SPECIAL MEETING LA PORTE CITY COUNCIL ~+4AY 12,193$ ~ 9 : 3o A.r~. to order by ~e Rdayor Sharp w2th the folloxing Aldermen call: C.:d. Agee, P.L. Benson, F.R. Boyle, J.J. RoarY, The Mayor stated that the meeting had been called for the purpose of dis- cussing the case of F.T. Baldwin vs City of La Porte. City Attorney Kiibler outlined to the Council a proposed settlement of the F.T. Baldwin suit against the City and in corformance therexith, Alderman Ages offered in writing and made a motion, second by Alderman Benson, that the folloxing resolution be passed by the Council, to-sat: Be it resolved by the City Council of the city of La torte, Texas: That suit No. B 207705, pending in the District Court, 55th Judicial District of Harris County, Texas, entitled F.T. Baldvrin vs. F.A.Gayls and the City of La Porte, be compromised and settled as follows: 1 - That F.T. Baldwin dive the City a proper easement across his Bay Front property for the maintenance and operation of the City Sewer Line, upon condition that the City fix and operate the system so that the man-holes on such property will not overflox; that said suit be dismissed by Baldwin, who shall phi all Court costs incurred therein; 2- That the City issue a warrant in the exact amount of the unpaid delinquent taxes owing by F.T. Baldwin to the City and suoh warrant applied to the pa~rr~ent of such taxes and thereafter that -°proper ta:x~r~ceipts Be~isaued:'a~d~.de]:ivered to F.T. Baldwin; that the City issue a xarrant or instrument in favor of F.T. Baldwin for the difference between ~1.~50.00 and the amount of the present unpaid delinquent taxes owing by F.T. Baldwin, which warrant or instrument mall not be payable in money but may be applied only on ad valorem taxes owing by F.T. Baldwin to the Cit-yr in the future; 3 -That the 1'~y or and City Secretary be authorized to execute and deliver proper instruments and to do all other things necessary to carry out this settlement and to properly transfer whatever necessary exchanges are needed in the City funds and accounts in carrying out such settlement, and it is so ordered.
