M. ~~ Regular meeting of the City Commission was called to ar~der by Mayor H. J. Pfeiffer, with the following members and city officials present: Commissioners Jas. S. Crate, Jr., -and Wm. P. Jones, City Attorney Carl C. Patrick, Supt. of Public'@Porks Raleigh Erwin; and City Clerk J. `E; Muldoon. Minutes of the last meeting were read and approved. The Mayor announced the first business to b e taken up would be the Southwestern Bell Telephone Company~s appli~dation for an increase in~local telephone exchange rates in the City of La Porte. He asked if there was anyone in the audience who wished to ask ax:y questions on the subject. Mr. Morris Roberson asked several questions. Mr. Chas. Maas and Mr. Frank Baker also spoke. Mr. C. J. Lafferty, District Manager, and Mr. W. E. Hornbuckle, Jr., represented the telephone Company.After much discussion, ~Sayor Pfeiffer called for a motion on the Ordinance as read. Motion by Jones, second by Crate, that Ordinance No. lt06, being AN ORDINANCE REGULATING THE RATES OF THE SOUTHfI~ESTERN BELL TELEPHONE COMPANY IN THE,CITY OF LA PC~tTE, TEXAS, be adopted as read. Carried. Motion by Crate, second by Jones, to pay Raymond Crawley X9.00 fca~ watering. the streets. Carried. The City Commission unanimously instructed- the City Clerk to write the Viking Supply Company that in the event that Ed RTiles Construction Company did not pay them for the 8600 feet of 8" Transits Pipe on delivery, the City would do so. Carried. motion by Crate, second by Jones, authorizing the City Clerk to order from the South- west Traffic Equipment Company, 1000 Dur-0-Line Markers, with appurtenances. Carried. The City Clerk inf"ar~med the commission that Guy R. Hamilton had requested the balance of his"refund on water and sewer contract in Block 18, contract dated June 29, 19118, balance owed Mr. Hamilton being $95.12. Motion by Jones, second by Crate, authorizing the Mayor and City Clerk to sign ease- ment in favor of the Houston Lighting & Power Company as reflected on sketch No. AJ-8192R, for use of the U. S. A. Texas Air National Guard. Carried. '.fir. Carl C. Patrick, City Attorrney, read the following letter to the Commission: October 2b, 1950 The City of La Porte La Porte, Texas In Re: Dunbrik Company vs. Moore & Moore, et al Gentlemen: After considerable correspondence with i~i~T'. Duncan NBblett, Attorney for Defendant, Moore & Moore in the above styled cause of action, who has made a throuough brief of the questions of law involved in the g arnishment proceedings agaY'rzst the City of La Porte, Texas, in behalf of his c7.ient, and after study of the authorities cited by Mr. Neblett, it is my opinion that the City of La Forte can at this time pay unto. Moore & Moore the funds being held in abeyance since the institution of said suit. In accordance Frith the foregoing, it is iqy recommendation that the City of La Porte disburse to Moore & Moore the funds being .held by it as a result of brit of Garnish- ment havingbeen served in .the above styled case. Commission and requested the City Commission 3 "Shady Oaks" out of the W. P. Barris SurvEy. approve the plat of Shady Oaks. Carried. The City Clerk informed the Commission that H. B. Harrison had made application for 22 building permits on or about October 27, 1950, and 2~ad tendered the City $1.00 per permit. The City Clerk informed Mr. Harrison this eras in conflict with Ordinance No. 366-0, passed October 19, 1950, but that he +rould take it up with the Commission at their next r egular meeting. After discussion, the Commission unanimously instructed the City Clerk to issue a permit to anyone for X1.00, who could show an F. H. A. or f3. I. committment or any other evidence dated before passage of Ordinance No. 366-C, dated October 19, 1950. Carried. Motion by Crate, second by Jones, ratifying the Mayor Pfeiffer action in executing contract with the Karpark Corporation October 28, 1950. Carried.
