Service Awards January 24, 2022
The three employees being recognized tonight have a
combined 55 years of service to the La Porte community.
Roy Linscomb, Street Maintenance Supervisor (10 years)
In January of 2012, Roy was hired as a Senior Equipment
Operator. He was promoted to the role of Street Maintenance
Supervisor in August of 2015, where he continues to serve
as possible, even when that means getting back on the heavy
equipment himself to get the work done.
Roy, thank you for all you do for La Porte.
Dora Leos, Records Specialist (20 years)
In 2002, Dora joined the City of La Porte team as a Secretary
in the Public Works department. She worked there for five
years before being selected as a Records Specialist in the
Police Department. Dora has been an outstanding employee
evidenced by an average annual performance rating of over
4.0 for the last 10 years. Her file contains several letters of
appreciation and recognition for her excellent customer
service.
Dora, thank you so much for your service to the La Porte
community.
Lee Stewart, Lieutenant Support Services (25 years)
Lt. Stewart began his career with La Porte on January 20, 1997.
Over the next 23 years, he served as a patrol officer, detective,
and Sergeant in the Patrol and Support Services divisions. In
March of 2020, he was promoted to the rank of Lieutenant
where he has continued working in the Support Services
division which includes Animal Services, Records, and a variety
of community engagement programs. Lee is certified as a
Master Peace Officer and has been nominated for recognition
as an Employee of the Quarter. Lee is known by many
employees across the city for his passion and expertise in
leading training sessions such as active shooter and workplace
safety and security.
The La Porte community is fortunate to have had Lt. Stewart
keeping us safer for the past 25 years and we look forward to
more years of his dedicated service. Thanks Lee for all you do.

Lindsey has been a valued member of the City of La Porte team since 2004 when
she was a student worker in the Summer Youth program. Since then, she has
provided outstanding service to her fellow employees and the La Porte
community in roles in Finance and HR. In her current role as the Senior HR
Generalist, Lindsey continues to deliver great work on her own while also
teaching two relatively new teammates who both nominated her for this
recognition. Here are some of their own words describing Lindsey and her work:

have. There have been multiple times she has stopped what she is doing to
help us out when needed.

The fourth quarter of each year is a busy time for HR, especially Lindsey. She takes
the lead on the annual Open Enrollment process, ensuring employees have all of
the information needed to make their elections. The start of the new budget year
in October means adjustments to pay rates for most employees, which Lindsey
revalmost 400 entries which
have to be done individually. This year also saw the return of the in person
Employee/Retiree Christmas party. With two members of the team who had not
been involved in this event before, Lindsey took the lead in planning, prepping,
decorating, etc. for this popular event. All of these accomplishments are in
and supporting employees.
Lindsey is a fantastic teammate, not just to the HR team but to all employees of
the City. Please join me in thanking Lindsey and congratulating her as the
employee of the fourth quarter for 2021.

g. Approve a reduction of $51,364.00 from amount previously awarded to Grapevine Dodge-
Chrysler-Jeep-Ram on October 11, 2021, and award a purchase of two Chevrolet Tahoe
Police Patrol Vehicles to Lake Country Chevrolet in the amount of $75,188.50, under

Mayor Rigby signed a conflict of interest affidavit for item 5c before the meeting and did not
participate in the consideration of or vote on the item. Item b was pulled by the City Manager.
Councilperson Bentley moved to adopt items a and d-g; the motion was seconded by
Councilperson Williams; the motion was adopted, 9-0.
Councilperson Bentley moved to Award Bid #22008 - Broadway Trail Lighting Project Phase II to
Genrg Electrical Solutions, LLC in the amount of $426,825.00 with a contingency amount of
$42,683.00, for a total authorization of $469,508.00; the motion was seconded by Councilperson
McCaulley; the motion was adopted, 8-0.
6. PUBLIC HEARINGS AND ASSOCIATED ORDINANCES
a. The City Council will hold a public hearing to receive comments regarding a
recommendation by the Planning and Zoning Commission to adopt Ordinance 2022-3860
Zone Change #21-92000004, a change from Main Street Overlay (MSO) District to Main Street
(MS) District for a 0.344-acre tract of land located at the 300 Block of East Main Street and
legally described as Lots 23-25 and E ½ of Lot 26, Block 196, Town of La Porte, Harris
County, Texas; followed by discussion and possible action to consider adopting Ordinance
2022-
by granting Zone Change #21-92000004, a change from Main Street Overlay (MSO) District
to Main Street (MS) District for a 0.344-acre tract of land located at the 300 Block of East
Main Street and legally described as Lots 23-25 and E ½ of Lot 26, Block 196, Town of La
Porte, Harris County, Texas. \[Teresa Evans, Director of Planning and Development\]
Mayor Rigby opened the public hearing at 6:33 p.m. There were no public comments. Mayor Rigby
closed the public hearing at 6:44 p.m.
Councilperson Garza moved to adopt Ordinance 2022-3860 amending the Code of Ordinances of
Zone Change #21-92000004, a change from
Main Street Overlay (MSO) District to Main Street (MS) District for a 0.344-acre tract of land located

