MINUTES - SPECIAL MEETING

10:00 A. M.
Regular meeting of the °City Commission was called to order by Ma,}ror ,H. J.
Pfeiffer, with the following members and city officials present: ~G~ommiss-
ioner gym. P. Jones, City Attorney Carl C. P~.trick, Supt. of Public~l~orks
Raleigh Ero+rin, and J.E. I~du].doon, City Clerk.
Minutes of the last meeting were read and approved.
The Mayor handed the City Clerk Mr. Jas. S. Crate's resignation and re-
quested it be read to the Commission. Mr. Crate's resignation read as
follows:

Gentlemen:
This is to confirm ~Y verbal resignation, as Councilman for the City of
La Porte, being effective as of January 31, 1951, due to my having taken a
position with the County.

Upon motion by Jones, second by Pfeiffer, Mr. Crate 's resignation was
accepted.
Carried.
The City Clerk read a petition in behalf of Mr. and Mrs. T. E. Bolding for
a new taxi service in the City of La Porte. After discussion, the Commission
tabled the petition .until their next regular meeting.
The Com~tission unanimously instructed the City tax collector to waive the
interest and penalty on all current (1950) taxes c ollected in the month of
Bebruary, 1951, and to again acid the regular interest and' penalty to all un-
paid taxes collected after the month, of February from date of their original
delinquent date, February 1st, 1951.

The Commission unanimously instructed the City Clerk to v+rrrite the Viking
Supply Corporation that if Niles Construction Company did not pay for the
merchandise reflected orb their sale orders Nos. 1x96 and 1098, that the City
of La Porte would.

The City Clerk..read a letter of, resignation f~'om Mr. M. D. Burgin, City Fire
Marshall, in which hq requested to be relieved of his. duties as City Fire

I Wish to be relieved of ~ duties as City Fire Marshall, and hereby tender
my resignation to become effective as of this date, January 31, 1951.
The time required to handle the affairs of the City Fire Marshall .has become
too great for me to continue in my off time. As you know, I am in hearty
accord with your fast-moving, progressive administration, and I will continue
to support you in future projects for public improvement.
Iweuld be glad to serve and work with you in some other capacity ~rhich would
not take :all of my spare .ti me.

The City Attorney was instructed by the Commission to draw up an Ordinance in
cannection with cleaning up the property of debris after a building has been
demolished.
Motion by Jones, second by Pfeiffer, to appoint Harry I~. Ralston as ~:ectrical,
Plumbing and Sewer Inspector, and to be compensated as follo~rs: X50.00 per month,
or if the: total permit fee amounted to more than X100.00, then he ~rould be paid
one-half of~ the fees.
Carried.
Motion by Jones, secca~d by Pfeiffer, authorizing the City Clerk to issue a
check in the amount of X1,675.19, to Sargent 3c Sowell, Inc.,' for 1 -Wilshire
Pon~er Sweeper, 1t$" Model wi.tl-, lights.
Carried.
Motion by Jones, second by Pfeiffer, authorizing the City Clerk to issue a check
to the First National Bank of La Porte in the .amount of X5,075.00 for payment
of tax anticipation note made August 3, 1950.

Motion by Jones, second by Pfeiffer, to cPaange Section VI in Ordinance No.
~01~, from "The Licensee sriall pay a permit fee of Twenty-Five 025.00) for
each structure to be moved where the ground space of such structure does not
exceed 400 square feet and for each'. structure to b e .moved that has a ground
space of more than L-00 square feet, the permit fee shall be one Hundred 0100.00)
dollars, ." to "Ten 010.00) minimum for each structures up to 200 square feet of
• ground space, and Five 05.00) for each additional 100 square feet or part thereof."

