On this, the lath day of F~etruary, A.D. 1958, the City Commission of the City of La Porte, Texas, comrened in special session, duly and regularly calleel, at its regular meeting place 3n the City Ha11, in the City of La Porte, Texas, all members there, to wit: H. P. PFEIFFER., Maytr~ Pro-tem; L. R. RIGBY, Commissioner; being present, none being absent, one .(1) Commissioner's office being vacant, and the follo~cirg business and proceedings were transacted: It was moved by Canmissioner L. R. Rigby, and seconded by Mayor Pro-tem H. P. Pfeiffer that the Commission pass a Resolution giving notice of its intention to pass an ordinance submitting certain amendments to the existing Home Role Charter of the City of La Porte, Texas; the motion carried by the followi:g vote: Ccmmissicner L. R.Rigby and Mayo Pro-teen A. P. Pfeiffer voting "Aye", and none voting "No". Thereupon the following resolution was read at length, approved and adopted: A resolution providing that notice be given of the intention of the City Commission of the City of La Porte, Texas, to submit to the qualified voters of the City, far approval or rejection, certain amendments to the existing Home Ru le Charter of the City of La Pa~rte. W'H!L'[iEAS, the City Commission of the City of La Par to deems it advis- able at this time to submit to the qualified voters of the City of La Porte amendments to the existing Charter; and 11P~1EFtEA5, the C~ y Charter of the said City has not been altered or amended within two (2) years next preceding this date: THEREFCRE, BE IT RESOLVED BY THE CITY COMI~SSION OF THE CITY (&' L6 POR.TE, TEXAS, THAT Section 1: That it is the intention of the said City Commission to pass an ordinance on the 28th day of February, A.D. 1958, for -the purpose of submitting to the quali.f`3.ed voters of said .City, at an election to be held for that purpose, the f ollowirg amendments to the existing Charter AMEbTDMII~TT N0. 1 ARTicle 1, Section.3, of the Home Rule Charter of the City of La- Porte, Texas, shall be amended so that the same shall hereafter read as follaPS: ~' "Section 3. Farm of Government: The governing body of the City of La Porte shall be a Commission composed of the Mayor and fota~ (4) Commissioners, to be lrnonm as the City Commission of the City of La Porte. ;'The members of the City Commission shall be elected from the City of La- Porte at large in the manner prescribed else:rhere in this Charter. A,s hereinafter used in the Charter, the cords City Commission shall be construed to mean a Mayor and four (4) Commissioners: Pursuant to its provisions and sub3ect only to the limitations imposed by the State Constitution and by this Charter, all poners of the City shall be vested in the elected City Co:nmissicm, rhich shall enact local legislati an, adopt budgets, determine policies and execute the lags and administer the governmer~ of the City. All pacers of the City shall be exercised in the manner prescribed by this Charter or if the manner be na~t prescribed then in such manner as may be prescribed bar ordinance." ,. AI~3dDMEIJr N0. 2 Article II, Section 12, of the Home Mule Charter of the City of La Porte, Texas, shall be amended so that the same shall hereafter read as follow Section 12, City Camadssion, Nwober, Selection, Term: The meaa- bers of the City Commission -af the City of La Porte shall hold their offices for a term of two (2) years, aryll. until their successors have been elected and duly qualified. After the regula r City Election to be held on the fourth Tuesday 3n April, 1958, the City Commission shall be composed of a Mayor at~¢i four (!~) Cammd.ssioners and thereafter a Mayor and four (!t) Comrat.ssioners shall be elected on the fourth Tuesday in ,April, every t*o (2) years At the first regular meeting of the City Commission after the votes have been canvassed and the results of the regular City E]~ection on the fourth Tuesday in April, 1958, have been declared, the t~no (2) candidates for ~e office of Commiss- ioner receiving the third and fom~th highest number~of qualified votes at such .election shs].1. be declared elected an@1 shall serve as Commissioners, upon qualifying as required by lair. If, at the said election on the fourth Tuesday i.n April, 1958, there are less than four (!~) candidates for the office of City Cammi.ssioner, then after the results of such election have been declared, the City Cession shall fill the ~taeaacy or vacancies, as the case may be, by appointing a qualified voter or voters residing in the City aryl havix~ the proper ualifications. Thereafter, in the election of the Cammtssioners, the four ~4) candidates receiving the highest number of qualified votes shall be declared elected, and there shall be no run-off elections; ixi the election of a M~ror, the candidate receiving the highest number of qualified votes shall be declared elected a.~i there shall be no run-off elections. In the event the election of a Mayor or a Commissioner catrmot be determd.ned because of a tie vote, the City Commiss3oa~ sha].1 call a Special Election within thirty (30) days to determine the ginner between the candhdates receiving such tie vote ar~d the candidate receiving the highest number of qualified votes in such Special Electi on shall be declared elected. The four (~) positions of the Commissioners on the City CaQaani.ssion shall be numbered One (1), Two (2), Three (3), aa~d Four (!~), oral at the firer regular meeting of the City Commission after the results of the regular City Election on the fourth Tuesday in April, 1958, have been dec].ared~ the Four (!4) Co®m- issioners elected or appointed, as the case may bed shall determine by lot the number of the position of each Ccxnmi.ssioner. In all subsequent elections all candidates for Gity Commissioner shall be voted on and elected separate],y for positions on sa. d City Camnission aid all candidates shall be designated on the affi.cial ballot according to the number of such positions to which they seek election." AI~I~TT No. 3 Article II, Section 15, of the Home Rule Charter of the City of La- Porte, Texas, shall be amended so that the saaoe shall hereafter read as folloa+rs: "Section 15. Vacancies in City Commission: A v aaancy in the office of City Commissioner shall be filled by a qualified voter residing in the City and having the proper qualifications, appointed by a majority vote of the remain- ing members of the Commission. A vacancy i.n the office of the Mayor shall be filled by a qualified voter residing in the City and having the proper quali- fications, appointed by a majority vote of the remaining members of the Comm- ission, provided that a City Commissioner may be appointed to the office of Mayyor by the majority vote of all the other Commissioners. ~lihen vacancies occux so that there is less than a majority remaining on the City Commission, then a Special Election shall be called bT the remaining members of the City Commission withia forty-five (lu) days oral all vacancies filled in the same manner as herein provided for General El.ect~.ons; provided, hoRever, if such vacancies occur within ninety (90) days of a Ge~ral ESection, then no Special Election shall be called." Section 2: That the Mayor Pro-tem of the City of La Porte be author- ized and instructed to publish a Dopy of this Resolution in the La Porte Liberal, the official newspaper of the City of La Porte, as notice of the intention of the City Ccwanission to submit said Amendments, aril the wane when marked "NOTICE OF INTENTION TO SU'BMCT CHAF.TER AMENDMQ+ITS", signeei by the Mayer Pro-te~m of the City of La Porte and attested by the City.. Clerk, and published as aforesaid, is to be due notice thereof. Section 3: That said notice s hall be published in the La Porte Liberal, the official newspaper as aforesaid, for not less than twenty (20) days prior to the date on which the proposed ordinance is to be passed.