7. STATUTORY AGENDA
a.Authorize the City Manager to execute an interlocal agreement with the Harris County Flood
Control District to receive funds for the Brookglen Subdivision Drainage Improvement

Lorenzo Wingate, Assistant Director of Public Works, informed the Council that the Drainage and
Flooding Committee, at their 5 p.m. meeting, had approved a recommendation to the Council to
enter into the interlocal agreement. Councilperson Engelken moved to execute an interlocal
agreement with the Harris County Flood Control District to receive funds for the Brookglen
Subdivision Drainage Improvement Project; the motion was seconded by Mayor Pro Tem Martin;
the motion was adopted, 9-0.
8. REPORTS
a. Receive report of the La Porte Draining and Flooding Committee meeting. \[Mayor Pro Tem

Mayor Pro Tem Martin said the Committee had discussed the status of the property at McCabe
Road, received an update on the detention pond interlocal agreement with the City of Pasadena,
approved a recommendation to the Council to approve an interlocal agreement with HCFCD for
the Brookglen Subdivision Drainage Improvement Project, and set the next meeting for February
14, 2022.

10. COUNCIL COMMENTS Hear announcements concerning matters appearing on the agenda;
items of community interest; and/or inquiries of staff regarding specific factual information or
existing policy from the Mayor, Councilpersons, and City staff, for which no formal action will
be discussed or taken.
Councilpersons wished all a happy new year; thanked the Council for approving the Brookglen HCFCD
interlocal agreement; expressed appreciation of pressure washing at Pecan Park; offered condolences
to the family of a retired EMS employee Randy Hanks who passed away recently, noting he would be
sorely missed; and announced that Mike Sullivan had again been elected to the HCAD Board as the
nominee.

SUMMARY& RECOMMENDATION
The previous contract for services with the Bay Area Houston Economic Partnership
(BAHEP) expired December 31, 2021.The new contract, which is identical to the
previous contract andis for a period of three years, beginning January 1, 2022and
ending December 31, 2024.The scope of services, highlighted by written updates,
trade show representation and site selector visits, are the same in the new contract as
what was in the previous agreement.The annual membership cost of $20,000 is an
approved expenditure in the La Porte DFY 2021Budget.
BAHEP has been a partner of the City of La Porte since 2012. The organization has
giventhe City of La Porte the following services and the scope of services Exhibit A,
outlined in the agreement.

AGREEMENT
as described in PROPOSAL (Exhibit A) TO THE CITY OF LA PORTE is made effective
as of the Effective Date (defined below) between the City of La Porte
Bay Area Houston Economic Partnership 501 (c)(6) not for
profit organization.
Contract Term:
This Agreement is effective on the Effective Date signed and remains in effect for three
(3) years thereafter, unless sooner terminated under this agreement.
Services:
Contractor agrees to provide the services described in Exhibit A.
Payment Term:
The City shall pay $20,000 per year, in semi-
economic development services rendered under this Agreement. Initial payment to
Contractor is due within thirty (30) days of the Effective Date.
Effective Date:
This Agreement shall be effective as of January 1, 2022.
Termination for Convenience by the City:
The City may terminate this Agreement at any time by giving thirty (30)
cumulative of all rights and remedies, which exist now or in the future.
On receiving the notice, Contractor shall, unless the notice directs otherwise, immediately
discontinue all services under this Agreement and cancel all existing orders and
subcontracts that are chargeable to this Agreement. As soon as practicable after receiving
the termination notice the City shall then honor payment terms for services rendered under
this agreement unless the fees exceed the allocated funds remaining under this Agreement.
TERMINATION OF THIS AGREEMENT AND RECEIPT OF PAYMENT FOR
CONSTITUTE A DEFAULT OR BREACH OF THIS AGREEMENT. CONTRACTOR
WAIVES ANY CLAIM (OTHER THAN ITS CLAIM FOR PAYMENT AS SPECIFIED

