53° MINUTES - REGULAR MEETING LA PCRTE CITY COMkBILLSSION - SIl'TEMBEtZ b, 1951 10:00 A, M. Regular meeting of the City Commission Was called to order by Mayor Pro-Tem Wm. P. Janes, in the absence of Mayor H. J. Pfeiffer, with the following mem- 3~ers and city officials presort: Commissioner M. D. Burgin, and City Clerk J. E. .Muldoon. Upon motion by Burgin, second by Jones, this meeting was recessed until 10:00 o~clock A. M., September 7, 1951, at which ti me the Mayor could. be present. Recessed at 10:15 A. M. SEPTEMBER 7TH, 1951 10:00 A. M. Carried. Mayor H. J. Pfeiffer called to order t$e meeting which was recessed at 10:15 o' clock A. M., septeuber bth, 1951, with the folla~.ing members and city officials present: Commissioners Nor. P. Bones and M. D. Burgin, Supt. of Public ~Porks ~P. A. Arthur, City Attorney Carl C. Patrick, and City Clerk J. E. Muldoon. 'r`he Mayan ordered th,e bids opened and read aloud on the constructiaai of addi- tions to the Sewage Plant, as advertised far September 7, 1951. The bids were as follows ; J. M. White & Sons X13,930.15 Pyramid Construction Co. 90 Calendar Days 20,990.00 A. S. Koehler 60 Calendar Days 1J~,775.00 Niles Construction Co., Inc. 120 Calendar Days 17,612.00 Moore & Moore 100 Calendar Days 18,1~7b.15 The Mayor infcaned the bidders the Commission would study the bids and let them know later the successful bidder. Men fron various departa:ents in charge of the Public Works Superintendent, appeared with grievances. The Commission informed thew to toy and work these grievances out w3.th the Superintendent of Public Works. Motion by Burgin, second by Jones,`to designate the following days as city holidays: Christmas Thanksgiving, July 4th, and Labor Davy, city employees to be paid for 8 hours plus auy time they work. Carried. 531 Upon motion by Commissioner Jones, duly seconded by Commissioner Burgin, and carried by a unanimous vote, the follororing Resolution was adopted:. ~ IT RESOLPED that the City of La Porte, Texas, tentatively approve this date the budget submitted by the Mayor for t11e current fiscal year; that pub- lication of notice of heaving on .said budget be made in °the official neorspaper of the City of La Porte, Texas, on September 21st,~1951, and that said hearing be held in accordance with such notice on September 28th, 1951, at 11:00 0' clock A. M. at the City Hall, City of La Porte, Texas. Carried. The City Clerk informed the Commission that mss, Billie Minchen had requested of him an adjustment of her taxes and penalties ,and as he was without auth- ority to make such an adjustment and asked their pleasure. This matter was referred to the City Attorney, The attorney advised them they also were without authority to act. The# Egnaiiz#tion Board had met each year, and. to waive the penalties they would have to vraive the penalties' for all others in the city by Ordinance. The Commission advised the City Clerk to write mss. Minchen and, advise her they were without authority to adjust her taxes. M., September 8, 1951, at which time further discussion would be had on the bids for the construction of additions to the Sewage Treatment Plant. Carried. Recessed at 1:10 P. M., September 7, 1951, with the follc~vPin.g members and c3.ty officials present: Commissioner M, D. Burgin, Mr. Payton, representing A. B. Moore Eazgineer, City Attorney Carl C. Patrick, and. City Clerk J. ~. Muldoon. ~. J. M. Wt~i.te, representing J. M. White and Sons, also was at this meeting. A lengthy discussion was held with Mr. White in connection with J. M. White & Son's bid, and clause which was added to bid. 533 Motion by Burgin, second by Jones, to reject all bids opened September 7th, 1951., for the construction of additions to the Se~rage Treatment Plarit~ except that bid of J. M. White and Sons. 3~. White agreed to bid Clause Classification in contract, also line in question to be constructed according to corrected plan, ie, City to furnish materials and pay contractor ..5© per foot for laying 6~i Cast Iron Supesanated Drain Line, Ehgineer to be on project when Baffels were being moved. Carried. These items were read back to Mayer Pf~iffer,by telephone, by the City Attorney. Motion by Janes, second by Burgin, to award contract to J. M. .White & Sons, for amount of bid, subject to execution of Performance Barad and contract. Carried. Motion by Burgin, second by Jones, that the meeting adjourn. CarP:ied. ATTEST: !~
