Special meeting of the City Comm~.ssion was called t o order by Mayor Pfeiffer with the folloxit~g members and City Officials present: Commissioners Jas. S. Crate, Jr. and Jas. E. Stewart, Supt. of Public Works Raleigh Erwin, A. H. Lambert, Sr., Editor and oamer of the La Porte Reporter, John T,lUio ;,fee, re- presenting Wyatt C. Hedrick, City Engineer, Ernest L. Brown, Jr., John S. Kiibler, City Attorney, and J. E.Muldoon, City Clerk. Commissioner Crate introduced a Resolution, and moved it's adoption. The motion was seconded by Coxnnissioner Stewart. The Resolution is as follows: RESOLUTION CANVASSING RETURNS AND DECLARING TN.E RESULT OF AN ELECTION HELD ON THE QUESTION OF THE ISSUANCE OF REVENUE BONDS OF SAID C a Y IN THE AMOUNP OF X200, 000.00, FOR THE PURPOSE OF C ON- STRUCTION EXTII~TSIONS AND IMPROVEMENPS TO THE WATERWC~tKS SYS- TEM OF SAID CITY; AND ON THE QUEST ION OF THE ISSUANCE OF X300,000.00 REVENUE BONDS, FCR THE PURPOSE OF CONSTRUCTING EXTENSIONS AND IMPRWEMIIJTS TO THE SEWER SYSTEM OF SAID CITY; and PLEDGING THE REVENUES OF THE WATERWORKS SYSTEM AND THE SEWER SYSTEM TO THE PAYMENP THEREOF. '~ ViHEREAS, on the ~d day of February, 19l~8, the City Coa:unission adopted a resolution and order callia2g an election to be held in the City of La Porte, Texas, on the 21st ds4Y of February, 191x.8, on the following propositions: PROPOSITION N0. 1 Shall the City Commission of the City of La Porte, Texas, be auth- orized to issue $200,000.00 Revenue Bonds of said City, maturing serially or otherwise over a period of years not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed five (5~) per cent per annum, for the purpose of constructi:ag exten$ions and improvements to the tiYaterworks System of said City; and to provide for the payment of the principal of and interest on such bonds solely by pled~iag the net reven- ues derived fran the operation of said Waterworks System, or in the event that the City Commission be authorized to issue Seaver System Revenue Bonds as submitted in Proposition No. 2, to issue oombined Waterworks and Sewer System Revenue Bonds in the maximum amount of X500,000.00, and to pledgo 133 solely the net rev~es of the oombined Waterworks ~ Sewer System to the payment of the principal of and interest on said combined Waterworks and ~, Sewer System Revenue Bonds. PROPOSITION N0. 2 Shall the City Commission of the City of La Porte, Texas, be author- ized to issue X300,000.00 Revenue Bands of said City, maturing serially or otherwise over a period of years not to exceed thirty (30) years from their date, bearing interest at a rate not to exceed five (5)y per cent per annum, for the purpose of constructing extensions and improvoments to the Sewer System of said City; and to provide for the payment of the principal of and interest on such bonds solely by pledging the net revenues derived from the operation of said Sewer System, or in the event that the City Commission be authorized to issue Waterworks System Revenue Bonds as submitted in Proposition No. 1, to issue combined Waterwor2ca and Sewer System Revenue Bonds in the maximum amount of $500,000.00, and to pledge solely the net revenues of the combined Waterworks and Sewer System to the payment of the principal of and interest on said combined Waterworks and Sewer System Revenue Bonds. AND WHEREAS, there were cast at said election 516 valid and legal votes, of which number them were cast: "FOR THE ISSUANCE OF WATERWORKS SYSTEM REV'F~1iJE ' BONDS AND THE PLEDGE OF NET REVENUES FOR THE PAYMENT THEREOF, AS SUBMITTED IN PROPOSITION N0. 1" ...................................... ~_votes. That said election was duly called; that notice was given in accordance with law and in accordance with the resolution and order calling the election; that the eleotiaa was held in accordance with law; that due return of said election has been made by the proper officers; that said election has resulted favorably to the issuance of sa3,d bonds; that a majority of the qualified voters, who owned taxable property in said City and who had duly rendered the same for taxation, voting at said election have voted in favor of the issuance of said bonds. 2. That the City Commission be and it is hereby ixi all things authorized, ordered and directed t o issue said bonds and to do any and all things necessary and~or convenient in oonneotiam therewith. Muldoon i er Motion by Stewart, second by Crate, that Ordinance No. .357, being AN ORDINANCE BY THE C TTY COMMISSION OF THE CITY OF LA PC~tTE, TEXAS, AUTHOR- IZ ING THE ISSUANCE OF _ CITY, OF, I.A_ PORTE WATERWC~RSS _ AND SE4YER REVENUE BONDS, SERIES 1948, IN THE AMOUNT OF X250,000, FOR THE P(JRPOSE OF CONSTRUCTING EXTENSIONS AND IMPROVEMENTS TO THE WATERWORKS SYSTEM AND THE SEWER SYSTEDd OF SAID CITY; FBESCRIBING THE FCRM OF BOND AND INTEREST COUPON; PLEDGING THE REVENUES OF THE WATERWORKS SYSTEM AND THE SEWER SYSTEM OF SAID CITY TO PAY THE PRIDTC IPAL OF AND INTEREST ~ SAID BONDS AFTER PROVIDING FCfft THE EXPENSES OF OPERATING SAID SYSTEMS; MAKING CERTAIN COVENANTS OF SAID 13> CITY iN1TH REFERENCE TO THE BOND FUND FROM VYHICH SAID PRINCIPAL AND INTEREST ARE TO BE PAID; PROVIDING THAT THE HOLDER OR HOLDERS OF SAID BONDS SHALL NEVER HAVE THE RIGHT T O DEOdAND PAYMENT OF SAID OBL TGAT I ONS OtTT OF ANY FUNDS RAISED Qt TO BE RAISED BY TAXATION; MAgING CERTAIN PROVISIONS VPITH REFERENCE TO THE ISSUANCE OF THE REMAINING BONDS AUTHORIZED AT THE ELECTION HELD ON FEBRUARY 21, 191.;5, AND DECLARING AN EA'lERGENCY, ' be adopted as read. Carried. Motion by Crate, second by Stewart, to authorize extension of water lines through Block 227, La Porte, in accordance with contract between the City and Moore and Moore Brothers. Carried. Motion by Crate, second by Stewart, to authorize Ed Niles, Contractor, to make connections on storage tank at Number (3) three well, and to furnish materials and labor for siuae, City to pay Niles the cost of labor and materials, plus fifteen (15~) per Dent. Carried. A discussion of water and sewer mains extension to Lot 5, Nebraska Syndi- cate, was held with Mr. Herman and Mr. Peabody. This matter was turned over to Mr. John T. bin Afee, for further investigation. Motion by Crate, second by Stewart, that the meeting adjourn. Carried.
