Meeting was called to order by Mayor Sharp, with the follu~ring Alder~en responding to roll call: C.M. Agee, F.F. Boyle, J.J. Roark, Fred R. Ruff. The Mayor stated that the purpose of ,the meeting was to arrange a com- promise in the Baldwin suit and appoint an attorney to act in the suit, also to ratify the purchase of the neap Axerican La France Fire Truck and complete arrangezRents with the Bank for payiaent for same. a After some discussion of the Baldwin matter t't~e~@a letter was read from Attorney Jno.S. Kiibler advising the City Council that Mr ~d.P,'`. Streetman had called him in the matter and had been authorized by Mr Baldwin to make the City the following proposition to settle the suit: Baldwin That the City fix the two manholes on Baldwin's property so prposal that they will be securely closed and so as not to overflow; that the City issue warrants to Baldwin in the sum of X750.00, apply a sufficient amount thereof on Baldwin's delinquent taxes and the balance of the war- ~~ rants to be applied by Baldwin on future taxes on the property. Reject Potion by Boyle, second by Ruff, that the City reject the proposal of eos~promise by F.T. Baldwin's Attorney, W.T. Streetman. Carried. City's Pdotion by Ruff, second by Roark, that W.M. Streetman be notified that proposal the City of La Porte rejected the Baldwin proposition to comproa:ise his suit and that he be advised that the City is willing to fix the man holes so they will not over flow and pay Mr Baldwin the sure of X50.00 to cover any other damage he may have sustained on his property in question. Carried Kiibler Motion by Ruff, second by Boyle, that Jno.S. Kiibler be employed to Baldwin handle the Baldwin case for the City, subject to the withdrawal of case ~~t.NI. Streetman, for the sum of X150.00 if the case goes through court and for the sum. of X100.00 if the case is prepared for trial and dis- missed or cornpro~sised, and for a reasonable amount if the case is com- promised bef®re actually prepared for trial. Carried. Motion by Roark, Second by Agee, that the following resolution be adopted as read; BE IT RESOLVED BY THE CITY COU??CIL OF THE CITY OF LA PORTE, TEnAS: `'2,000 That the City of La Porte bgrr the su f ~o Tho sand borro~red Dollars 02,000.00) from the First National Bank o~ ~a Porte, ~exas, (over) 2 • to be used for the purpose of paying Ono Thousand Dollars 01,000.00), the purchase price of the American-La France City Service Fire Truck purchased from tho American- La France & Foamite Industries, Inc., and One Thousand Dollars 01,000.00) on the repairs and. purchase of new equip- ra.ent for such truck; that the Pfayor and City Secretary be instructed and authorized to execute a note or warrant, payable to the First National Bank of La Porte, Texas, in the sins of Two Thousand Dollars 02,000.00) payable on or before six (6) months after date, with interest thereon at six percent (~) per annum, as well as a chattel mottgage on said truck in favor of said Bank, to secure payment of said note, and that the 2ayor and City Secretary be instructed and authorized to issue a warrant in the sum of One Ths~usand Dollars 01,000.00), payable to American La France Sc Foamite Industries, Inc. in payment of the purchase price of the truck and a warrant payable to A. B. Bushey in the sum of Nine Hundred Twenty-One and 21100 Dollars 0921.?_1), in pay~ent for equipment, repairs and other expenses on such truck. And it is so ordered. Carried. There being no further business to come before the meeting, on motion by Agee, second by Roark, and carried by those present, the Council took adjournment.
