Open Public Hearing to receive citizen input on Special Conditional Use Permit Request #11- 91000003, for a 47.709 acre tract of land situated in the Johnson Hunter Survey, Abstract No. 35, Harris County, Texas, containing all of Outlots 10 and 11, and Blocks 373, 374, and 376 all of Blocks 377, 378, 379, and 380 in the subdivision of Outlot 9 of the Nebraska Syndicate Tract. La Porte Real Property, LLC., seeks this request for proposed development of chassis/container yard at the Landfill Site #3 located at 901 North Broadway. Chairman Hal Lawler opened the public hearing at 6:03pm. A. Staff Presentation Masood Malik, City Planner, gave staff's report on a request by La Porte Real Property, LLC, for a special conditional use permit to develop a chassis/container yard at 901 North Broadway. Thirteen public hearing notices were mailed to property owners within 200' of the subject property. No responses were received. B. Proponents The applicant, Brian Bommer, informed the Commission of a one million dollar bond in place with Harris County. C. Opponents Phillip Hoot, 925 Seabreeze, was concerned with stacking containers four high at this location. D. Proponents Rebuttal There were none. 4. Close Public Hearing. Consider recommendation to City Council regarding Special Conditional Use Permit Request #11-91000003. Motion by Danny Earp to approve Special Conditional Use Permit #11-91000003 with changes. Danny Earp withdrew his motion. After lengthy discussion regarding stacking containers two high rather than four high, David Janda asked for a preliminary vote, to put on record, his opposition to amend Item # 4 of Special Conditional Use Permit #11-91000003, from four containers high to two containers high. Motion by David Janda to deny the stacking of shipping containers as stated in item #4, from four containers to allow stacking of two shipping containers high. City Attorney Clark Askins suggested that the motion be in the affirmative. David Janda changed the motion to approve the stacking of shipping containers as stated in item #4, from four containers to allow stacking of two shipping containers high. Second by Danny Earp. Abstain: None Motion by Danny Earp to approve Special Conditional Use Permit #11-91000003 with the following conditions: 1. This SCUP outlines in general terms the proposed Planned Unit Development. The developer recognizes and understands that any future construction or development anticipated by this SCUP and the approved plan shall require further submittal and approval of plats, site plans, construction drawings etc. 2. Plan submittals shall be in accordance with this SCUP, ordinances and policies of the City of La Porte and specifically Section 106-216 & 217 of the Zoning Ordinance. 3. Proposed construction shall be in accordance with the TCEQ authorization for re -grading and paving activities and not for construction of any enclosed structure or underground utilities. 4. Stacking of shipping containers shall be permitted up to two (2) containers high. 5. Storm water drainage will require on -site detention to mitigate any adverse impact associated with this development. North 8th Street will be graded from discharge point to move the flow to the north into F101 Channel. 6. A statement from the owner/developer specifying clear responsibility for maintenance of detention system shall be noted on the site plan. 7. The owner or developer shall develop a planting plan that includes Benthamii Eucalyptus trees and creates a continuous visual screen. Trees shall be planted along North 8th Street and 400 feet along J & H Streets from an intersection with North 8th Street. Landscaping along North Broadway is also required in accordance with the City ordinance. 8. Provide an irrigation system to ensure that all landscaping and screening is properly maintained by the owner/developer. 9. An application of geo-tech surfacing shall be applicable per manufacturer's specification. Owner/developer shall provide proof to the City for on -site applications. 10. Provide the City a letter stating responsibility for the maintenance of the Landfill Site. 11. The owner/developer must secure a maintenance bond according to the City's Ordinances, seek an approved alternate showing evidence of bonding insurance, or participate in a "reserve fund mechanism" that establishes an account for the sole purpose of maintenance of the Landfill Site for the lifetime of the project. 12. Owner/developer shall submit an annual report to the City describing maintenance activity of landscaping/screening and surfacing occurring through annual period. 