TAH~RF.AS, Gilbert Baldauf is the oamer of Block Thirty-Four (3!~} situated
in the tovm of La Porte, Bay Front Addition, and has constructed improvements
on a portion of said property-which extend a distance of four (!t) feet beyond
his property line on to the adjacent property: owned by the City of La Porte,
Texas, and used as 3 public alley; and
WHEREP.S, the location of such i~:provements was made through inadvertence
and the relocation thereof would at this time cause said property owner ..excessive
and unreasonable expense; and

WHEREAS, the said Gilbert Baldauf owns the property on the opposite side
of ..said. alley and is willing to grant the City of La Porte, Texas, a strip of
land equal to .the width and length of that upon which said improvements are
located and in addition thereto is willing to grant unto the City of i.a Porte,
Texas, an easement for water and sewer lines across property owned by him in
shi.d block; and
WY.ERF,AS, the exchange of property contemplated will not in effect alter the
width of said alley but will only create a four (4) foot offset which will not
materially or substantially affect the useful purpose of said alley:
NOPP THEREFORE, BE IT RESOLVED that the City of La Porte, Texas, acting by
and through-.its duly elected Mayor H. J. Pfeiffer, under. the seal-of said City
and the attest of its City Clerk, J. E. Muldoon, be authorized, and it is hereby
authorized, to execute and deliver in its behalf a (3enetal Warranty Deed to the
property hereinafter described as being conveyed by it and to receive on its ,~
behalf, a General "Yarranty Deed from the said Gilbert Baldauf on the property
hereinafter described as being conveyed unto it, and for the purpose of eviden-
cing and perpetuating the consideration for. the exchange of said lands, said
officers of the City of La Porte, Texas, are further authorized to execute
and acknowledge an instrument of writing, when considered to~ther with this
Resolution, shall constitute full ~d conclusive authority and consideration
for the execution and delivery of the need on behalf of the City of La Porte
and acceptance of the deed from the said Gilbert Baldauf; such instrument being

do hereby agree to grant, sell and Canvey those certain tracts of land as
hereinafter get f orth out of ~ssid Block Thirty-Four (34) and each of the parties
do hereby covenant, grant, conclude and agree each for himself and itself,
their heirs, successors or assigns, that such exchange be made as follows:
That the said Gilbert Baldauf shall from henceforth have, hold, possess and
en~ay, to himself, his heirs and assigns, the following described tract of
land, to wit:
BEsINNING at the Southwesterly corner of Lot Eight (8), Block Thirty-
Four ( 34) of Bay Front Addition, in the Town of La Porte, Texas;

most Westerly boundary line of-said Block Thirty-Four (34) for a distance of
Four (4) feet to stake for corner;
THENCE in an Easterly direction and parallel with the most Northerly

twenty-five (125.) feet;
THE~iCE in a Northerly direction and parallel to said projected line
for a distance of Four (4) feet;
THENCE in a ~Iesterly direction and parallel with the most Northerly

enjoy, to intself, its successors and assigns, the following described tract
of land, to wit:

Harris County, Texas;
THENCE in a Southerly direction with. the ~.ost Westerly t~ounciary
line thereof for a distance of Four (4) feet;

point of intersection with the.most Easterly line of Lot

The said City of La Porte, Texas, shall further haves hold, possess and

This agreement shall be binding upon the heirs, executors and successors
of each of the respective parties hereto but shall not be assignable in whole

A discussion was held on the appointmerit of a Commissioner td fill the vacancy
of Jas. S. Crate, Jr., resigned.
Mr. Mercer D. Burgin v-€~s asl~eii if he would consider filling thef positiori of
Co*ncnis~ioner, which was vacated. Mr. ~u•gin stated-- that he atppreciated the
confidence which the Commission placed in him by their offer,- and that he would
accept, ,and would do everything to carry out-the ~tishes of the people, and he
would also cooperate with the Mayor and Mr. Jones. -He wanted 3:t understood,
however, that he was not a "yes" man, and would on all questions express his
avm opinion.

Upon motion by Jones, second by Pfeiffer, M.D. Burgin was appointed,Comsnissioner
to fill the unexpired term of Jas. S. Crate, Jr.~ resigned.

The City Clerk was instructed to have a $3000.00 Bond, executed by Corporate
Surety- Company, for bRz~. Burgin, ready for their next regular meeting at which
time he ..would be sworn into office.
Motion by Jones, second h1Y Pfeiffer, that the meeting adjourn.
