Rigby, Mayor] (b) Adopt Resolution 2022-22 authorizing the City Manager to execute the Texas Department of Transportation Impaired Driving Mobilization (IDM) grant award and other documents for the TXDOT IDM Selective Traffic Enforcement Program (STEP) Grant. [Steve Deardorff, Chief of Police] (c) Approve rollover of requested encumbrances from City of La Porte, Texas, Fiscal Year 2022 budget to City of La Porte, Texas, Fiscal Year 2023 budget. [Michael Dolby, Finance Director] (d) Award bid #23004 'Annual Requirements Contract for Mowing Services' and authorize the City Manager to execute a potential two (2) year and nine (9) month agreement with NeoGlobal Enterprises, LLC d/b/a Horticare Landscape Management, for mowing of various City properties, not to exceed the annual budgeted amount. Rigby, Mayor] (f) Authorize the City Manager to execute a renewal agreement with CentralSquare Technologies, Inc. for the ONESolution Enterprise Resource Planning (ERP) system software in the amount of $207,900.00 [Matt Daeumer, Assistant City Manager] (g) Approve the purchases of replacement vehicles and equipment through TIPS Cooperative Purchasing Program contract #20026, and BuyBoard contracts #601-19 and #603-20, in connection with Fiscal Year 2022-2023 Vehicle Replacement Program. [Ray Mayo, Director of Public Works] (h) Reject the single bid received in response to City of La Porte Bid #23010 'Main Sewer Rehabilitation'. PUBLIC HEARINGS AND ASSOCIATED ORDINANCES (a) The City Council will hold a public hearing to receive comments regarding the recommendation by the Planning and Zoning Commission to adopt Ordinance 2022-3907 amending the Code of Ordinances of the City of La Porte, Texas, Chapter 106 "Zoning" by amending regulations related to deadlines for recommendations of the Planning and Zoning Commission, shopping center off-street parking, gas station uses, tobacco/vape shop uses, grid -scale battery energy storage uses in commercial and industrial zones, and setbacks for swimming pools; followed by discussion and possible action to consider adopting Ordinance 2022-3907 amending the Code of Ordinances of the City of La Porte, Texas, Chapter 106 "Zoning" by amending regulations related to deadlines for recommendations of the Planning and Zoning Commission, shopping center off-street parking, gas station uses, tobacco/vape shop uses, grid -scale battery energy storage uses in commercial and industrial zones, and setbacks for swimming pools. COUNCIL COMMENT Near announcements concerning matters appearing on the agenda; items of community interest; and/or inquiries of staff regarding specific factual information or existing policy from the Mayor, Councilpersons, and City staff, for which no formal action will be discussed or taken. 10. EXECUTIVE SESSION (a) Texas Government Code Sec. 551.071(1)(A) - Pending or Contemplated Litigation. The City Council will meet in closed session with the City Manager and Assistant City Attorney to discuss the status of City of La Porte vs. Darius Anthony Meza, Cause No. 2022-32341 [Clark Askins, Assistant City Attorney; Corby Alexander, City Manager] (b) Texas Government Code Section 551.072 - Deliberation regarding the purchase, exchange, lease, or value of real property. The City Council will meet in closed session with the City Manager and Assistant City Attorney to discuss the purchase of vacant real property legally described as Block 1254, Town of La Porte, and located adjacent to the Bay Forest Golf Course. 11. RECONVENE into open session and consider action, if any, on item(s) discussed in executive session. 12. ADJOURN If, during the course of the meeting and discussion of any items covered by this notice, City Council determines that a Closed or Executive Session of the Council is required, then such closed meeting will be held as authorized by Texas Government Code, Chapter 551, Section 551.071 - consultation with counsel on legal matters; Section 551.072 - deliberation regarding purchase, exchange, lease or value of real property; Section 551.073 - deliberation regarding a prospective gift; Section 551.074 - personnel matters regarding the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee; Section 551.076 - implementation of security personnel or devices; Section 551.067 - deliberation regarding economic development negotiation; Section 551.089 - deliberation regarding security devices or security audits, and/or other matters as authorized under the Texas Government Code. If a Closed or Executive Session is held in accordance with the Texas Government Code as set out above, the City Council will reconvene in Open Session in order to take action, if necessary, on the items addressed during Executive Session. The purpose of the hearing is to receive public input on proposed modifications to Chapter 106 (Zoning) of the City of La Porte's Code of Ordinances related to deadlines for recommendations of the planning and zoning commission, shopping center off-street parking, gas station uses, tobacco/vape shop uses, grid -scale battery energy storage uses in commercial and industrial zones, and setbacks for swimming pools. Following the public hearing, the City Council will act upon the public hearing item and conduct other matters pertaining to the Council. Citizens wishing to address the Council pro or con during the public hearing are required to sign in before the meeting is convened. A quorum of Planning and Zoning Commission members may be present and participate in discussions during this meeting; however, no action will be taken by the Commission. In compliance with the Americans with Disabilities Act, The City of La Porte will provide for reasonable accommodations for persons attending public meetings.
