M• Special meeting of the City Commission was called to order by Mayor Pro-Tem H. P. Pfeiffer, with the following presents Commissicaier L. R. Rigby and City Clerk Frank G. Baker Mayor Pro-Tem H. P. Pfeiffer asked that the returns of the City Election held on April 22nd, 1958, be canvassed. The election returns were canvassed as follows FOR M,~YOR FOR CObgvIISS IONERS ~ H. P. (Jack) Lawler and Odell L. Brown elected to the offices of Co~rnnissioners for a term of two years. Carried. The :~;ayor Fro-Tem asked that the adoption of amendments to the Home Rul e Charter for the City of La Porte, be canvassed. The votes were canvassed and the following resolution was introduced, un- aniunously approved and adopted. The resolution is as followss RESOLUTION CANVASSING THE RETURNS AATD DECLARING THE RESULT OF ELECTI02d HELD ON THE QUESTION OF THE ADOPTION OF AI~QENDMENTS TO THE HOME RULL CHARTER FOR THE CITY OF LA PORTS, TEXAS . WHEREAS, on the 28th day of February, 1958 the City Casmnission of the ~: City of La Porte adopted and passed an ordinance and order calling an election to be held on the City of La Porte, Texas, on the 22~d day of ~'april, Ig58, submitting the proposed three amendments to the home Rule Charter to the qualified voters of the City of La Porte, for adoption or rejection; AND NffiEREAS, there were cast in said election b61 valid and legal votes of which number there ~~1ere cast as follows: AP~NDT:iENT N0. 1 FOR amending Article 1, Section 3, of the Home Rule Charter of the City of La Porte, to provide that the governing body of the City shall be a Commission composed of the ~:.ayor and four (~.) Commissioners. --------------------- 607 AGAINST amending Article 1, Section 3, of the Home Rule Charter of the City of La Porte, to provide that the governing body of the City shall be a Commission composed of the I~iayor and four (1~) Commissioners. ----- 51a. AMENDMENT N0. 2 FOR amending Article 11, Sectiam 12, of the Home Rule Charter of the City of La Porte, to provide that after the regular election on the fourth Tuesday in ~`,pril, 1958, the City Commission shall be oomposed of a Mayor and four (~.) Commissioners; that the two (2) candidates for the office of City Coy.a~issioner receiving the third and fourth highest number of qualified votes at such election shall be declared elected and providing that the four (1~) positions on the City Com- mission shall be numbered One (1), Tvuo (2), Three (3) and Four (I~.) and at sll subsequent elections all Candidates for City Commissioner shall be voted on and elected separately for positions on said City Commission---------------------------~--------------------------------- 585 AGAINST amending Article 11, Section 12, of the Home Rule Charter of the City of La Porte, to provide that after the regular election on the fourth Tuesday in April, 1958, the City Commission shall be composed of a P~4ayor and four (1~) Commissioners; that the two (2) candidates for the office of City Commissioner receiving the third and fourth highest number of qualified votes at such election shall be declared elected and providing that the four (~) positions on the City Commission shall be numbered One (1), Two (2), Three (3) and Four (1.~) and at all subsequent elections all candidates for City Commissioner shall be voted on and elected separately for positions on said City Commission. ------------------------------------ 56 AMENDMENT N0. 3 FOR amending Article 11, Section 15, of the Home Rule Charter of the City of La Porte, to provide that vacancies on the City Com- mis si cin sha 11 be filled by appointment by a ma jority vote of the remaining members and providing that a City Commission may be appointed to the office of Mayor by a majority vote of all of the other Commissioners. -------------------------------------------------- 563 AGAINST amending Article 11, Section 15, of the Home Rule Charter of the City of La Forte to provide that vacancies on the City Commission shall be filled by appointment by a majority vote of the remaining members and providing that a City Commissioner may be appointed to the office of Mayors, by a majority vote of all of the other Commissioners. -------------------------------------------------- 6!~ ~. ~' a BE IT RESOLVED BY THE CITY COIvII~7ISSION OF TH • TY OF LA PO RTE, TEXAS: 1. That said election was duly called;, that notice was given in accordance with law and in accordance with the ordinance and order calling the election; that said election was held in accordance with law; that due returns of said a lect ion has been made by the proper officers; that said election has resulted favorably to the adoption of Amendment_No. 1, Amend- meat No. 2 and Amendment No. 3 to the said Charter. 2. That the City Commission is hereby in all things authorized, ordered and directed to do any and all things necessary andfor convenient in connection with said Amendments to said Charter. 3. The City Clerk of the City of La Porte is hereby. authorized, ordered and directed to furnish the :Mayor of said City a copy of the three Amendments to said. Charter, authenticated and certified by his signature and seal of the City, and the Pdayor is .authorized, ordered and directed to forward such copy of the lsmendments to said Charter to the Secretary of State of the State of Texas.
