HomeMy WebLinkAbout12-07-1988 Meeting• MINUTES DECEMBER 7, 1988 1. The meeting was called to order at 6:05 P.M. by Chairman Guy Sutherland. MEMBERS PRESENT: Chairman Guy Sutherland, Vice Chairman Larry Tucker, Secretary Steve Gillett, Members Cliff Hyde, Mike Miller, and John Ladd. MEMBERS ABSENT: None OTHERS PRESENT: None 2. The minutes of the November g, 1988 meeting were read. Motion was made by Member Mike Miller to approve the minutes as presented and seconded by Member Cliff Hyde. Motion was unanimous. 3. Chairman Guy Sutherland discussed the need for a master plan update to identify needed improvements at the airport to take into account the changing environment at the airport. Secretary Steve Gillett outlined the process to obtain the grant and select a consultant. Mr. Gillett will develop a proposal and check with the FAA regional office on the possibility of funding for a master plan update. Member Mike Miller left the meeting at 7:00 p.m. 4. Secretary Steve Gillett reported on the proposed three hundred foot (300") flare stack for Himont USA, Inc. Chairman Guy Sutherland appointed Member Cliff Hyde and Vice Chairman Larry Tucker to draft a response. 5. Chairman Guy Sutherland related that he had visited with the City Manager, Bob Herrera, concerning the vacant position on the Board. He was told to write a letter recommending a candidate. Mr. Sutherland stated he would recommend David Newsom, a pilot, for the remaining position. Bill Gray, with the FAA, was mentioned to fill the FAA advisory position. Paul Johnson, of Eastern Airlines, was suggested to fill the Airline advisory position. Minutes December 7, 1988 Page Two 6. Based on the study it is found that the construction would have no substantial adverse effect on the safe and efficient utilisation of the-aavigable airspace by aircraft or on the operation of air navigation facilities. There- fore, pursuant to the authority delegated to me, it is-hereby determined that the construction would not be a hazard to air navi- gation provided the following conditions are met: Conditions: The structure should, be marked and lighted in accordance with Chapters 3'and~5 in FAA Advisory Circular AC 70/7460-1E, Obstruction Marking and Lighting, which is available free of charge from the Department of Transportation, Publication Section TAD 443.1, 400 7tfi Street, S.W. Washington, D,C, 20590.. Supplemental notice of construction is required any tfine the project is abandoned (use the enclosed FAA form), or (~XX) At least 48 hours before the start of construction (use the enclosed FAA form). ( XX) Within five days after the constructfon reaches its greatest height (use the enclosed FAA form). ( ) Not required. LOCATION OF PROPOSED STRUCTURE Approximately 4 statute miles southwest of the Humphrey Airport. 2. OBSTRUCTION STANDARDS EXCEEDED The proposed structure would exceed obstruction standards of Federal Aviation Regulations, Part 77, as follows.: Section 77.23(a)(2) by 130 feet, the height above ground level (AGL) or airport elevation exceeding 250 feet at 3.5 nautical-miles of the Humphrey Airport established reference point with its longest runway more than 3200 feet in actual length. 3. EFFECT TO AERONAUTICAL OPERATIONS a. En route/Terminal - the proposed structure would not affect any insCrument flight rule (IFR procedure). b. En route/Terminal/Airport - the proposed structure would not affect any visual flight rule (VFR) operations. 4. CIRCULARIZATION AND COMMENTS RECEIVED The proposal was circularized to all known affected aviation interests. and to nonaeronautical interests that may be affected by the proposal. There were no objections or comments receivedaas a result of~the circularization. 5. DETERMINATION - NO HAZARD a, It is determined the proposed structure would have no substantial adverse effect on the safe and efficient use of navigable airspace by aircraft if appropriately marked and lighted. b. Explanation - the proposed structure would not effect any change in IFR procedures or VFR operations. 6. LIMITATIONS This determination, issued in accordance with FAR, Part 77, does not preempt, cancel, alter, supersede, or suspend any ordinances, laws, regulations of any government body or agency. 7. The structure is of sufficient distance from the La Porte Municipal Airport so as not to interfere with aircraft approaching or departing runway 12 or any other runway on the airport. In addition, the structure would not be located in proximity to VFR traffic pattern operations at the La Porte Municipal Airport. Part 77, of the Federal Aviation Regulations, has been changed since - the original zoning ordinance was passed by the La Porte-Harris County Joint Zoning Board in 1957, and the area covered by that ordinance is no longer the area that now should be covered. The airport is zoned for VFR operations and one runway should be zoned for future IFR operations. You should have your engineer draw a new zoning map, and a new Joint -~ Zoning Board should be formed at an early date to bring in the City of Lomax. Box 1115 LaPorte, Texas 77571 Dear Mayor Thomas: As you may know, Grant Agreements resulting from airport development aid programs specify that all possible measures must be taken by the airport sponsor to prevent incompatible land use in the vicinity of the airport. We are sending a letter similar to this to all locations that have had recent Federal-aid airport projects to stress the importance of having a positive program in this regard. We continue to receive, at an increasing rate, reports of such incom- patible development. 'Several instances have been brought to our attention recently in which housing subdivisions, schools and other incompatible development have been constructed in critical areas near public airports. Not only does such construction have an adverse effect on future airport development and expansion, but it is likely to result in noise complaints and even organized opposition to existing airport operations. Such activity tends to erode public support for the airport which is so vital to your total economy. This type of opposition also complicates and delays the preparation of environmental impact statements, approval of which is a prerequisite to federal funding of subsequent airport development projects. The solution to the problem is not easy because of the lack of effective federal and state enabling legislation to control such development. We feel, however, that if airports are to survive, positive action must be taken by the local government to control incompatible growth around the airport. Much can be accomplished through careful handling of building permits and building codes, applying height and hazard zoning and being constantly alert to problems caused by construction near the airport, especially in the approach and departure zones. In this connection, Federal Aviation Regulation (FAR) Part 77 requires that prior to the erection of structures on or within a certain distance of airports, notice must be given to the FAA to permit an airspace evaluation of the effects of the structure on the safe and efficient use of airspace. This review procedure sometimes enables the FAA to prevent construction of hazards or structures that would adversely affect ~ ~ ~ • 2 airport operations. We strongly recommend with the Houston Airports District Office building codes and zoning ordinances with that you communicate frequently to coordinate your application of our airspace analysis. The problem of achieving compatible land use has been recognized by Congress in its recently enacted Airport and Airway Development Act. This new Act contains provisions not previously included which allow the Federal Government to participate in the acquisition of land, purchase of noise- suppressing equipment, the construction of physical barriers and landscaping for the purpose of diminishing the effect of aircraft noise. If you have a noise problem which you feel could be eliminated or reduced by participating in one of the provisions of the Act, you are invited to discuss it with the Airports District Office. We would be most interested in learning what measures have been taken to achieve compatible land use at your airport and in receiving your suggestions as to how we can mutually foster this program.
