On tt~.is 23rd day of May,1938, the City Council of the City of La Porte,
Texas, convened in regular session ~rrith the following named member$ present
viz:

And Alderman Ruff introduced an Ordinance No. 268 entitled:

G~~yle The Ordinance was read in full and it was moved by
Eros Alderman Ruff and seconded by Alderman Boyle that it be passed on
'darrants first reading, which motion was unanimously carried, Alderman Ruff,
Boyle, Agee and Roark voting Aye; and no one voting No.
It was moved by Alderman Ruff and seconded by Alderman
Boyle that the rule requiring Ordinances to be read at more than one
meetir~~ be suspended, and that the Ordinance be placed upon its second
and final readings, which motion was unanimously carried, Aldermen Ruff,
Boyle, Agee and Roark voting Aye; and no one voting No.
The Ordinance was read a second time, and it was moved by
Alderman Ruff and seconded by Alderman Boyle that it be passed on second
reading, which motion was unanimously carried, Aldermen Ruff, Boyle, Agee
and Roark voting Aye; and no one voting No.
The Ordinance was read a third time, and it was moved by
Alderman Ruff, and seconded by Alderman Boyle that it be passed on third
and final reading, which motion was unanimously carried, Aldermen Ruff,
Boyle, Agee and Roark voting Aye; and no one voting iio.
The Mayor then declared the Ordinance finally passed.
~r.Phillips of J.R. Phillips Investment Co., Albert Roberts, Attorney
and Mr F.A. Gayle were present in connection with the ease of Gayle Bros
vs the City of La Fgrte.

The minutes of the las; regular meeting of ~`ay 9th and Special meeting
of Ia~a.y 12th,1938 were read and approved.
Street ~'tork ~Tr Luther Casteel appeared before the Council asking that some street
Casteel work be done in his vicinity.
?notion by Ruff, second by Roark, that the Styeet and Alley Committee
be instruct°d to im rove the street situation in the vicinity of the
Luther Casteel°~rr~ding and filling, as soon as possible.

Peace RrTOtion by Agee, second by Boyle, that Special Officers Connnissions
Officers be given by the ?da.yor to Arthur Long, H.~ld. Dahse and Joe ?doore to
act as peace officers at Sylvan Beach Park, without compensation.
Carried.
Extending Ordinance ado. 269, being an 9rdinance providing for extension of
Sewer City Sewer Lines, providing for the payment of cost of such ex-
tension by the City and the Applicants anJ. declaring an emergency,
was read.
P:'Iotion by Agee, second by Roark, that Ordinance No. 269 be passed
as read. Carried.
Letter ~.Zotion by Ruff, second by Agee, that the City Attorney ~e instruct-
School ed to write a letter to the Architect and Contractor of the School
Permits Gymnasium and Elementary Buildings and to the School Board of the
La Porte Independent School district advising them that they must
furn~sh and place on file at the City Hall, the plans and specifica-
tions for the Gymnasium and ~'lementary Buildings and must take out
1~uilding,Electrical, Sewer and Plumbing Permits for these buildingsi
mot later than Thursday noon, Tray 26,1938. Carried,
sire Hose alderman Boyle reported that the Fire Hose recently purchased from
the Eureka FirQ Hose Division had arrived, been insgected, accepted
and placed on the fire ~triacks in good order.
Plumbg. A~lotion by Ruff, second by Agee, that the City Plumbing and Sewer In-
'~• Sewer peetor be instructed not to make any tap to the City Sewer Lines or
approve any sewer installation until the ~~ouse plumbing has been
roughed in. _._ Carried.
Inspector City Engineor L.L. Price appeared before the Council and repoz~ted
Enforce that in two instances recently brought to his attention in the in-
Ord. stallation of plumbing and sewer connection the City Ordinance had
not been complied with. The Council instructed Price to enforce the
Sewer and Plumbing Ordinance,
Eq. Board Ordinance No. 270 was read, being an Ordinance providing that the City
1938 Council shall act as the Board of equalization for the year 1938, fix-
ing the times of the meetings of such Board, providing that the City
Secretary shall act as Secretary of such Hoard and declaring an emer-
gency.

read. Carried.

ed to write Chas.R. Norris and O.D. Nesmith asking when the maps

raxzts the following warrants:
No.1~325 in the amount of ~2.?_5 to J.F. De Lewder for :~c Ayeal meter box
No.1829 in the amount of ;,;7.1.7 to J..°l. Mills Dist.Clerk for costs in the
case of Cit~T of La Porte vs `y.c.t. ?vginchen, Suit No.197175.
Carried.
Pdote The City Secretary reportod ttLat the note of '600.00 with interest in the
amount of~~10.30, in favor of the First National Bank and which was due
April 2yth,lA3~3 had been paid on li?ay 12,138.
The CiL-y Secretary reported that an affidavit had been received from Fred
~~a.rtman of ttie Daily Sun on the publication of the Ordinance No.267 on the
levy of an Occupation Tax.
Ball T_,otion by Agee, second by Roark, trial RT.O. Nelson Co. bill of ;~23.h9 be
accepted and ordered laid by the I6th of June in order to take advantage
of the ~;~ discount for cash. Carried.
Letter ~dotion by Boyle, second by Agee, that the City attorney be authorized to
write a letter to the J.S. Johnson, Estate, asking them to discontinue
servicing water consumers in the City Limits, except or_ their own private
property. Carried.
City Motion by Ruff, second by Roark, that the CitS* Hall office be closed for the
Hall day on Wednesday, i;~a.y 25th in order f,o allow the City office force to attend
the Regional meeting of City Officals to be held in the Dice Hotel on that
date. Carried.
Dump ?'lotion by Ruff, second by Roark that the matter of an official dumping ground
for the City be turned over to the Street and Alley Colmnittee for recommenda-
tion. Vote was taken with taro Ayes and two Noes. The Mayor cast the deciding
vote in favor of the motion and declared it carried.

F1~~~rs Motion by Boyle, second by Ruff, that the Cit;~ of La Porte pay X50.00 for the
Expense expenses of two d~ ~ etas to State Firemen's Convention at Amari7.lo,Texas on
June 15,16 & 17~an~ 75.00 for expense of two delegates to Firemen's School at
A & M College, July 1$th to July 23rd, 1938. Carried
There being no further business to come before the meeting, on motion by Agee,
second by Ruff the Council took adjournment.