13. This permit does not become valid until a Development Site Plan is submitted to the City; reviewed and approved in accordance with the requirements of the Development Ordinance and this Special Conditional Use Permit. Open Workshop to discuss the following: a. Yard Parking Masood Malik, City Planner, gave staff's report. The Commission discussed the parking of boats and RV's in the front and side yards of residential areas. After discussing the current ordinance provisions, the Commission concurred that no changes to the ordinance are necessary at this time. b. Truck Routes Masood Malik, City Planner, gave staff's report. With recent developments in the La Porte area, particularly business/industrial parks, e.g. Port Crossing, Underwood Business Park, and influence of the Bayport Expansion and possible Cruise Terminal, trucking activities are projected to increase. A list of recently designated truck routes follows: 1. Export Drive — from South 16th Street to State Highway 146 2. South 16th Street — from south of Export Drive to Wharton Weems Blvd. and McCabe Road connecting with State Highway 146. 3. North Broadway — from north of Barbour's Cut Blvd. to North `L' Street. 4. North `L' Street — from west of North Broadway to North 8th Street. 5. North 8th Street — from North `L' Street to North `J' Street connecting with State Highway 146. 6. North 8th Street - from Barbour's Cut Boulevard to North `H' Street with future extension to North `J' Street. 7. North `E' Street — from North 16th Street to UPRR right-of-way line. 8. North 8th Street — Barbour's Cut Boulevard to a point 300 feet north of the north right- of-way line of Barbour's Cut Boulevard. Alton Ogden, owner of property in Sector 23, and developer, spoke in favor of adding truck routes within Sector 23. Mr. Ogden provided the Commission with photos of developments in La Porte similar to what he is proposing to develop. He also showed photos of developments in La Porte that do not comply with existing requirements. Linda Westergren, Sector 23 property owner, spoke in favor of a truck route designation for affected properties in Sector 23, and discussed with staff, different interpretations of a truck terminal. John Zemanek, 3805 Oak Wilde Circle, spoke in favor of a truck route designation in Sector 23 as proposed, but would not favor changing the truck terminal definition. Planning and Zoning Commission Minutes of March17, 2011 Page 4 of 5 Danny Earp asked staff to report the cost incurred by the city in the maintenance of the proposed truck routes, research the adequacy of width for trucks, and review the potential tax base if the truck route was designated. John Lawler, 911 Oak Leaf, currently a student at the University of Texas, cautioned the Commission on making decisions about truck routes that could adversely affect the quality of life for the citizens of La Porte. Linda Westergren, Sector 23 property owner, thanked John Lawler for his comments and noted that there are no residential properties located within Sector 23. c. Comprehensive Plan- Update Masood Malik, City Planner, gave staff's report. The La Porte 2020 Comprehensive Plan is an official public document that acts as a general guide for how the City should grow and operate over a 20 year interval. The first 5-year update was performed in-house. The City is now 10 years into the 2020 Comprehensive Plan. During the past10 years there have been significant changes and other major activities have occurred. As communities face growth -related challenges, a need for professional planning services arises. The Houston -Galveston Area Council (H-GAC) has introduced PlanSource, a program designed to assist local governments in reducing costs and streamlining the procurement process. PlanSource is a cooperative purchasing program for planning services, i.e. comprehensive plan, land use, transportation, parks and recreations, economic development, feasibility studies and visioning. The City utilized H-GAC to locate a consultant or firm to accomplish this important Comprehensive Plan update. Staff met with the planning consultant, Kendig Keast Collaborative, and discussed goals and objectives of the Comprehensive Plan Update. The planning consultant has assembled the scope of study; salient features are as follows: • Citizen Involvement in the Planning Process • Existing Information Review • Structural Plan — Context, Land Use & Character, Downtown Master Plan, Parks & Recreation Master Plan, Infrastructure & Growth Capacity, Community Mobility, Economic Development, Implementation • Deliverables 7. Administrative Reports There were none. 8. Commission Comments David Janda asked Masood Malik to report on new business in La Porte. Mr. Malik reported "Carl's Jr." will be building at the SW corner of Spencer and Canada. David Janda thanked John Lawler for his input during the meeting. Staff Report CHEMICAL LIME April 21, 2011 Zone Change Request Requested by: Brolyn Petri on behalf of Chemical Lime (Lhoist North America) Requested for: TRS A & IA, Blk. 1, Nebraska Syndicate Location: 801 North 16th Street Land Use: Industrial Present Zoning: Light Industrial (LI) Requested Zoning: Heavy Industrial (HI) Surrounding Zoning: North -Heavy Industrial (HI) South -Light Industrial (LI) East - HI & PUD West - LI Background: The property in question consists of 9.1460 acres described as TRS A & IA, Block 1, Nebraska Syndicate, Johnson Hunter Survey, Abstract 35, La Porte, Harris County, Texas. The subject property has an existing industrial building, office and shop. This rail -served facility has been used for lime manufacturing since the mid 1980's. The subject property is within the vicinity of major commercial and industrial establishments in LaPorte. The property is surrounded by the Strang Road Yard and Union Pacific Railroad's undeveloped parcels of land. Chemical Lime supplies lime based slurry products to industrial and construction customers with a fleet of twenty plus rigs. The La Porte plant processes quicklime made in quarry facilities into final product of lime slurry. 95% of their raw material is received by rail. Rail served facilities or rail service are not permitted in Light Industrial zones but are allowed in Heavy Industrial zones. The applicant is requesting a zone change of the subject property from LI to HI to be in compliance with the City's Code of Ordinances. Chem Lime P&Z 4/21/11 Page 2 of 3 Analysis: In considering this request, Staff reviewed the following elements of the Comprehensive Plan. Land Use — The City's Land Use Plan indicates this area developing with industrial uses. These uses are typically as intense as the industrial land use which is where the applicant's request would be categorized. Conformance of a zoning request with the land use plan is one consideration among several criteria to be considered in approving or denying a rezoning application. Other criteria may include: • Character of the surrounding and adjacent areas; • Existing use of nearby properties, and extent to which a land use classification would be in harmony with such existing uses or the anticipated use of the properties; • Suitability of the property for the uses to which would be permissible, considering density, access and circulation, adequacy of public facilities and services, and other considerations; • Extent to which the designated use of the property would harm the value of adjacent land use classifications; • Extent to which the proposed use designation would adversely affect the capacity or safety of that portion of the road network influenced by the use; • Extent to which the proposed use designation would permit excessive air pollution, water pollution, noise pollution, or other environmental harm on adjacent land use designations; and, • The gain, if any, to the public health, safety, and welfare due to the existence of the land use designation. Surrounding properties to the north and east are currently zoned Heavy Industrial. Properties to the south and west are light industrial with rail spur serving this facility and Strang Yard to the west of the subject property. If the applicant's request is granted, the property will be compatible with the current use and zoning designation of the surrounding properties. Transportation — Currently, the property in question has ingress/egress along North 16th Street which dead ends at the northeast corner of this facility. However, a majority of their receiving and shipping is through rail served by UPPR. Chem Lime P&Z 4/21/11 Page 3 of 3 Conclusion/ Recommendation: Utilities — Currently, the site has sufficient water and sewer facilities to serve this development. Public infrastructure will not be affected with the requested change. Based on the above analysis, staff finds the requested change is compatible with the zoning and uses of nearby properties. The change from Light Industrial (LI) to Heavy Industrial (HI) will have no impact on the future development within the area. Staff recommends approval of the rezone request. Options available to the Commission are: • Recommend to Council approval of this rezoning request from LI to HI. • Recommend to Council denial of this rezoning request from LI to HI. • Table this item for further consideration by the Commission. Staff Report SULZER INC. April 21, 2011 Zone Change Request Requested by: Billy Coleman, Vice President of Operations on behalf of Sulzer Inc., the property owner Requested for: 6.7973 acres, TR 333B & W 168' of Lot 348, Lot E 168' of Lot 348 & TR 333A, TRS 347A-2 & 347A-IA, La Porte Outlots in the Enoch Brinson Survey, Abstract 5, LaPorte, Harris County, Texas. Location: 11518 Old La Porte Road / North `P' Street Present Zoning: Large Lot Residential (LL) Requested Zoning: Light Industrial (LI) Surrounding Zoning: North — Light Industrial (LI) South - Large Lot District (LL) East —Low Density Residential (R-1) West — Large Lot District (LL) Background: The subject tract is located just south of Sulzer/Hickham Industries, Inc. at 11518 Old La Porte Road along State Highway 225. Three parcels comprise the 6.7973 acre tract, a 1.9170 acre tract of land adjacent to the Exxon Pipeline easement is located to the west, 1.9152 acre tract in the center, and 2.9651 acre tract acquired from the City of La Porte for detention purposes to the east. Harris County Flood Control District channel F 101 is to the south of these tracts and necessary easements have already been secured and in place for drainage purpose. In 2009, Sulzer Inc. was the highest bidder of Tract 1 (2.9651 acres) along with two additional tracts (0.0686 & 0.0986 ac) for emergency evacuation purposes (See Exhibit C). Emergency evacuation or secondary access to North `P' Street was proposed in case of any de-railment or similar circumstances. Earlier, the concept was to construct a bridge over the drainage channel to provide future emergency evacuation for personnel at Sulzer Inc. as they have just single access along Old La Porte Road. The applicant is seeking this rezoning from Large Lot (LL) to Light Industrial (LI). The intent is to extend the requested zoning up to the drainage channel (130' ROW) to enlarge/expand current operations and provide detention pond for an existing facility (See Exhibit D). Rezone Request (Sulzer) P&Z 4/21/11 Page 2 of 3 Analysis: The property in question also abuts a residential subdivision along Lemon Lane and Battleground Estates to the east. The subject tract has natural buffers: an existing drainage channel to the south and Exxon Pipeline to the west. However, staff suggests heavy landscaping/screening, to a portion of the subject tract (2.9651 acre), should be provided as a buffer between residential and industrial uses. Tracts south of the drainage ditch are not included as part of this rezoning, thereby allowing the drainage ditch to serve as a natural buffer between the residential and industrial zoned properties. In considering this request, Staff has reviewed the Development Ordinance as well as elements of the Comprehensive Plan. Land Use — The Land Use Plan indicates this area is envisioned as developing as low density residential. The tract in question is within the vicinity of various industrial establishments along State Highway 225. Conformance of a zoning request with the Land Use Plan is one among several criteria to be considered in approval or denial of an application. Other criteria may include: • Character of the surrounding and adjacent areas; • Existing use of nearby properties, and extent to which a land use classification would be in harmony with such existing uses or the anticipated use of the properties; • Suitability of the property for the uses to which would be permissible, considering density, access and circulation, adequacy of public facilities and services, and other considerations; • Extent to which the designated use of the property would harm the value of adjacent land use classifications; • Extent to which the proposed use designation would adversely affect the capacity or safety of that portion of the road network influenced by the use; • Extent to which the proposed use designation would permit excessive air pollution, water pollution, noise pollution, or other environmental harm on adjacent land use designations; and, • The gain, if any, to the public health, safety, and welfare due to the existence of the land use designation. Streets — The property is located approximately 1500' south of State Highway 225 and nearly 1000' north of North P Street. Currently, this Rezone Request (Sulzer) P&Z 4/21/11 Page 3 of 3 Conclusion/ Recommendations: property is landlocked and has no street access. The only access is from the adjoining properties to the North. Access from North P Street could be provided via a bridge constructed over the drainage channel or by moving tracts 2 &3 to the east adjacent to the drainage ditch. The other option for feasible development of this tract is through north properties along State Highway 225. Traffic circulation and parking will be reviewed with the site development plan submittal. Utilities — Public facilities and services are sufficient to handle the supply of potable water and fire protection along Old La Porte Road. Provisions will have to be made to ensure that all on -site infrastructure or improvements can accommodate the water and sanitary sewer needs of future developments. The storm water drainage issue will be reviewed with the site development plans and on -site detention. There is an existing 40'wide drainage channel F 101, that is planned to be expanded to 130' wide. Development Strategy — The highest use analysis presented by the applicant reveals