BUILDING CODES APPEAL BOARD
Purpose: To provide a comprehensive review of construction codes and make a
recommendation to City Council and to hear and determine appeals from applicants.
Term: 3 Year term
Meeting Time: On an as needed basis.
Eligibility Requirements: They must be a resident or non-resident individuals owning or
operating a business within the City of La Porte. Council will determine competency based on
experience and training in matters pertaining to building construction.
May not be employed by the City of La Porte.

1. CALL TO ORDER
Meeting called to order at 6:03 P.M. by Chairman Tom Campbell.

Sherry Jennings administered oaths to Tom Campbell, Paul Larson, Ron Holt, Ken
Schlather and John Elfstrom. Oaths for Terry Bunch and Bruce Compton will be
administered at a later meeting.
3. CONSIDER APPROVING MINUTES FROM THE AUGUST 15,2007 MEETING
Motion to approve the August 15, 2007 minutes, as submitted, was made by Mr.
Schlather. Second by Mr. Larson. Motion passed unanimously.
4. REVIEW AND DISCUSS CHAPTERS 1-3 OF THE 2006 FUEL GAS CODE
Following a discussion by the Board, Mr. Elfstrom made a motion to close the review
and discussion. Second by Mr. Schlather. Motion passed unanimously.
5. ESTABLISH NEXT MEETING DATE, TIME AND TOPICS
Mr. Larson made a motion to hold the next meeting on February 21,2008 at 6 p.m. with
the following agenda item: 2008 National Electrical Code (NEC) comments. Second by
Mr. Holt. Motion passed unanimously.

6. ADMINISTRATIVE REPORTS
Debbie Wilmore provided the Board with a copy of the December 5,2007 Code
Adoption Educational Meeting Flyer and the code adoption ordinance (2006 Editions).
Staff advised the Board the 2008 NEC books were available. Mr. Elfstrom requested the
Illustrated Code Changes in lieu of a code book. Book arrival should be later December
2007 or early January 2008.
7. BOARD COMMENTS
Staff was asked to proceed with the review of the NEC and provide the Board with typed
comments at the February 2008 meeting.
8. ADJOURN
A motion to adjourn was made by Mr. Elfstrom with a second by Mr. Schlather. Motion
passed unanimously. Meeting adjourned at 6:55 p.m.

Code Deletions:
NONE - No changes proposed to existing local amendments or the 2008 Ed. of the
National Electrical Code (NEC)
Code Amendments:
Section 82-336 is amended to read as follows:
82-336 National Electrical Code - Adoption. The National Electrical Code, 2008
edition, is hereby adopted as the regulations to govern and to be observed and
followed in all electric wiring and in all electrical construction, installation,
repair, alteration, operation and maintenance of electric wiring, apparatus and
fixtures, exceptfor the amendments adopted in Sections 82-337 through 82-350.
Significant Changes noted in the Illustrated Code Changes (2008 Ed. Of the NEC)
Sect. 210.8:
Previous exceptions on GFCI protection (receptacle for
appliances occupying a dedicated space and receptacles that were
not readily accessible) were deleted.
2008 Ed. requires both to be GFCI-Protected
Sect. 212. 12(B):
Previous code required dwelling unit bedrooms (120-v, 15 & 20-
amp branch circuits supplying outlets) to be arc-fault circuit-
interrupter (APCI) protection.
2008 Ed. requires AFCI for family, dining & living rooms,
parlors, libraries, dens, bedrooms, sun rooms, recreation
rooms, closets, hallways, or similar rooms or areas
Sect. 406.11:
New section requires tamper-resistant receptacles in dwelling unit
locations specified in S. 210.52 (kitchen, family & living room,
parlor, library, den, sunroom, recreation room, bathrooms,
outdoors, laundry, basements, garages, hallways & bedrooms).

Author's Comment: The two exceptions permitting receptacles that were not readily accessible and
single or duplex receptacles for two appliances within a dedicated space for each appliance to not
have GFCI protection for personnel in garages and unfinished basements were deleted. The
substantiation in the proposal and the discussion during the Panel deliberation indicated that the present
generation of GFCI devices do not have the problems of nuisance tripping that plagued earlier devices.

Installed in dwelling unit bedrooms shall be protected by a listed arc-fault circuit interrupter, combination type
installed to provide protection of the branch circuit.

Exception NO.1: Where RMC, IMG, EMT or steel armored cable, Type AC, meeting the requirements of 250.118
using metal outlet and junction boxes is installed for the portion of the branch circuit between the branch-circuit
overcurrent device and the first outlet, it shall be permitted to install a combination AFCI at the first outlet to
provide protection for the remaining portion of the branch circuit.
Exception NO.2: Where a branch circuit to a fire alarm system installed in accordance with 760.41 (8) and
760.121 (8) is installed in in RMC, IMC, EMT, or steel armored cable. Type AC, meeting the requirements of
250.118, with metal outlet and junction boxes. AFCI protection shall be permitted to be omitted.
Author's Comment: A new Exception No. 1 has been added to permit a combination AFCI to be
installed at the first outlet to provide protection for the remaining portion of the branch circuit where
RMC, IMC, EMT or steel armored cable, Type AC, meeting the requirements of 250.118 using metal
outlet and junction boxes is installed for the portion of the branch circuit between the branch-circuit
overcurrent device and the first outlet. A new Exception NO.2 has been added permitting rigid metal
conduit, intermediate metal conduit, or electrical metallic tubing to protect the branch circuit supplying
a fire alarm system branch ciruit in lieu of an AFCI device.