IN THIS SECTION), IT MAY HAVE NOW OR IN THE FUTURE FOR FINANCIAL
FOR CONVENIENCE.
Termination for Cause by Contractor:
Contractor may terminate its performance under this Agreement only if the City defaults
and fails to cure the default after receiving written notice of it. Default by the City occurs
if the City fails to perform one or more of its material duties under this Agreement. If a
default occurs and Contractor wishes to terminate the Agreement, then Contractor must
deliver a written notice to the city manager describing the default and the proposed
termination date. The date must be at least 30 days after the City Manager receives notice.
Contractor, at its sole option, may extend the proposed termination date to a later date. If
the City cures the default before the proposed termination date, then the proposed
termination is ineffective. If the City does not cure the default before the proposed
termination date, then Contractor may terminate its performance under this Agreement on
the termination date. To effect final termination, the contractor must notify the city
manager in writing.
Termination for Cause by City:
If Contractor defaults under this Agreement, the City Manager may either terminate this
Agreement or allow Contractor to cure the default as provided below.

To effect final termination, the city manager must notify Contractor in writing. After
receiving the notice, Contractor shall, unless the notice directs otherwise, immediately
discontinue all services under this Agreement, and promptly cancel all orders or
subcontracts chargeable to this Agreement.

Exhibit A
1. Bay Area Houston Economic Partnership will assist the City of La Porte to
work within the established framework as outlined in the City of La Porte
2030 Comprehensive Plan.
Provide the City of La Porte with direct access to Bay Area Houston
Econ
studies, forward planning and research.
Attract diversified industry that will contribute to the tax base as well
as provide jobs for a variety of diverse workers in the community
without conflicting with other land uses in La Porte, while
encouraging younger citizens to remain in the community.
Work to ensure that all existing and future commercial development is
attractive, highly utilized and without negative influence on adjacent
residential uses.
Facilitate meetings with county and state officials in order to develop a
positive working relationship; in regards to mutual goals for
development of lands and thoroughfares within the city limits.
Assist the City of La Porte to improve the community character of La
Porte to make it a more desirable place to live, work and visit.
2. Utilize 2030 Comprehensive Plan objectives to assist the City of La Porte
achieve economic development goals.
3. Include the City of La Porte in specific Bay Area Houston Economic
Partnership communications, as follows:
Inclusion of City La Porte material on the Bay Area Houston
Economic Partnership website.
Inclusion of the City of La Porte in Bay Area Houston Economic
Partnership printed materials and electronic newsletters.
Advise the City of La Porte in development of marketing materials
for the city website and for print and video distribution.
4. Include the Mayor, other elected officials, or City Staff in two site selector
visits per year.
5. Coordinate representation of the City of La Porte at two trade shows per
year, if held, with Bay Area Houston Economic Partnership staff working
with the city staff on the best methods to promote the City of
economic development objectives.
6. Include the City of La Porte in four business programs each year.
7. Continue to engage industry representatives from the industrial complex,
City of La Porte, and Bay Area Houston Economic Partnership to identify
constraints and barriers to economic vitality of the petrochemical industry
and determine appropriate resolutions.
8. Along with an annual written report documenting progress, Bay Area
Houston Economic Partnership representatives will meet every six (6)
months with the Mayor of the City of La Porte and/or his/her designated
representative(s).

SUMMARY& RECOMMENDATION
At the September 13, 2021, City Council meeting, Council established a committee to
review applications for neighborhoods looking to enhance or add fencing around their
respective neighborhoods. Staff has prepared applications and distributed those
applications to La Porte HOAs.Theapplications were also made available to civic
groups and members of the community. In all, threeapplications were submitted for
consideration.
On December 13, 2021, the La Porte Community Fencing Ad Hoc Committee met
and moved to recommend City Council to approve one application. The Bay Point
Townhomes application was recommend for funding, in an amount not to exceed
$25,000. The committee agreed they would come together on a later date to consider
possible changes to the policy to encourage more applications.
ACTION REQUIRED BY CITY COUNCIL
Consider and/or approve Community Fence Funding Award to Baypoint
Townhomes HOA in an amount not to exceed $25,000.00.