that the subject property would be better served by the proposed use (Turbo Services Expansion), which would blend into an existing use of property to the north and west of the subject tract. Based on the above analysis, staff finds the requested change should conform to the zoning and uses of nearby properties. The tract in question is suitable for the requested change to Light Industrial (LI) zone. Development within the subject tract should not negatively impact the surrounding properties nor harm the value of nearby properties. It should not have a significant impact on traffic conditions in the area and utilities should not be affected. The applicant has demonstrated that the requested zoning would represent the highest and best use of the property. Granting the requested change should not be contrary to the goals and objectives of the Comprehensive Plan. Staff recommends changing the zoning of this tract from Large Lot to Light Industrial. In addition, staff suggests a 1.75 acre tract south of the drainage ditch not be included with this rezone request. Actions available to the Commission are listed below: • Recommend to Council approval of this rezoning request from Large Lot to Light Industrial as submitted. • Recommend to Council denial of this rezoning request from LL to LI. • Table this item for further consideration by the Commission. Zoch, CCIM c/o The Carson Companies Requested For: 15.78 acres of land out of the Enoch Brinson Survey, Abstract No. 5, La Porte, Harris County, Texas Location: 1445 Sens Road Present Zoning: Light Industrial (LI) Background Applicant is proposing a 254,800 sq.ft. office/warehouse & distribution center along Sens Road, south of State Highway 225 and UPRR. The subject property, consisting of 15.78 acres of land, is located to the east of Sens Road at North `P' Street. The property is in the vicinity of major commercial/industrial establishments along Sens Road and State Highway 225. Under the terms of Development Ordinance 1444, the proposed development will require a major development site plan. This is based on the size of the development being in excess of 10 acres. Analysis: Land Use — The City's Land Use Plan shows this area developing with commercial industrial uses. The existing land use is vacant. Transportation - Staff notes that the primmy facility fronts Sens Road and is within close proximity to State Highway 225. The proposed use will generate some additional traffic, but existing roadways are capable of handling additional traffic generated by the proposed development. A traffic impact analysis has been performed and is attached hereto. Topography — This area is relatively flat and stable and should not be an obstacle to this type of development. Utilities - Staff reviewed the existing facilities and services for each of the components of the utility system for the proposed development. Existing water is adequate for potable and fire protection needs. An 8" fire line with fire sprinkler tank is proposed for this project. On -site waterline and fire hydrants would be privately maintained. The City maintenance responsibility is up to the flange of the tapping sleeve. Private fire line and hydrant notes are clearly indicated on the site plan. SanitaiN- sewer is readily available to the property. The developer shall be responsible for all on -site utility extensions to serve the facil*itv. - Sens Road Dist. Ctr. Site Plan Page 2 of 2 Drainage - The drainage for the proposed development is within the 17101 watershed. The applicant is providing detention to the north abutting UPRR and State Highway* 225. Harris County Flood Control District (HCFCD) will determine detention criteria because of the direct outfall into F101 and TxDOT system. TxDOT approval is required for the driveway* along its roadway* as well as drainage. An express review sheet from Harris County* and driveway* permits shall be required before final approval of the site plan will be granted by the City of La Porte. Exterior Building Design Standards — Proposed facility* is subject to the City of La Porte exterior building design standards of 100% masomy and glass products, as required along major thoroughfares. Proposed Sens Road Distribution Center building shall be pre -cast concrete exterior walls, dock high class A building with TPO built-up roof and aluminum framed windows. Economic Development — The proposed project represents a significant positive impact to economic development within the City* of La Porte. The site will be developed as office/warehousing and distribution center. Ultimately*, the development is estimated to have a veiN- positive impact on both the City and school district in terms of property* tax revenues. Conclusion/ Recommendation: Staff has reviewed the major development site plan for the Sens Road