1. CALL TO ORDER
Meeting called to order at 6:00 P.M. by Chairman Tom Campbell.

3. CONSIDER APPROVING MINUTES FROM THE JUNE 26, 2008 MEETING
Motion to approve the June 26, 2008 minutes, as submitted, was made by Mr. Schlather.
Second by Ron Holt. Terry Bunch, Mr. Reed and Mr. Follis all abstained due to their
absences at the previous meeting. Motion passed.
4. REVIEW, DISCUSS AND CONSIDER A BOARD RECOMMENDATION TO CITY
COUNCIL REGARDING A POSSmLE WCAL RESIDENTIAL (IRC) AND
COMMERCIAL (mC) BUILDING CODE AMENDMENT PROHmITING THE USE
OF STAPLES FOR INSTALLATIONS OF ROOFS
Mr. Campbell made a motion to allow Tommy Moser speak regarding this matter.
Second by Mr. Follis. Following Mr. Moser's comments and the Board's discussion, Mr.
Schalther made a motion for staff to obtain a formal ICC code interpretation on IRC code
Sect. R905.2.5 and R 905.2.6 in regards to a possible conflict with manufacturer's
recommendation. Second by Mr. Follis. Motion passed unanimously.

5. ESTABLISH NEXT MEETING DATE, TIME AND TOPICS
Mr. Follis made a motion that the next meeting be held on January 15,2009 at 6 p.m. and
the agenda should include a discussion on the ICC interpretation and an inspection
process on asphalt shingle roofing. Second by Mr. Schlather. Motion passed
unanimously.
Mr. ScWather made a motion to include a discussion on board member terms. Second by
Mr. Holt. Motion passed unanimously.
Mr. Campbell made a motion that staff develop a handout describing the Board's duties
and include it for discussion on the next agenda. Second by Mr. Follis. Motion passed
unanimously.
Paul Larson made a motion to include drinking fountain code requirements for discussion
on the next agenda. Second by Mr. Holt. Motion passed unanimously.

BUILDING CODES APPEAL BOARD
Purpose: To provide a comprehensive review of construction codes and make a
recommendation to City Council and to hear and determine appeals from applicants.
Term: 3 Year term
Meeting Time: On an as needed basis.
Eligibility Requirements: They must be a resident or non-resident individuals owning or
operating a business within the City of La Porte. Council will determine competency based on
experience and training in matters pertaining to building construction.
May not be employed by the City of La Porte.

BUILDING CODE APPEALS BOARD
(Ordinance #04-2733-A)
In December 2004, the Building Code Appeals Board (BCAB) was created to hear and
decide appeals of orders, decisions or determinations relative to the application and
interpretation of the adopted building codes.
The Board has the following powers:
1. To hear and decide appeals from the determination of a Building Official where it
is alleged that on a claim that the true intent of the building and construction
codes have been incorrectly interpreted, that the provisions do not fully apply, or
that an equally good or better fonn of construction is proposed. The Board shall
have no authority to waive requirements of the code.
2. BCAB is to conduct a regular comprehensive review of the codes adopted and has
the power to recommend to the City Council changes, additions or deletions from
said codes for any reason including the following:
a. Defects in the text of the codes;
b. Deficiencies created by improper or lax administration of the codes; or
c. Inconsistency with the State Statutes or judicial decisions.

ICC Code Interpretation (Mike):
IRC Sect. R905.2.5 Fasteners.
Section identifies the kind of nails to be used for asphalt shingle installation.
IRC Sect R905.2.6 Attachment.
Section states asphalt shingles shall have the minimum number of fasteners required by
the manufacturer. He believes that they talking about manufacturer recommendations
on the nailing pattern - but still talking about nails rather than staples - even though
manufacturers do allow use of staples.
IRC Sect. R1 04.11 Alternative materials. design and methods of construction and
equipment.
He stated an alternative material, design or method of construction shall be approved
where the building official finds that the proposed design is satisfactory and complies
with the intent of the provisions of this code and that the material, method or work
offered is, for the purposed intended, at least the equivalent of that prescribed in this
code.
Past practices have been to allow the manufacturer's installation
instructions as to "fasteners and nailing". Should the decision be
made to utilize only nails, a clarification policy can implement the
change immediately.
CLARIFICATION POLICY ON
ASPHALT ROOF SHINGLES
INSTALLATION/INSPECTIONS

