Regular meeting of the City Commission was called to order by Mayor H. J. Pfeiffer, with the following members and city officials present: Cemmissi®n.ers Jas. S. Crate, Jr., and Wm. P. Jones, Raleigh Erwin, Supt. ®f Public Works, Carl C. Patrick, City Attorney, y+hn. Maness, representing Wyatt C. Hedrick, pity Engineer, and J. E. Muldoon, City Clerk. Minutes of the last meeting were read and approved. 1'he Mayer instructed the City Clerk to open the bids on X50,000.00 VVaterw©rks and Sewer System ~ kevenue Bonds. Porte, 'lexa.s, adopted an ordinance on June 28, 1949 authorizing the .issuance of a 9x100,000 installment of the X500:000 V'Jaterworks and Sewer System Revenue Bonds of said city tivhieh were authorized at an election held on February 21, 1948, and by ordinance adopted Xugust 9, 1949 awarded sale an,d authorized immedis.te delivery of X50,000 out of the 9x100,00 bonds authorized in s€~id ordinance but provided that the remaining X50,000 §l~ould nvt besold until fu~her orders of the City Commission; and VdI-3ERFAS, 1'he City Commission is of the opinion that the remaining X50,000 unissued bonds cxf said authorization should now be sold and: delivered and finds that the bid of Ditianar and Company, San Antonio, `T'exas, at a price of par and accrued interest, plus a premitun of X4,513.00, is the highest and best bid re- ceived for the purchase of said X50,000 unissued bonds; Therefore BE IT ORDAINED by the City C orrunis si on of the -City of La Porte, 'Texas Section 1s That the remaining 9x50,000 VVaterwmrks and Sewer System Kevenue Bonds, Series 1g~9, authorized by ordinance adopted by this City Commission on June 28, 1949 shall now be sold and delivered, said unissued bonds being described by numbers as follows, to-wit: Bonds Nos. 2, 4, 6, 8, 10, 12, 14, 16, 18, 20, 21, 23, 24, 26, 27, 29~ 34~ 32~ 33. 35. 36~ 38~ 39~ 41, ~, ~~ 45~ 47~ ~, 51~ 52. 55~ 56, 59, 60, 63, 64, 67, 68, 71, 72, 75, 76, 79, 80, 96, 97, 98, 99 ~d 100. Section 2; That the bid of vittmar ~ Company, San Antonio, Texas, for the pur- chase of said X50,000 bonds at a price of par and accrued interest, plus a pre- mium of ~'1;j.,513.00, is the highest and best bid received for said bonds and said bid is hereby accepted and when said bonds have been approved by the Attorney General of Texas, registered by the Comptroller of Public Accounts of texas, and approved by market attorneys selected by the purchaser, they shall be delivered to such successful bidder upon receipt of the purchase price. 2'he Mayor, City Clerk and City Treasurer are hereby authorized and directed to do any and all things necessary to carry out the provis ions of this ordinance. Carried. Motion by Crate, seoand by Janes, authorizing the mayor and City Clerk to sign contract with the Century Construction Company for X1.#.5,069.56, upon approval of contract by the City Attorney, subject to the oantractor agreeing to pay all additional legal expenses oocasianed by the paving assessments. Carried. The City Attorney approved the contract of the Century Construction Company and the City of La Porte, ~F ~ The City Engineer was instructed to procure a latter from the Century Construe- tion Company, in whioh they would agree to do all "clean up work" within 2!~ hours after notice of engineer, and in the event they failed to do so, the City would have the right to have it oleaned up and oharged to the aocouat of the Century Construction .Company; also that commercial establishments would have ingress and egress at all times. lotion by Jones, second by Crate, that the following Resolution be adopted: RES OLIJT ION THE STATE OF TEXAS X COUNTY OF HARRIS ~ CITY DF I.A P@tTE ~ , A RESOLUTION AUTHORIZING THE CITY. Or LA.PORTE, TEXAS TO BOP.ROW $5,000.00 BY THE ISSUANCE OF ITS SPECIAL REVENUE NOTE FOR THE YEAR 1950• WfiEREAS, it has been made known to the City Co~m~i.s3lan of the City of ~, Porte, Teaas, that pertain eight inch (8") water pipe might possibly be made available by Vance Turner, a priests 8ouroe of supply and at a price per lineal foot substantially lower than the usual market pri~~; TI~HEREAS, it is antioipated by said Ca~i.ssion that the City will need such pipe°from time to time during its ourrent improvement program and that purchases fromm such source will represent a substantial savings to the City provided such purchases pan be made from time to tim® within the neat sixty (60) days; ~iEREAS, said City,Comgaission on the 12th day of January, 1950, author- ized the purchase of suoh pipe in quantities not to exceed One Thousatxl;; Dollars ($1,000.00) for any individual purchase provided funds were avail- ab le; 11~EREAS, it has beoome necessary to make the initial purchase of suoh pipe in order to preserve the souse of supply for the next sixty (60) days and funds are not available for suoh initial purchase and probably will not be available during the next sixty (60) days and it would be to the financial advantage of the City to borrow funds in the amount of Five Thousand -ollars ($~j,000.00) to be set aside for suoh purchases and such amount is oonsistent with the ant is ipated receipt of funds cuff io ient t o ret ire suoh indebtednes s within the budget year; and, 3~~. V~HEREAS, the First~iona~nk of La Porte, Texas~as ex• ed the finan- cial status of the City and is willing to make a loan of suoh amount and in aocor- danoe with the provisions hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City C ommais s ion of the City of La- Porte, Texas, that thv City Clerk be authorized to issue the negotiable note of the City to be designated "Special Revenue Note for the Budget Year 1950"; suoh note to be in the principal amount of Five Thousand Dollars ($5,000.00); to bear interest at the rate Bf per cent per annum, interest payable at maturity, and to be due and payable on or before the expiration of sixty (60) days from and after the date of this resoluticsz; that said note be sold by the Director of Finance to the said First National Bank at net less than par value, and when suoh note has been signed by the Director of Finance and delivered to said Bank with a duly authenticated copy of this resolution, the indebtedness thereby evidenced shall be fully bind ing against said City. McCauley, Build- ing Inspector, was instructed to make inspection and report back to the Com- mission at their next regular meeting. The 1~ayor introduced an ordinance, which was read in full. Ccammissioner Jones made a motion that the Ordinance be adopted as read. The motion was seoaunded by Commissioner Crate, and carried by+,the following vote: AYES, Mayor Pfeiffer, Co:mnissioner Jones, Casunissioner Crate. NOES, None. The Ordinance oapt ion reads a s follows ORDINANCE N0. 3~ AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF LA PORTE, TEXAS, AND ANNEXING ADDITIONAL ADJACENT TERRT+ TORY TO SAID CITY. Carried. The Bdayor ordered bids opened on the twn trucks which were advertised for sale. Johnnie Thornton bid X100.00 fnr th® 19~i.8 Chevrolet Dump Truck. Motion by Crate, second by Jones, to accept Thornton's bid and instructed the City Clerk to draw up papers transferring title to him. Carried. ~ i ` • E. yi.
