SPECIAL MEETING
LA PORTE CITY COUNCIL
JULY 8, 1938 8:P.M.
Meeting was called to order by Mayor Sharp with the following
aldermen responding to roll call: C. M. Agee, F. R. Boyle,
Fred R. Ruff. Absent: P. L. Benson, J• J. Roark.
City Attorney, Jno. S. Kiibler read a letter of July 6th from
Mr. Elbert Roberts, in which he requested delivery of the bonds,
and a warrant in the sum of X1107.08, plus ~ interest from
February 1st. 1938, and in this connection Tyr. Kiibler presented
a letter dated July 8, 1938 explaining the settlement made with
Gayle Bros.
Gayle Motion by alderman Boyne, second by Alderman Ruff, that the follow-
Bros ing resolution be adc.oted:
suit Be it resolved by the City of La Porte, Texas that:
In full, final and complete settlement of Suit No• 210,27, styled
Gayle Bros. vs. City of La Porte, in the 80th District Court of
Harris County, Texas, and of the indebtedness owing by the City of
La Porte to Gayle Taros., Frowing out of the construction of the
City of La Porte sewer system, the Mayor be, and is hereby, author-
ized and instructed to deliver to Gayle Bros. City of La Porte
Sewer Funding Bonds, dated ,may 10, 1938, No. 1 to 22, both inclu-
sive, in the sum of ~500.OU each, agr°regating the sum of X11,000.00,
with coupons attached, and tl~.at the Mayor and City Secretary are
hereby authorized and instructed to issue Wa:~-~•ants, payable to Gayle
Bros., drawn on the i~`arrant Interest and Sinking fund, for the follow-
ing amounts: One Warrant in the sum o.f X1107.08; one 'r'iarrant in
the sum of ,~121a..12 and one. ?Varrant in the sum of ~25?.92 and that
upon the delivery of such Bonds and Warrants the Mayor takefrom
Gayle Bros. a receipt for all of same, and it is so ordered.

end Alderman Ruff introduced an Ordinance No. 271 entitled:

PERMIT; PROVIDING A PENALTY FOR THE VI~LATIO' HEREOF AND DECLAR+k
ING AN EMERGENCY.
The Ordinance was read in full and it was moved by
Alderman Ruff and seconded by Alderman Agee that Ordinance
No. 271 be passed as read, and that notice of same be published
in the Daily Sun July 9, 1938.
Motion by Agee that adjournment be taken.
