MINUTES LA PORTS CITY COUNCIL APRIL 25,1938, 8:00 P.A~. Meeting wac palled to order by the Mayor, Geo. H. Sharp, with the follow- ing Alder~en responding to roll Dells C.T~". Agee, F.R. Boyle, J.J. Roark, Fred R. Ruff. Minutes of the last regular meeting, of April 11,1938 and special meeting of April 20,1938 were read and approved. The oath of o8fice was then administered to Ald. J.J. Roark, by Atty. Jno. S. Kiibler, due to the fact that Mr Roark wa:; not present when the newly elected officials were sworn in on April 11,1938. :idewalks At this time Mr Geo. Counts appeared before the City Council in the inter- ~chool est of sidewalks to serve the new sbhool building now being erected on the school grounds on Broadway. After space discussion a motion was offered by Ald. Ruff, second by Boyle, that the matter of sidewalks on the west side of the School House, betRreen C and D streets, be turned over to the Street and Alley Coamaitteefor investigation and report to the next Council meeting. Motion Carried. Committees The Mayor at this time announced the appointment of committees to serve for the following fiscal year, as follows: Street & Alley, Chairman, F.R. Boyle, C.1~. Agee, P.L. The City Secretary reported that the First National Bank of La Porte ~~ Bank col- wished to replace certain retired Ca~aeron County Bonds with U.S. Gov- lateral ernment Bonds, put up as collateral for depository,and read a letter from the Bank setting out the description of the Bonds to be substituted. Motion by Boyle, second by Roarg, that the Mayor and City Secretary be authorized to write a letter to the First National Bank of La Porte, agreeing to the exchange of two Cameron County, Texas, 5~% Road Bonds, in the principal sum of X1,000.00 each for U.S. Treasury Notes No•56534, 56535 & 56536 in the principal sum of X50.00 each,L?.S. Treasury Notes, No.8l~1,65 & 8li166, in the principal sum of X100:00 each,U.S. Treasury Bond No.137943c i3~ the principal sum of X100.00, Home oAners Loan Corp. No.M750278, in the principal sum of "~1,000.OO,Home Owners Loan Corp. No. T1258391,T1258392,T1258393,T1258391~, each in the principal sum of $100.00 Home Owners Loan Corp.No.AT153533C in the principal sum of X100.00 and Home Owners Loan Corp. No.R329810L for X50.00, a total of ~2,000.00~ on security collateral for depository. Carried Cancelled The .City Secretary read a letter From the Manufacturer's Trust Co. ad- Bonds wising of the return by registered mail of City of La Porte Refunding Bonds Nos.8,9 & 10, due April 10,1938, in the principal sum of X1,000.00 each, these bonds having been paid and cancelled. The cancelled Bonds were turned over to the Mayor. On motion by Boyle, second by Ruff. and passed by those present, the Mayor was authorized to 8estroy by fire, City of La Porte Refunding Bonds Nos. 8,9 and i0, due April 10,1938., each in the principal sum of X1,000.00, with Alderman Agee acting as a witness. Audit The Mayor presented the four copies of the audit submitted by Learned & Tapp, for the fiscal year ending March 31,1938. A~otioh by Boyl®, second by Agee, that the audit of Learned & Tapp be ac- cepted and planed on file and that the Mayor and City Secretary b® auth- orised to draw a warrant in payment of the bill for these services, Sub- mitted by Learned & Tapp in the amount of $125.00, as per their contract. Carried. Bills Motion by Agee, second by Roar]c, that. the bills of Jasper Christy for $1.50, Cuvis Carey in the amount of X10.00 and W.E. Hooper in the amount of X7.50 be approved and that warrants for these respective amounts be drawn. Carried. Warrants The City Secretary asked that the following warrants be ratified: ratified No.1716, Gulf Cities Nat.Gas. Co. X2.32, " 17LF5, Evelyn Radar 5.00 " 1755, W•R. Vickers 3.50 " 1756, Mrs M.O.Lambly,City Secy 10.00 Motion by Boyle, second b4'' Ruff, that p~y~mei~t of the above described warrants be ratified. Carried. Motion by Boyle, Second by Roark, that the Mayor and City Secretary be auth- Note orized to pay the note of X600.00 due the First National Bank on April 26th, r~s~t Nat 1938, from the Delinquent Tax Fund ,with interest to date in the='azaou~ of ~j.00• Carried. 