Benson ".R. Boyle, Fred R. Ruff. Ald. b.N. Agee came in to the meeting at a little later time. Resolution P"",iinutes of the last regular and two special meetings were read and approved. T.g. F~aldrop,~ Vies: Pres, and Gen. hanager of the Southern Pacific Transport Company appeared before the Council in the interest of removal of the restrictions from the Certificate issued by the Texas Railway Commmission to the Southern Pacific Transport Co. on its route through La Porte. Cn motion of Ald. Ruff, second by Ald. Benson, the follav:ing resolution rues unanimously passed by the City Counoil, to wit, '~'~ ~' ,the Texas Railroad Commission issued Certificate 29.5 to the Southern Pacific Transport Cn~mpany and therein prohibited such Company from serving the City of La Port® by motor truck on freight originating at Houston and ~or Galveston, Texas; and, SEAS, such restriction is a discrimination against the City because it perr.~i.ts such Compar:y to serve other cities on its route through La Porte but witholds such needed sez~rice from the City of La Porte; NOi~, TII~EFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTS, TEkAS, that a protest be filed with the Texas F,ailway Coamnis- sion at its hearing to be held at Houston, Texas on ~~a,y 20,1937, re- questing the Comrn,ission to re-issue a Certificate of Public Conven- ience and Pdeeessity to the Southern Facific Transport Company without restrictions so that the City of La Porte may enjoy the same complete and unrestricted service as is afforded other towns on the route through La Porte. Further, that the ~Tayor and City Secretary be instructed to send a certified copy of this resolution to the Railroad Co~unission at its hearing to be held on the application of the Southern Pacific Transport Company for the removal of such restrictions. Bonds The City Secretary presented the following described City of La Porte Ret'd Refunding Bonds which had been paid,caaneelled and retuned by the" A~tanufacturers Trust Co. as per their letter of April 30,193?, to wit City of La ~orte Refunding Bonds numbered 5,6 and 7, each in the prin- cipal sumo X1,000.00 dated Oct. 10,1934 and due April 10,1937. I~Qtion by Ald. Boyle, second by Ald. Ruff that the above described C ty of La Porte Refunding Bonds be turned over to the b~eyor to be destroysd~by fire, the ~~ayor to present an affidavit at the next regular Council meeting that such had been done. Carried. Tax On recommendation of the Tax Com. Chairman Ruff presented the foll- Caneellation owing motion which was seconded by A~d. Boyle, that taxes on Lots 22 and 23, Block 29, Beach Park, for the years 1921 and 1922,in the sum of X3.75 for each year, ~e cancelled, and that the City Tax Col- lector be instructed to show these cancellations on the Tax P.eeords. Carried. Adjustment On recommendation of the Tax Com. Chairman Ruff moved, seconded by Pfeiffer taxes Ald. Agee, that the amount of X8.03 collected in error on A.~. P~'eiffer taxes on Lot 21, Block 92, Bay Front for the year 1932 be put into Tax Deposit Account for Pfeiffer Electric Co. to be ap- plied on x.J. Pfeiffer t~ces due on Lots 2 to 5, Block 92, Bay Front, for the year-1923 in the amount of $10.32, the balance of X2.29 to be taken care of in the City's second settlement with Pfeiffer Elec. Co. on July 3rd, 1937. Carried. Affidavit yiotion by ALd. Boyle, second byr Ald. Ages, that the affidavit of the Daily Sun on the publication of the financial statement of the City's current assets and liabilities be placed on file. C rried. y New meters Motion by A d. Carried. next page • • 3 Traffic The h:ayor presented Ordinance No. 261, being an ordinance Ordinance regulating traffic upon the public streets in the City of La Porte, Texas; fixing per~.lty for violatiox~.;repealing ordinances in conflict therewith and declaring an emergency. Upon motion by ALd. Boyle, second by ALd. Agee , Ordinance No. 261 was unanimously adopted as read and its publication in the Official newspaper of the City was ordered. Books The City Attorney handed the City Secretary a communication setting Firemen's out the provisions of the law regarding the Firemen's Relief and Re- Relief tirement Fund and in particular the duty of the City to Furnish books and equipment for keeping the records of the local Board of Trustees. Motion by Ald. Boyle, second by Aid. Agee that this coaununication be placed on file and that the Adgyor~and City Secretary be authorized to purchase the necessary books and other equipment for keeping the records of the Board of Trustees of the Firemen'x~ Relief and Retire- ment Fund. Carried. Norris Bro. Ddotion by Ald. Agee, second by A~,d. Ruff, that the City Secretary be Ant. ~~ar. instructed to withold payment of Norris Bros. Anteipating Tarrant ~7l~.$ in the amount of X300.00 plus interest to due date, until settlement has been made by Norris Bros. of their obligation to the City i.n the amount of X33.92 plus interest at 6? per annum from date, Nov. 21, 1935.