City of La Porte Community Fencing Policy & Procedures
Oversight:
City Council will establish a committee comprised of three (3) councilmembers who
shall consult with City staff (City Manager or designee, Public Works Director or
designee, and Parks and Recreation Director or designee).
Application Period:
The City of La Porte will open a period of 30-days to receive applications from the
community. Application period will occur October 1 and end on November 1 of each
year that funding is made available.
Community Fencing Projects:
The community fence project should benefit the entire neighborhood. Each project will
be evaluated by an oversight committee. Any funding awarded to the applicant for the
community fence project will be based on an evaluation point system, with greater
points being awarded for projects that demonstrate need and cost share capabilities.
The City has allocated limited funding for the community fence projects; therefore, those
applicants that demonstrate a greater need due conditions of their current fencing along
with cost sharing capabilities will receive higher favoritism. Additionally, applicants that
have failed to adequately maintain their community fencing will receive less points.
Applicant Responsibility:
Applicant shall provide City with initial scope and idea for community fence
project.
Applicants should be prepared to cost share in the community fence project.
Applicants will be required to receive three (3) quotes for the proposed work.
Applicants may apply for funding in subsequent years regardless of prior
applications. However, the applicant must be noted as adequately maintaining all
previous City funded fence projects.
Applicants should be prepared to assume on-going maintenance responsibilities
for the community fence improvements.
If the applicant is within a HOA or group, the applicant must provide proof of
signatory authority for the association or group. Typically, this is satisfied with a
copy of the articles of incorporation filed with the State for official HOAs.
Additionally, the City will need a letter from the HOA president confirming Board
approval of the application of the community fencing project.
If the applicant is not within a HOA or group, the applicant must provide written
documents from all the homeowners affected by the community fencing project
that they consent to the project and understand their respective responsibilities.
City Responsibilities:
The City will assist the applicants developing scope for projects.
City will prepare projects for presentation to the committee and City Council.
Projects may not proceed forward until a Memorandum of Agreement is
approved by the City Council and fully executed by both parties. Should the
applicant not be within a HOAor group association, the Memorandum of
Agreement will include all affected property owners of the community fence
project.
The City will reimburse applicant based on the award amount upon proof that all
bills related to the project have been paid.
Evaluation Point System:
Oversight committee will evaluate the applications based on the following
evaluation point system and provide results to be presented to the full City
Council for action.
Each project will be evaluated based on a 100 point scale.
Each project will be evaluated on the following criteria:
o Need Based (20 points max)
What is the current state of the community fencing?
Are there any safety concerns that would be addressed by the
project?
Other need based concerns as identified by the oversight
committee.
o Ability to Maintain the project (20 points max)
What are the available resources of the applicant?
If project is a replacement, has the current fencing been maintained
properly?
Does the applicant have an active board to manage ongoing
maintenance?
o Cost Share (25 points max)
What the financial commitment of the applicant?
Maximum points in this category to be granted to applicants
committing 50% or more.
o Cost Benefit Analysis (20 points max)
Total cost of the project divided by number of homes represented
by the applicant.
Committee will need to determine point allocation based comparing
applications.
o Prior Year Funding (10 points max)
Maximum points to be given to applicants that have not received an
award with last 5 years.
Suggestion: 2 point deduction for each prior year of funding.
o Other (5 points max)
This category will be awarded points based on factors not previous
identified but deemed important by the oversight committee.
Examples: fencing design, material to used, location in the
community, etc.
Application Process:
Determine Eligibility: Discuss the project plans with the City Manager, Assistant
City Manager or Public Works Director.
Complete the application and sign the agreement form. If the applicant is not a
homeowners association or group, then each of the property owners requesting
the community fence project would be required to sign the application.
A drawing (by an architect, design professional, or applicants) that adequately
depicts the scope of the work to be completed.

The bulk heading at Bay Forest Holes #11 and #15 isseriously deteriorating and will
installed, the proper bulkhead support systemwas not utilizedbecause the existing cart
path located along Hole #11 is located too close to the edge of the lake.
After much consideration, the best long term solution is to re-route 785 linear feet of cart
path to allow for proper installation of the bulkhead support system. The planned repair
will not only prevent future collapse of the wooden bulkhead but will also allow for much
needed repairs to this section of the cart path. This section along Hole #11 is a high
priority section on the repair/replacement list.
The amount being requested includes all of the work to accomplish both bulk head and
cart path repairs. Performing both as one project is the most efficient and safe way to
complete the work.

