ADDENDUM TO MEETING NOTICE
The following items will be added to the January 12, 2009 City Council Meeting to be held in the Council
Chambers at City Hall, 604 West Fairmont Parkway, La Porte, Texas. The below item will be discussed on
January 12, 2009 at 6:00 p.m.
Consider approval or other action regarding a resolution requesting that a portion of State
Highway Business 146 be remove from the State Highway System, from Wharton Weems
Boulevard to State Highway 146 (BFI46D); (Res. 200S-1S-A) - J. Joerns
I hereby certify that I posted this Notice on the bulletin board located at a place convenient to the public in the
City Hall of the City of La Porte, 5:00 p.m. on the 9th day of January 2009, and that (1) said Notice was
posted for at least 72 hours preceding the scheduled time of the meeting; or (2) if this Notice was posted less
than 72 hours but more than 2 hours before the meetinq convened, I hereby certify that said meetinq was
called because of an emerqency or urqent public necessity limited to imminent threats to public health and
safety or reasonable unforeseeable situations requirinq immediate action by the City Council.

SUMMARY & RECOMMENDATION
On November 10, 2008, City Council passed Resolution 2008-15 requesting that portions of
Business SH146 be removed from the State Highway Systems after certain conditions are met.
That Resolution included January 1,2009 as the effective date. At that time it was anticipated
that the Commission would act in January.
On Thursday, January 8, 2009, TxDOT notified us that the City will need to modify the
Resolution under Section 1 by removing January 1, 2009 and adding 'upon written notification
by the State.
We will need this information back to them by January 21 st in order to make the March
Commission Agenda.

RESOLUTION NO. 2008- 15-A
A RESOLUTION REQUESTING THAT A PORTION OF STATE HIGHWAY
BUSINESS 146 BE REMOVED FROM THE STATE HIGHWAY SYSTEM,
FROM WHARTON WEEMS BOULEVARD TO STATE HIGHWAY 146 (BF
146D); FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, State Highway Business 146 traverses through the City of La Porte;
WHEREAS, a portion of State Highway Business 146 includes the City's Main Street
district;
WHEREAS, the City of La Porte desires to increase economic development within the
City's Main Street district, including planned development within the existing State
Highway Business 146 right-of-way;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
Section 1. The City of La Porte requests that State Highway Business 146 (BF 146D)
from the North right-of-way line of Fairmont Parkway Northward and Westward
(Broadway and Main Street) be removed from the State Highway System effective upon
written notification by the State. Also, the City requests that State Highway Business 146
(BF 146D) from the North right-of-way line of Fairmont Parkway to the North right-of-
way line of Wharton Weems Boulevard be removed from the State Highway System no
later than six (6) months after the state has overlayed and striped this segment based on a
formal agreement between the City of La Porte and the Texas Department of
Transportation.
It is also understood that the State may re-designate the remaining portions of State
Highway Business 146 and Spur 501.
Section 2. The City Council officially finds, determines, recites and declares that a
sufficient written notice of the date, hour, place and subject of this meeting of the City
Council is posted at a place convenient to the public at the City Hall of the City for the
time required by law preceding this meeting, as required by the Chapter 551, Tx. Gov't
Code; and that this meeting has been open to the public as required by law at all times
during which this resolution and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting thereof.
Section 3. This Resolution shall be effective upon its passage and approval.