Effective 01/16/09
Policy to clarify Asphalt Roof Shingles Installation/Inspections #P2009-00 1.
Purpose: To ensure proper installation of asphalt roof shingles for basic wind speed of
120 mph for both residential and non-residential structures.
Timing: Permanent policy for use by the public and staff
Policy: All asphalt roof shingles shall be a minimum of Class F shingles and installed
with nails (regardless of whether the manufacturer allows the use of staples). Nailing
shall be in accordance with the manufacturer's printed installation instructions.
Owner and contractor shall be responsible for ensuring the use of Class F shingles. The
shingle wrapper shall be retained to confirm compliance of applicable material.
Within 30-days of permit issuance, a final approval on the installed roof is required.
The Owner and/or Contractor shall be responsible for providing the City with a
certification letter by a Texas licensed engineer (original seal/signature required) ~ or-
ICC certified Coastal Construction & Floodplain Inspector (certificate #//signature
required). Letter shall certify: 1) Class F shingles were used: 2) shingles were properly
installed with nails (not staples): and 3) the proper number of nails were used.
NOTE: For properties east of New Highway 146, compliance with the additional Texas
Department oflnsurance (TDI) windstorm requirements is voluntary. However, many
insurance companies require state approval before they will insure roofs, so we
recommend you talk with your insurance agent on their requirements. Also, for
requirements/inspections by TDI, you may contact them at #281-474-5025.

SECTION 401
GENERAL
401.1 Scope. This chapter shall govern the materials, design
and installation of plumbing fixtures, faucets and tixture tit-
tings in accordance with the type of occupancy, and shall pro-
vide for the minimum number of fixtures for various types of
occupancies.
401.2 Prohibited fixtures and connections. Water closets
having a concealed trap seal or an unventilated space or having
walls that are not thoroughly washed at each discharge in
accordance with AS ME A 112.19.2M shall be prohibited. Any
water closet that permits siphonage of the contents of the bowl
back into the tank shall be prohibited. Trough urinals shall be
prohibited.
401.3 Water conservation. The maximum water flow rates
and flush volume for plumbing fixtures and fixture fittings
shall comply with Section 604.4.
SECTION 402
FIXTURE MATERIALS
402.1 Quality of fixtures. Plumbing tixtures shall be con-
structed of approved materials, with smooth, impervious sur-
faces, free from defects and concealed fouling surfaces, and
shall conform to standards cited in this code. All porcelain
enameled surfaces on plumbing fixtures shall be acid resistant.

402.2 Materials for specialty fixtures. Materials for specialty
fixtures not otherwise covered in this code shall be of stainless
steel, soapstone. chemical stoneware or plastic, or shall be
lined with lead, copper-base alloy, nickel-copper alloy, con'o-
sion-resistant steel or other matelial especially suited to the
application for which the fixture is intended.
402.3 Sheet copper. Sheet copper for general applications
shall conform to ASTM B 152 and shall not weigh less than 12
ounces per square foot (3.7 kg/m").
402.4 Sheet lead. Sheet lead for pans shall not weigh less than
4 pounds per square foot (19.5 kg/m2) coated with an asphalt
paint or other approved coating.
SECTION 403
MINIMUM PLUMBING FACILITIES
-/5( 403.1 Minimum number of fixtures. Plumbing fixtures shall
be provided for the type of occupancy and in the minimum
number shown in Table 403 .1. Types of occupancies not shown
in Table 403.1 shall be considered individually by the code offi-
cial. The number of occupants shall be determined by the Inier-
national Building Code. Occupancy classification shall be
determined in accordance with the International Building
Code.

SECTION 409
D1SHWASHING MACHINES
409.1 Approval. Domestic dishwashing machines shall con-
form to ASSE 1006. Commercial dishwashing machines shall
conform to ASSE 1004 and NSF 3.
409.2 Water connection. The water supply to a dishwashing
machine shall be protected against backflow by an air gap or
backflow preventer in accordance with Section 608.
409.3 Waste connection. The waste connection of a
dish washing machine shall comply with Section 802.1.6 or
802.1.7, as applicable.