Repair was opened on December 14, 2021. The bid was advertised on November 18
th
and November 25in the Bay Area Observer, the City website and on Public Purchase.
A total of 29 contractors downloaded the bid documents and five (5) bids were received.
The low bid was submitted by Greenscapes 6, LLC in the amount of $149,705.00.
Greenscapes 6, LLC has worked with the City for the last six years on annual sidewalk
replacement projects with excellent results.
Staff recommends toaward Bid #22007 to Greenscapes 6, LLC in the amount of
$149,705.00 with a contingency amount of $15,000.00 for a total authorization of
$164,705.00.The total amount budgeted reflects funds from two separate CIP accounts,
with this project representing aportion of the planned improvements. Remaining funds in
the accounts will go towards additional car path repair/replacement and other planned
projects.

uses, the FLUP would need to beamended to allow for “Light Industrial” use.
Staff mailed nine (9) public notices to property owners located within 200 feet of the
subject property. Staff received one (1) returned comment sheet that was opposed to
the proposed zone changerequest.
The Planning and Zoning Commission, at their December 16, 2021, regular meeting,
voted 7-0 to recommend denial of the proposed Future Land Use Amendment.

multiple amendments since its adoption;
WHEREAS, pursuant to mandate of Chapter 106, "Zoning" of the Code of Ordinances of the
City of La Porte, the Planning and Zoning Commission of the City of La Porte has reviewed all
elements of the Comprehensive Plan, and as duly approved by the City Council of the City of
La Porte, to consider possible amendments thereto; and
WHEREAS, at the La Porte Planning and Zoning Commission meeting which occurred on
December 16, 2021, the La Porte Planning and Zoning Commission reviewed the Future Land
Use Map component of the Comprehensive Plan for the purpose of considering proposed
amendments thereto, to change the designation for that 6.264-acre tract of land located at 3337

the conclusion of such review the La Porte Planning and Zoning Commission voted to recommend

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA

Section 1. All of the facts recited in the preamble to this Ordinance are hereby found by the Council

Section 2. That an amendment to the Future Land Use Map component of the Comprehensive Plan
of the City of La Porte, Texas, which is incorporated to this ordinance by reference
herein and attached hereto as Exhibit A, be and is hereby authorized, approved, and
adopted by the City Council of the City of La Porte, Texas, after duly noticed public
hearing held at its January 24, 2022, meeting, pursuant to the recommendations of the
Planning and Zoning Commission of the City of La Porte, Texas.
Section 3. The City Secretary of the City of La Porte or her designated representative shall be
required to make this amendment to the Comprehensive Plan available to the public and
duly mark and note the updated reference on the Future Land Use Plan component of

Section 4. The City Council officially finds, determines, recites and declares that a sufficient written
notice of the date, hour, place and subject to this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the City for the time

change is now required in order to resume commercial operations on site.
The property owner has already begun commercial operations on site prior to approval
of any city issued permits. The owner has been cited by Code Enforcement for the
ongoing violations with a trial set for February 10, 2022.
Staff mailed nine(9) public notices to property owners located within 200 feet of the
subject property. Staff received one (1) returned comment sheet that was opposed to

The Planning & Zoning Commission held a public hearing on this item at their
December 16, 2021 regular meeting.The Commission voted on a motion to

WHEREAS, the City is authorized by Chapter 211 of the Texas Local Government Code to
promulgate rules and regulations governing regulation of land use, structures, businesses, and
related activities, and that such rules and regulations as adopted by the City promote the safe,
orderly, and healthful development of the City; and
WHEREAS, on December 16, 2021, the La Porte Planning and Zoning Commission conducted

