eligible and the City has adopted incentives Valvoline could be eligible for and nominates Valvoline LLC for half enterprise project status on the grounds that it will be located at a qualified business site inside an enterprise zone, will create a higher level of employment, economic activity and stability; and WHEREAS, the City finds that it is in the best interest of the City to nominate Valvoline LLC as a half enterprise project pursuant to the Act; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: That the findings of the City and its actions approving this resolution taken at the council meeting are hereby approved and adopted. The current scheme is that 2% of sales tax collections are retained by the State for administration of the State Comptroller of Public Accounts agency. The State Comptroller does a great job collecting and providing a wide variety of services, but the 2% across the great State of Texas amounts to nearly $188 million per year to the State, far in excess of the cost of providing those services. Local government finance and Microsoft Excel guru Lewis McLain has been highlighting the topic at https://citybaseblog.net/2018/09/30/a-huge-local-government-expense-not-being-disclosed/ This bill would reduce the fee the State Comptroller charges local governments for sales tax collection. The reduction of 1% would mean that well over $93 million more would go back to local governments, of which La Porte would receive over $121,000 annually in additional sales tax collections. In 2018, the State Comptroller had a budget of $356.7 million, which was used to perform a multitude of services by collecting fees from 425 types of revenue sources. The two largest revenue collections come from federal government payments and sales tax. Though there is no direct correlation with the $356.7 million collected and the work involved, it can be said that there is a general correlation. Why does an appraisal district offer to do your property tax billing as such a reasonable cost? Because they are sending out bills for the one or more portion of sales tax (6.25%), then how much additional work is there to collect the local governments portion (up to 2%)? As from local entities budget. This has caused local entities and legislators such as Representative Thompson to question just how much time and effort is really spent by the State Comptroller for collecting (including the field audits, etc.) sales tax in total? At least a reduction of 1% charge to local entities for collecting their sales tax is a reasonable request. Attached is a resolution supporting this legislation. If adopted, this resolution will be sent to all elected officials representing the City of La Porte. Action Required by Council: Consider approval or other action of Resolution 2019-01 supporting H. WHEREAS, the City of La Porte, Texas, is a home-rule city located in east Harris County; and, WHEREAS, the City of La Porte, Texas, has made significant commitments to improve infrastructure, to drive economic growth, and to enhance quality of life for our citizens; and, WHEREAS, within the City of La Porte, sales tax is collected from businesses for purchases and services rendered to customers in the amount eight and a quarter percent. WHEREAS, within the City of La Porte, the State of Texas receives six and a quarter percent of the total qualified sales; and, WHEREAS, within the City of La Porte, the City of La Porte receives one percent of the total qualified sales to be used for general fund purposes; and, WHEREAS, within the City of La Porte, the City of La Porte receives half percent of the total qualified sales to be used for Type B related to economic and infrastructure projects; and, WHEREAS, within the City of La Porte, the City of La Porte receives quarter percent of the total qualified sales to be used for street maintenance projects; and, WHERAS, within the City of La Porte, the City of La Porte receives a quarter percent of the total qualified sales to be used for emergency services district funding. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte, Texas, supports the creation, introduction and passage of legislation that will amend the Section 403.107 (c), Chapter 403 of Texas Government Code to reduce the percentage deducted by the State of Texas Comptroller of Public Accounts from two percent to one percent for charges by the state for its services under this section and deposit that amount into the state treasury to th operating fund. Section 2. The City Council of the City of La Porte, Texas, supports the creation, introduction and passage of legislation that will amend the Section 321.503, Chapter 321 of Texas Tax Code to reduce the percentage deducted by the State of Texas Comptroller of Public Accounts from two percent to one percent of the amount of the taxes collected within thereby deleting this subject to premiums paid under section 321.501 (c). Section 3. The City Council of the City of La Porte, Texas, supports the creation, introduction and passage of legislation that will amend the Section 323.503, Chapter 323 of Texas Tax Code to reduce the percentage deducted by the State of Texas Comptroller of Public Accounts from two percent to one percent of the amount of the taxes collected within and thereby deleting this subject to premiums paid under section 323.501 (c). There have been discussions amongst the Councilmembers in the past to change the voluntary contribution option designation from beautification and trail system projects to animal control services. Our utility billing contracted vendor, Dataprose has indicated to the City that there would be no charge to make this change on the utility bills. Action Required by Council: Discuss, consider, and possibly act to change the voluntary contribution option on the monthly utility bill to be used for animal control services instead of beautification and trail system projects. The Code requires that the police department annually report, to its governing body, data collected on the race or ethnicity of individuals stopped for traffic violations and subsequently cited, searched and/or arrested. The report indicates that the La Porte Police Department is fully in compliance with all relevant Texas laws concerning racial profiling, including the existence of a formal policy prohibiting racial profiling by its officers, officer training, and the collection of data in compliance with the law. As a result of this analysis, and the listed statistics, it is believed that the officers of the La Porte Police Department are operating appropriately and without bias relating to individual violator race, ethnicity, or national origin.