SECTION 410
DRINKING FOUNTAINS
410.1 Approval. Drinking fountains shall conform to ASME
AI12.19.1M,ASMEAI12.19.2Mor ASMEAI12.19.9M and
water coolers shall conform to ARI 1010. Drinking fountains
and water coolers shall conform to NSF 61, Section 9. Where
water is served in restaurants, drinking fountains shall not be
required. In other occupancies. where drinking fountains are
required, water coolers or bottled water dispensers shall be per-
mitted to be substituted for not more than 50 percent of the
required drinking fountains.
410.2 Prohibited location. Drinking fountains shall not be
installed in public restrooms.
SECTION 411
EMERGENCY SHOWERS AND
EYEWASH STATIONS
411.1 Approval. Emergency showers and eyewash stations
shall conform to ISEA Z358.1.
411.2 ,"Vaste connection. Waste connections shall not be
required for emergency showers and eyewash stations.
SECTION 412
FLOOR AND TRENCH DRAINS
412.1 Approval. Floor drains shall conform to ASME
A 112.6.3, ASME A 112.3.1 or CSA B79. Trench drains shall
comply with ASME AI12.6.3.
412.2 Floor drains. Floor drains shall have removeable strain-
. ers. The floor drain shall be constructed so that the drain is
capable of being cleaned. Access shall be provided to the drain
inlet.
412.3 Size of floor drains. Floor drains shall have a minimum
2-inch-diameter (5 I mm) drain outlet.
412.4 Public laundries and central washing facilities. In
public coin-operated laundries and in the central washing facil-
ities of multiple-family dwellings, the rooms containing auto-
matic clothes washers shall be provided with floor drains
located to readily drain the entire floor area. Such drains shall

have a minimum outlet of not less than 3 inches (76 mm) in
diameter.
SECTION 413
FOOD WASTE GRINDER UNITS
413.1 Approval. Domestic food waste grinders shall conform
to ASSE 1008. Commercial food waste grinders shall conform
to ASSE 1009. Food waste grinders shall not increase the
drainage fixture unit load on the sanitary drainage system.
413.2 Domestic food waste grinder waste outlets. Domestic
food waste grinders shall be connected to a drain of not less
than 1.5 inches (38 mm) in diameter.
413.3 Commercial food waste grinder waste outlets. Com-
mercial food waste grinders shall be connected to a drain a min-
imum of2 inches (5 I mm) in diameter. Commercial food waste
grinders shall be connected and trapped separately from any
other fixtures or sink compartments.
413.4 Water supply required. All food waste glinders shall be
provided with a supply of cold water.
SECTION 414
GARBAGE CAN WASHERS
414.1 Water connection. The water supply to a garbage can
washer shall be protected against backflow by an air gap or a
backtlow preventer in accordance with Section 608.] 3.1,
608.13.2.608.13.3,608.13.5,608. I 3.6 or 608.13.8.
414.2 Waste connection. Garbage can washers shall be
trapped separately. The receptacle receiving the waste from the
washer shall have a removable basket or strainer to prevent the
discharge of large particles into the drainage system.
SECTION 415
LAUNDRY TRAYS
415.1 Approval. Laundry trays shall conform to ANSI
ZI24.6, ASME AI12.19.1M, ASME A112.19.3M, ASME
AI12.19.9M. CSA B45.2 or CSA B45.4.
415.2 Waste outlet. Each compaI1ment of a laundry tray shall
be provided with a waste outlet a minimum of l.5 inches (38
mm) in diameter and a strainer or crossbar to restrict the clear
opening of the waste outlet.
SECTION 416
LAVATORIES
416.1 Approval. Lavatories shall conform to ANSI ZI24.3,
ASME AI12.19.IM, ASME AII2.19.2M, AS ME
AI12.19.3M, ASMEAI 12.19.4M, AS ME Al 12.19.9M, CSA
B45.1, CSAB45.2, CSAB45.3 orCSA B45.4. Group wash-up
equipment shall conform to the requirements of Section 402.
Every 20 inches (508 mm) of lim space shall be considered as
one lavatory.
416.2 Cultured marble lavatories. Cultured marble vanity
tops with an integral lavatory shall conform to ANSI Z 124.3 or
CSA B45.5.

SECTION 2901
GENERAL
[P] 2901.1 Scope. The provisions of this chapter and the Inter-
narional Plumbing Code shall govern the erection, installation,
alteration, repairs, relocation, replacement, addition to, use or
maintenance of plumbing equipment and systems. Plumbing
systems and equipment shall be constructed, installed and
maintained in accordance with the International Plumbing
Code. Private sewage disposal systems shall conform to the
International Private Sewage Disposal Code.

MINIMUM PLUMBING FACILITIES
[P] 2902.1 Minimum number of fixtures. Plumbing fix ures
shall be provided for the type of occupancy and in the mini-
mum number shown in Table 2902. 1 Types of occupancies not
shown in Table 2902.1 shall be considered individually by the
building official. The number of occupants shall be determined
by this code. Occupancy classification shall be determined in
accordance with Chapter 3,
