The City Commission of the City of La Porter Texas met i.n Special session at the City Hall within said City on the 11th day of Novembers 1953, ~.+~ the following members present, to-wit: M. D. Burgin Mayor Robert A. White Commissioner J. E. Muldoon City Clerk when the foll.o-~ing business was: transacted.: The Mayor introduced an ordinance which was read in fu11. Cc~ni.ssioner White moved that it be adopted as read. The motion was seconaied by Co~- issioner Burgin and carrie~t by the following vote: AYES: Mayor Burgin, Commissioner White. NOES: None. .The ordinance thus adopted follows: ORDINANCE N0. t~55 AN ORDINANCE DETFRMTNING THE NECESS1fiY OF MAKING CII3TAIN STREET IMPA~ VEM~NTS IN THE CITY OF LA PORTS; AUTHCRIZING THE GIVING OF NOTICE TO BIDD~S AND OF INTENTION TO ISSUE TIME WARRANTS WH~EAS, it is necessary to make certain improvements i.n certain streets in the City v~'iich are in bad need of repair and the City does not have on hand sufficient funds to pay the costs of said improvements and this City Commission is of the opinion that said. costs should be paid by the issuance of tame warrants of the City of La Porte, Texas; THIlIFFQ~E $.~ IT ORDAINED BY the City Commr4.ssion of the City of La Porter Texas: Section 1: That it is hereby found and declared that it is necessary to ~` a cer~ain improves~ents to certain streets in the City of La Porte: Texas; that provision foe the payment of the cost of said improvements of said streets shall be made in whole or in part by t he issuance of the time warrants of said City in the ma~dmum amount of Twenty-Five Thousand (~25, 000.00) ~ol.l ars ~ and the levy of an. annual ad valorem tax on all taxable property vrithin the City for the payment of sack warrants; and that -the warrants issu ed to pay all or a part of the cost of making said improvements to such streets a~ay include all engineering, professional or other necessary .,services pertinent thereto. INTPR.PSTED PARTIES: z7c~ Sealed proposals in duplicate addressed to Honorable A4. D. Burgin, Mayor, City of La Porte, Texas, will be received at the Mice of the City Clerks City Halls La Porte, Texas, until 10:00 A. M., November 30, 1953, for: Furnishing a71. necessary materials, machinery equipment, superinten- dence, and labor for malting certain improvements to a ertain streets in the City of La Porte, Texas, to-merit : 1. Street improvements, generally consisting of the shaping and ca~paction of existing base materials the addition of -base material as required; and the application of a two course in- verted penetration asphalt wearing surface on apprwn.mately five miles of existing streets; 2. Or in the alternative, Street improvements, generally consisting of the shaping and compaction of existing base materials the addition of base material as required; and the application of a two course inverted .penetration asphalt wearing surface on approximately $ve miles of existing streets ,except those materials listed in the .specifications to b e supplied by the City. ~.. . Bidders must submit Cashiers check or certified check issued by a bank satisfactory to the City or a bidden s bond from a reliable surety company, payable without recourse to the order of M. D. Burgin Mayar~ La Porte, Tex- as~ in an amount not less than five (5~) per cent of the largest possib~.e bid submitted as a guaranty that bidder will enter into a contract and exe- cute bond and guaranty in the farms providied within ten (10) days after notice of award of contract to him. Bids v7ithout required check or pro- posal bond will not be considered. The successful. bidders must furnish performance bond on the attached form in the amount of one hundred (1000 per cent of the total contract price from a surety company holding a permit from the State of Texas to act as surety, or other surety or sureties- acceptable to the City. Instructions to bidderss proposal forms and plans and s pecifications may be wed without charge in the office of the City Clerk and ma„y be procured from A. B. Moore Engineering Compavy~ 307 South Maine Pasadena Texas upon making the deposits required by the engineers. All lump sum and unit prices must be stated in both script and figures. The City reserves the right to reject any or all bids and to waive formal- ities. In case of ambi~zity or lack of clearness in stating the prices i.n the bids, the City reserves the right to consider the most advantageous construction thereof, or to reject the bid. Unreasonable (or "unbalanced") unit prices ~ri11 authorize the City to reject any bids. Bidders are expected to inspect the site of the work and to inform them- selves regarding all local conditions. Attention is called to t he f act that there must be paid oat this project not less than the general prevailing rate wages which have been established by the City of La Porte which is of record in the office of the City Clerk, and is applicable to all contracts ativarded by the City. It is the intention of the City Commission of the City of La Porte, Texas, to authorize and issue ti.atae warrants of the City of La Porte in the ma~c;samm amount of Twenty-five Thousand 025,000.00) Dollars, bearing interest at the rate of not more than five (5~) per cent per ar~raum, and matux'ing serially over a period. not to exceed thirty (30) years, for the purpose of evidencing the indebtedness of the City of La Porte for a1.1 or part of the cost of said improvements to said streets in the City of La Porte, including all engineer- ing and other professional expenses necessary and pertinent to said work. Brown, Jr.~ for using his best efforts to find a purchaser for the proposed issue of X25,000.00 Street Improvement ~'tarrants, also Adr. Brown agrees to pay'the costs of publication of all necessary notices; to pay the cost of the printed Tarrant Forms and Bond Forms, and pay all costs of regis- tration and delivery for the sum of $500.00, this fee to be paid when all or arty part of the warrants have been issued and delivered.