Distribution Center and found it complies with the Development Ordinance. The site plan is recommended for approval with the following conditions: • Furnish the City an approval of driveway* and drainage by TxDOT. • Provide the City a copy* of Express Review Sheet by Harris County*. • Provide the City a copy* of driveway* permits issued by Harris County* prior to the issuance of any* building permits. • Stormwater permit with permanent control features shall be required. The distribution center will be located on a vacant plot of land at the northeastern corner of the intersection North P Street and Sens Road. The location of the proposed distribution center is shown in Figure 1, and the proposed site plan is shown in Figure 2. Access to the distribution center will be provided by three driveways: one on Sens Road and two on the turnaround road underneath the overpass. The southern driveway on the turnaround road will provide the primary access point for truck traffic during the day. The third driveway on Sens Road is expected to be used by trucks and/or staff. A proposed fire access driveway will provide emergency access only from North P Street. Figure 2 Site Plan Existing Conditions - Analyses of traffic impacts on the intersections of Sens Road at SH 225 Eastbound Frontage Road (EBFR) and Sens Road at SH 225 Westbound Frontage Road (WBFR) were performed. The intersection of Sens Road at SH 225 EBFR is signalized. The eastbound approach provides one shared left-turn/through lane, one through lane, and one shared through/right-turn lane. The northbound approach provides one through lane and one shared through/right-turn lane. The southbound approach provides one left -turn lane with approximately 250 feet of storage and two through lanes. The intersection of Sens Road with SH 225 WBFR is signalized. The northbound approach provides one left turn lane with approximately 165 feet of storage and one through lane. The westbound approach provides one shared left-turn/through lane and one shared through/right-turn lane. Signal phasing for the northbound left -turn is protected -permitted. Existing AM and PM peak hour traffic counts were obtained for the intersections of Eastbound SH 225 at Sens Road and for Westbound SH 225 at Sens Road. Trip Generation - Trips to and from the distribution center were estimated using equations, rates, and procedures from the Institute of Transportation 'Fable 2 Trip Generation for Sens Road Distribution Center - AM _.— PeaEngineers publication Trip Generation. The unadjusted ITE trip Light Industrial (254,800 sq ft) 1 206 28 31 217 generation for the proposed site is 234 trips in the AM peak hour and 247 trips in the PM peak hour. 100% of the generated trips were assumed to be made by trucks, which is a conservative estimate because some of the trips will be staff and employees accessing the facility in their private vehicles. Trip Distribution - The trips generated by the proposed distribution facility were distributed 50% to/from the west along SH 225 and 50% to/from the east along SH 225. SH 225 provides the most direct connection to the long -haul routes along east and west IH-10 that trucks will likely utilize. No trucks associated with the distribution facility are expected to utilize Sens Road to the south of the site. Capacity Analysis - Capacity analysis was performed at the two intersections using Synchro software, which is based on the procedures of the Highway Capacity Manual. Capacity analysis results in a level of service (LOS), an estimate of delay at an intersection as well as a letter score. LOS ranges from LOS A, which indicates free -flow conditions, to LOS F, which indicates highly -congested and unstable conditions. Two scenarios were modeled: background traffic, which includes the traffic that would already be present at the intersections when the distribution facility is opened, and future traffic, which adds site -generated traffic to the background traffic. Table 2 shows the LOS for the intersections of Sens Road at SH 225 EBFR and Sens Road at SH 225 WBFR. THE TEAM YOU CAN DEPEND ON PAGE 3 OF 4 TRAFFic EjvGijvEERs, / C. The existing volumes are low compared to the capacity of the intersections and will remain comparatively low even with the addition of site -generated traffic. The per -vehicle delays at the intersection of SH 225 EBFR at Sens Road in the AM Peak is actually projected to improve: this is due to the high number of right -turns onto the SH 225 EBFR for site -generated traffic. Vehicles making the right -turn movement incur less delay than the average vehicle utilizing the intersection because of their ability to make a right -turn on red. Because the analysis indicates the distribution center will have no significant traffic impacts, no street or signal improvements are recommended.