3 Minutes of La Porte City Council, April 25,1938, pontinued ) 2`ransfer Motion by Boyle, seoond by Roark, that the Mayor and City Secretary be to Gen Fd authorized to transfer from the Delinquent Tax Fund to the General Fund, the necessary funds to cover the allowed bills and the weekly and mofithly pay rolls, in the event the General Fund is short the required amount. Carried. Ac Ashan The City Attorney presented a letter to the Counai3~ advising his findings deed in connection with the deed from Mrs Li,szie S. MaAshan to the City of La Porte, on Lots 1 to 12,and 21 to 32, both inclusive, in Block 7, Town of La Porto, which were that the deed is legally effective. ° Afte r some discussion a motion was offered by Agee, seoond by Ruff, that the Council instruct the City Attorney to write Mrs Lizzie S. Mc Ashan that the City is willing for Mrs Mc Ashan to have the. property described as Lots 1 to 12, find 21 to 32,both inclusive, Block 7, Town of La Porte, which she has deeded to the City for Park purposes. Carried. The City Secretary reoprted that the returns on the April water samples were good. Water Works Motion by Ald. fluff, second by Agee, that the Mayor appoint a committee Imps to investigate Water Works iaprove~ents in near-by communities. Carried. ~gayor Sharp appointed the members of the Water Committee to apt on this co~nittee. sylvan Ald. Ruff presented the matter of the Sylvan Beach Park water bill of Desch X83.73, parried over unpaid from last year, askin instructions on c - g of Yater letting the bill before giving a water connection to Mr H.W. Dahse the ~1i11 , present lessee. After some discussion by the Council, Ald. Ruff offered a motion, seoond by Roark,, that the City assume one half of the loss of the amount of X83.73, asking Mr Dahse to assume ~I~1.87, to be paid out at the rate of ~10.l~7, or l~.of the aswunt, eaph aonth, together with the current monthly bill of Sylvan Beach Park, until the entire amount of ~1.~..87 has been paid, and in addition that Sylvan Beaph by Mr Dahse, put up a deposit of $60.00 for water service, X30.00 to be paid in cash when Application for Water Service is signed and X30.00 to be paid by MaylOth,l938~ the motion further stated an alternate proposition where- by Sylvan Beach by Mr Dahse would assume none of the old water bill but would but up a deposit of X100.00, X50.00 to be paid in Dash when the Applipation for Water Service is signed and X50.00 on May lOth,1938. Motion Carried. Jos.Clough The City Secretary presented a letter from Jos. Clough in regard t© the taxes application of his tax deposit of X9.00 on some part of his 193? taxes. Ald. Ruff offered a motion, second~by Agee, that the value of the improve- ments on Lots 9,10 & 11, Block 987, La Porte be adjusted from X300.00 to $100.00 and that the sum of ~50.ao for merchandise be cancelled, both of these adjustments to apply on the 1937 tax roll, and that Mr Cloughts tax deposit of X9.00 be appl3.ed to 1937 taxes on the above described property, returning the smell balance not used,to Mr Clough as per his request. Carried over 4 Ordinance The City Attorney presented Ordinance No. 267, being e.n ordinance levy- Occupation ing a.n occupation tax on every person, firm corporation or association of Tax persons pursuing any occupation taxed, or that may be hereafter taxed,by the occupation tax laws of the State of Texas; fixing the amount o£ such tax at one-half the State tax; providing a penalty for its violation and declaring an emergency. ~dotion by Roark, second by Agee, that the ordinance as read be passed. Carried Motion by Boyle, second by Ruff, that Ordinanoe No.?_67 as a~3opted, be published in the Official newspaper. Carried.