WHEREAS, on December 16, 2021, after considering the public testimony received at such
hearing, if any, the Planning and Zoning Commission recommended that the request to rezone
a 6.264-acre tract of land located at 3337 Canada Rd. and legally described as Tracts 692 &
693, La Porte Outlots, Harris County, Texas, from General Commercial (GC) to Medium
Density Residential (R-2) be denied; and
WHEREAS, on January 24, 2022, the City Council of the City of La Porte conducted a public
hearing regarding a request to rezone a 6.264-acre tract of land located at 3337 Canada Rd.
and legally described as Tracts 692 & 693, La Porte Outlots, Harris County, Texas, as from
Medium Density Residential (R-2) to Planned Unit Development (PUD); and
WHEREAS, each and every applicable requirement set forth in Chapter 211, Subchapter A,
Texas Local Government Code and the Code of Ordinance of the City of La Porte, Texas,
concerning public notices, hearings and other procedural matters have been fully met; and
WHEREAS, the City Council desires that the request to rezone a 6.264-acre tract of land
located at 3337 Canada Rd. and legally described as Tracts 692 & 693, La Porte Outlots, Harris
County, Texas, from Medium Density Residential (R-2) to Planned Unit Development (PUD)
be approved;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
LA PORTE, TEXAS:
Section 1. All of the facts recited in the preamble to this Ordinance are hereby found by the City
Council to be true and correct and are incorporated herein by this reference.
Section 2. changing the
zoning classification of the following described property, to wit: a 6.264-acre tract of
land located at 3337 Canada Rd. and legally described as Tracts 692 & 693, La Porte
Outlots, Harris County, Texas, from Medium Density Residential (R-2) to Planned Unit
Development (PUD).
Section 3. All ordinances or parts of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided, however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter covered by this ordinance.
Section 4. Should any section or part of this ordinance be held unconstitutional, illegal, or invalid,
or the application to any person or circumstance for any reasons thereof ineffective or
inapplicable, such unconstitutionality, illegality, invalidity, or ineffectiveness of such
section or part shall in no way affect, impair or invalidate the remaining portions
thereof; but as to such remaining portion or portions, the same shall be and remain in
full force and effect and to this end the provisions of this ordinance are declared to be
severable.
Section 5. The City Council officially finds, determines, recites and declares that a sufficient
written notice of the date, hour, place and subject of this meeting of the City Council
is posted at a place convenient to the public at the City Hall of the city for the time
required by law preceding this meeting, as required by Chapter 551, TX
and that this meeting has been open to the public as required by law at all times during
which this ordinance and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves and confirms such
written notice and the contents and posting thereof.
Section 6. The City Council of the City of La Porte hereby finds that public notice was properly

Section 7. It is directed that the Official Zoning Map of the City of La Porte, Texas be changed
to reflect the zoning classification established by this ordinance

SUMMARY&RECOMMENDATION
Paul Pitman, applicant andowner,requestsapproval of Special Conditional Use Permit
(SCUP) 21-91000009, to allow for Light Industrial (LI) uses in the Planned Unit
Development (PUD) zoning district, on a 6.264-acre tract of land located at 3337
Canada Rd.,andlegallydescribed as Tract 692 & 693, La Porte Outlots, Harris County,
Texas.
The applicant is in the process of requesting a zone change for the property to Planned
Unit Development (PUD). The site is currently zoned Medium Density Residential (R-
2) andwas originally developed in 1984, prior to annexation into the city limits. The site
currently houses a 63,000 square foot warehouse along with paved loading and parking
areas.
Theapplicant initially submitted a zoning permit applicationfor a general warehousing
use that requires adjacency to the high frequency truckroute. Thisapplication was
denied becausethe site does not meet this requirement.Mr. Pittman has subsequently
proposed touse the facilityfor hispackagingand cratingbusiness, whichdoes not
require adjacency to the high frequency truck route.
The current R-2 zoning district does not permit any commercial or industrial uses.

change to PUD along with an approved commercial SCUP is now required in order to
resume commercial operations on site.
As part of the SCUP approval process, staff and thePlanning and Zoning Commission
haverecommended twelve (12) conditions of approvalintended to limit negative
impacts to adjoining properties.The recommended conditions are as follow:
1. A site development plan shall be submitted in accordance with applicable
requirements of the City of La Porte’s Development Ordinance and shall
comply with all provisions of Chapter 106, “Zoning” of the City’s Code of
Ordinances and all other department reviews and applicable laws and
ordinances of the City of La Porte and the State of Texas.
2. The underlying zoning is Light Industrial (LI). All LI zoning and development
requirements will need to be met, in addition to any conditions listed below.
3. All uses permitted in the LI zoning district as shown in the Land Use table of
Chapter 106, shall be permitted on site.
4. Perimeter fencing must be constructed and maintained along all portions of
the property.
5. Perimeter fencing must be 8’ tall and 100% opaque. Vinyl slating in
conjunction with a chain-link fence is permitted.
6. Onsite lighting must be hooded to limit light pollution on adjacent properties.
7. Any operations involving trucks (eighteen wheelers) are limited to the hours
of 7:00 AM – 7:00 PM.
8. No modular or temporary structures, including shipping containers, may be
utilized on site at any time for any purpose. Shipping containers on chassis
and defined as in-transit shall be permitted.
9. No Shipping containers are permitted to be stored outside unless affixed to
a chassis.
10. All onsite areas utilized for storage, parking, or driving must be paved with
either concrete or asphalt.
11. Hazardous materials which may or may not require a placard may not be
stored on site for any length of time. This prohibition includes hazardous
materials stored in the building or on trucks and shipments of hazardous
materials that are defined as in-transit by the Department of Transportation
(DOT).
12. Any proposed modifications to this Special Conditional Use Permit will require
an amendment to this SCUP in accordance with Chapter 106, “Zoning” of the
City’s Code of Ordinances.

