CANADA ROAD
INFORMATIONAL MEETING
JULY 22, 2003

Property Owners and Representatives Present: Bobby Grisham, Parcels C, E & F;
Larry Allen, Nolan Allen and Jack Howard, Parcel G; Joel Chambers, Parcel B.
Consultant Present: Ron Bavarian, Walsh-Freese & Nichols.
1. Meeting called to order by Assistant City Manager John Joerns at 6:30 pm.
2. John Joerns introduced City Council City Staff and the Consultant. He requested
all present to introduce themselves and identify their interest. He also reminded everyone
to sign in.
3. John Joerns reviewed the letter sent to property owners and residents, and
discussed the challenges facing the Project. He briefly reviewed the need for donated
Right of Way, budget challenges, and requests received from some property owners for
favorable zoning in exchange for property donations.
4. Ron Bavarian presented a display board that outlined the road cross-sections in
the various portions of the Project. He answered questions from those present.
5. Steve Gillett presented an overhead presentation of the list of steps necessary to
complete the Project, as well as a draft cost estimate of road construction. John Joerns
reminded everyone that the estimate did not include utilities.
6. John Joerns reviewed the need for property owners to donate the necessary Right
of Way to begin bringing the estimated cost in line with the projected budget. He
reviewed the steps that might be taken if Project costs could no be lowered through
property donation, including paving lien assessments, phased construction, reducing the
scope of the Project and phasing or elimination of utilities. City Attorney Knox Askins
reviewed the tax benefits of property donation and the paving lien assessment process.
Finally he discussed the prohibition of contract zoning - the exchange of favorable
rezoning of property in exchange for property donation. He explained that this violated
state law, but property owners were welcome to avail themselves of the existing rezoning
process through the City's Planning and Zoning Commission.
7. John Joerns discussed the benefits of proposed utilities to property owners. He
reminded them that they were not free - development of property would require the
payment of front-foot fees if the City installed. rfthey were not constructed due to
budget constraints, property owners would be responsible for construction, with the
possibility of reimbursement under the utility extension policy. Ron Bavarius stated that
the utilities had not yet been designed. His firm has performed a feasibility study for
water and sewer construction, looking at several alternatives, and that the recommended
alternative would be designed as soon as the City authorized the proposal submitted for
design. He also stated that, under the preferred alternative, a small lift station site
(25'x25') would be required in the southeast portion of the Project.
8. Questions:
~ Existing resident have mailboxes on west side of Canada, with residences on the
east side. How will they cross busy, 4-lane road to get mail. Staff will research
the possibility of the Postal Service changing mail delivery to the east side of
Canada prior to construction.
~ Property owners questioned whether regional detention was design or
contemplated. The current road design does not contemplate draining acreage -
only to roadway. Discussion was held that the City consider incorporation of a
regional detention facility in the road design or, possibly incorporate detention in
the design and development of the proposed park.
~ Property owners wanted to know the process for property donation for Right of
Way. Knox Askins explained the process. Property owners were directed to
contact Steve Gillett to initiate the process, and he would coordinate with Mr.
Askins.
~ Potholes on existing Canada Road from HCFCD construction. City will follow
up on repairs to Canada Road as needed.
~ Where will project start - north or south end. Ron Baverian indicated that the
design called for the Project to begin on the south end, due to drainage
construction concerns. Will follow up on this with Engineer to see if construction
can begin on North end, especially the intersection of Spencer Highway.
