MINUTES - REGULAR MEETING
LA PORTS CITY COMMISSION ~- DEC. 21, 1950
10:00 A. M.
Regular meeting of the City Commission was called to order by Kayor H. J. :Pfeiffer,
with the following. members and city officials present: Commissioners Wm. P.~ Jones,
and Jas. S.Crate, Jr., City Attorney Carl C. Patrick, A. B. Moore, Engineer on the
Dever Disposal Plant, and City Clerk J. E;. Muldoon.
Minutes of the last meeting were read and approved.
Mr. Hugh Stone, Tax Commissioner, and..Mr. Heard, Attorney, both with, the .Humble Oil
& Refining Company, appeared before the Commission and requested them to release a
part of their land from the City which was annexed to the City under Section l0 of
the Home Rule Charter.
After. .considerable discussion, the City Commission denied their request.
Mr. Ferbert Bartley, and Mr. Ben Browning, representing the La Porte Independent
School District, appeared .before the Comsission, and requested the City to close
the streets; *aive the taxes and penalties, on the land they recently acquired from
Mr.~ A. 0. Blackwell, for a new school site. -
The City Commission unanimously agreed to close the street ~an~d alleys on the school
site, however it was-agreed that an easement should be xeta3,ned. This matter was
handed to the City Attorney to determine what. interest-the City had i,n the streets
and alleys, before taking further action. '
Motion by Jones, second by Crate, to accept. advance of monies.-for ..the cost of water
and sewer lines construction to the A. 0. Blackwell school site, from the La Porte
Independent School District, this advance to b e refunded tb the La Porte Independent
School District, without interest, by crediting their account-with amount charged
for water and sewer each month at the A. 0. Black~rell school-site, until total
amount is refunded. After refund of advance is made, the school district shall pay
the water and sewer charges on the A. O. Blackwell site, the same as on their other
water accounts.'

The City Clerk read a letter from the La Porte-Bayshore Chamber of Commerce, in
which they requested the City to takd up with Southern Pacific, the matter of
installing danger signals at their-railroad Grassing on the Spencer Highway.
The Commission instructed the City Attorney to draw up an'ordinance compelling the
railroad company to install warning signals.

The Commission instructed the City Clerk to hand tha City Attorney the names oP
those property owners who had not paid their curb and gutter assessment. The City
Attorney was instructed to write each of the owners, and if they did not answer,
to sue immedi ately.
The City Clerk read a letter from Hutcheson, Tiliaferro and Hutcheson, in which
;they requested the City Co~nission to ratify the minutes 'of September 12, 1927,
to reflect the legal-description of property conveyed at that meeting. The follow-
ing action was taken:.
"UPhereas, the minutes of September 12, 1927, failed to give the Lots, Block,
and name of addition, the City Commission does now unanimously confirm and ratify
the execution of that certain Quit Claim Dsed covering property described as Lots
21 and 22, Block 11, La Porte; Harris County, Texas, same being dated the 1ltth .
day of 'September, A. D.,-1927, and appears of record in the Deed Records of the
County Clerks office of Harris County, Texas, in Volume 721, Page 39b, Recorded
October 7th, 1927."

A discussion was held on a water tank for the proposed r-ell site in Block 177,
La Porte. `Raleigh Eriri.n~ .Supt. of .Public Works, had made a survey .f'or a tank,
.and had. advised thie~.Commission 'that he had looked at several tanks 'and had talked
with tank people, and found it impossible- at this time to purchase a metals tank«.
He did, however, find a Redwood water tank, s~une being 36' in diameter, and lb~
high, with redwood. top capaci-ty 115,000 gallons, which he .appraised the v clue
to be approximatelg X5,000.00, and which could b e purchased for X1,1:00.00, F. 0.
B. Camp Swift, Texas,- that is, i they acted `promptly, as several other people
were contemplating its purchase.
After considerable discussion, motion by Jones,~seaond by Crate?, authorizing J.E.
Muldoon, City Clerk, to telephone'Grahaia P1pe and Supply Company, 1109 Bee18y
Building, Fort 9~orth, Texas, that they would accept tank and have it hauled off
site the early part of next week.
Carried.
Raleigh Erwin, Supt. of Public forks, also had advised the Commission.-that they
could purchase 1 -Worthington Mater Pump, 2000 G P M, at 200 Head, Direct Conn-
ected to 125 H. P. Westinhouse Motor, 3 Phase, 60 C, ltlt0 Volts, 1765 R P M,Starter
twitch, also 10" & 12" flange gate valves and 10" check valves, for $2,000.00,
which he considered a bargain. He appraised the pump value at ~lt,500.00. This
pump would be 'necessary for the new proposed well.
Mayor Pfeiffer stated that he had checked the price with both Layne Texas Co.,
ltd., and Southern Engine & Pump Company, and their prices were $tt,200.00 or
~l~,600.00. The M~ror asked the City-Attorney for his opinion in making-this pur-
chase, with out advertiaf.ng for bids. -The City Attorney advised the Commission
that iP there was no other pump of the~same specifications, and as .the price 'was
a great deal less than other pumps, they would not be abusing the discretionary
powers vested in their offices to avail a savings to the public.

Motion by Jones, second by Crate, to purchase l -Worthington Pump, 2000 Gallons
per minute at 200 Head, for X2,000.00.
Carried.
The Mayor instructed the City Clerk to open bids on the erection of a redxood rater
tank, located at Camp Sxift, Texas. The ia~ds rare tabul ated as follars:
Pyramid Construction Co. Bid ~1t,500.00 This included a concrete slab.
Niles Construction Co. Bid X1,937.50 No Concrete slab.
Motion by Jones, second by Crate, to axard contract to Niles Construction Company.
Carried.
Motion by Crate, second by Jones, that the folloxing Resolution be adopted:
RESOLUTION
Whereas, heretofore, the Mayor of the City of La Porte prepared and submitted
to the Board of Corrnissioners at it's meeting held on December 7th, 1950, his pro-
posed budget for the fiscal year July 1, 1950 to June 30, 1951; and,
Whereas, the Mayor filed such proposed budget xith the Clerk of the City of
La Porte on November 6th, 1950, for public inspection;
Whereas, the Board of Com~issioner designated that a public hearing on such
budget be held at the City Hall at 11:00 o'clock A. M. on December 21, 1950, and
caused such public notice of such hearing to be made; and
Whereas, such public hearing has been held, and is therefore ordered by the
Board of Commissioners that the budget as prepared. and submitted by the Mayor is
hereby finally approved by the Board of Commissioners, and it is hereby ordered
that a t rue copy of such approved budget, together xith a copy of this order, shall
be filed in each of the offices of the Clerk of the City of La Porte, the County
Clerk's office, Harris County, Texas, and the State Comptroller at Austin, Texas.

Motion by Grate, second by Jones, that Ordinance No. ls07, being
AN ORDINANCE MAKING APPROPRIATIONS FOR SUPPORT OF THE GOVERNMENT OF THE
CITY OF LA PORTS, TF,XAS, EC)R THE FISCAL YEAR BEGINNING JULY 1, 1950, AND
ENDING JUNE 30, 1951, AND DECLARING AN EMERGBNCY,
be adopted as read.
Carried.