SUMMARY& RECOMMENDATION
The Texas May 2022 uniform election date falls on May 7, 2022. As provided for by law
and in the City Charter, the City will hold a general election for aCouncilperson At-
Large Position A, a Councilperson-District 4,and a Councilperson-District 5.
At itsDecember 13, 2021, meeting, the City Council considered potential impact to La
Porte voters of the election for two state constitutional amendments to also be held on
to move forward with contracting with Harris County for the election. In accordance with
relevant state statutes, the Council will soon review a joint election agreement and

runoff, if needed. Friday, February 18, 2022, is the deadline to order a general election
or a special order on a measure for the May 7, 2022, uniform election date. Per Section
3.007 of the Texas Election Code, failure to order a general election does not affect the
validity of the election, however, proper and timely ordering is highly recommended and

ORDERING A REGULAR MUNICIPAL ELECTION TO BE HELD ON THE 7DAY OF
MAY 2022; DESIGNATING THE PLACES AND MANNER OF HOLDING THE
ELECTION; PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE;
PROVIDING A SAVINGS CLAUSE; PROVIDING AN OPEN MEETINGS CLAUSE; AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, The Texas State Legislature has called for two state constitutional ballot amendment
measures to be placed on the ballot for a statewide election on the May 2022 uniform election date;
and
WHEREAS, The City of La Porte will hold a regular municipal election for the election of City
Council member positions designated as Councilperson At-Large Position A, Councilperson-District
4, and Councilperson-District 5, on the May 7, 2022, uniform election date; and
WHEREAS, The City Council finds that it is in the public interest to enter into a joint election
agreement and election services contract with Harris County in order to provide the most efficient and
convenient voting opportunities for both the City and State elections, with voting available in all
Harris County polling locations and the potential for extended hours for early voting;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA
PORTE, TEXAS, THAT:
SECTION 1. The regular municipal election of the City of La Porte, Texas, for election of members
of the City Council as prescribed by Section 2.03 of the City Charter, shall be held between seven
th
o'clock (7:00) a.m. and seven o'clock (7:00) p.m. on the 7 day of May 2022, in the city, for the
purpose of electing Councilperson At-Large Position A, a Councilperson-District 4, and a
Councilperson-District 5. A runoff election will be held, if necessary, between seven o'clock (7:00)
a.m. and seven o'clock (7:00) p.m. on Saturday, June 18, 2022, as established with Harris County and
in accordance with the Texas Election Code, all such arrangements for which are authorized by the
adoption of this ordinance and the executed joint election agreement and election services contract
with Harris County.
SECTION 2. The City is hereby divided into six (6) election precincts, corresponding to the
boundaries of the six City Council single-member districts. The boundaries of such districts are as
established, defined, and outlined in Ordinance 2011-3384. The polling places for these election
precincts shall be as designated by Harris County.
SECTION 3. This election shall be held in accordance with, and shall be governed by, the election
laws of the State of Texas. The City Council has determined, pursuant to Chapter 271 of the Texas
Election Code, that the City is authorized to enter into a Joint Election Agreement with Harris County
and other participating political subdivisions for this election. The City Secretary and Mayor are
hereby authorized to perform all duties and take all actions as required by any election services
contract(s) and/or joint election agreement(s) that may be authorized by the City Council.
SECTION 4. Any eligible and qualified person may have his or her name placed upon the official
ballot as an independent candidate by submitting an application, which, in accordance with Texas
Election Code Section 141.031, must be in writing and be signed and sworn to by the candidate and
indicate that the candidate swears to the application. Such application for the general election may be
filed with the City Secretary beginning on January 19, 2022, and must be filed not later than 5:00 p.m.
on February 18, 2022. Candidate filings will be accepted in the office of the City Secretary, 604 West
Fairmont Parkway, La Porte, Texas, 77571, from 8 a.m.-5 p.m. Monday through Friday.
SECTION 5. The positions of Councilperson At-Large Position A, a Councilperson-District 4, and
a Councilperson-District 5 shall each be elected and installed with the candidate that receives a
majority of all the votes cast for the office for which he or she is a candidate and shall hold office for
a period of three (3) years.
SECTION 6. Each candidate for the office of Councilperson At-Large Position A must be a
resident of the City for twelve (12) months immediately preceding election day. Each candidate for
the office of Councilperson-District 4 and Councilperson-District 5 must be a resident of the City for
twelve (12) months immediately preceding election day and must also be a resident of the district for
which he or she files for twelve (12) months immediately preceding election day, in accordance with
Section 2.02(a) of the City Charter.
SECTION 7. Harris County shall appoint the Early Voting Clerk and Deputy Early Voting Clerk
for early voting in person and voting by mail, and shall designate the Main Early Voting Location for
early voting for the election. Applications for ballot by mail (ABBM) shall be mailed, faxed, emailed,
or delivered by common or contract carrier to:

who shall, upon approval of the application, provide balloting materials to the voter in accordance
with the Texas Election Code.
The deadline to hand-deliver an application for a ballot by mail (ABBM) is Friday, April 22, 2022.
The last day for the early voting clerk to receive applications for a ballot to be voted by mail via
mail (regardless of postmarked date), fax, common or contract carrier, or email, is Tuesday, April
26, 2022, in accordance with Election Code Sec. 84.007(c). If a voter submits an application for
ballot by mail via fax or email, the Early Voting Clerk must receive an original or a copy with a
wet signature via mail within four (4) business days of the submission of the fax or email, in
accordance with Election Code Sec. 84.007(b-1).
The places at which Early Voting by personal appearance shall be conducted shall be designated by
Harris County. During the lawful early voting period, the Early Voting Clerk shall keep such locations
for early voting open for early voting as required by the Texas Election Code, at a minimum.
SECTION 8. Voting at said election, including early voting, shall be by the use of voting machines;
and the ballots of said election shall conform to the Texas Election Code, as amended. Harris County,
via the joint election agreement/election services contract with the City of La Porte, shall obtain, or
cause to be obtained, the necessary electronic tabulating equipment, to arrange for the testing thereof
as provided by law and to employ a duly qualified manager and a duly qualified tabulation supervisor
to perform the duties respectively imposed on them by law with respect to the processing and
tabulation of ballots at the Central Counting Station.
SECTION 9. The City Secretary of the City of La Porte shall issue notice of said election to be
published one time in the Bay Area Observer, which is hereby found and declared to be a newspaper
of general circulation in said City, not less than ten (10) days nor more than thirty (30) days prior to
the date of the said election; in addition, notice of said election shall be posted on the bulletin board

in City Hall not later than the twenty-first (21) day before election day and remain posted thorough
election day.
SECTION 10. The Mayor and/or the City Secretary of the City of La Porte are hereby authorized to
execute and/or issue, for and on behalf of the City, such orders, documents, and forms as may, from
time to time, be promulgated by the Secretary of State of the State of Texas in conjunction with the
election herein ordained.
SECTION 11. Each and every provision, paragraph, sentence and clause of this ordinance has been
separately considered and passed by the City Council of the City of La Porte, Texas, and each said
provision would have been separately passed without any other provision; and if any provision hereof
shall be ineffective, invalid or unconstitutional, for any cause, it shall not impair or affect the
remaining portion, or any part thereof, but the valid portion shall be in force just as if it had been
passed alone.
SECTION 12. The City Council officially finds, determines, recites, and declares that a sufficient
written notice of the date, hour, place, and subject of this meeting of the City Council was posted at a
place convenient to the public at the City Hall of the City for the time required by law preceding this
meeting, as required by Texas open meetings law, Chapter 551, Texas Government Code; and that
this meeting has been open to the public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and formally acted upon. The City
Council further ratifies, approves and confirms such written notice and the contents and posting
thereof.
SECTION 13. This ordinance shall be in effect immediately upon its passage and approval.
