Regular meeting of tha City Commission eras called to oiler .by It?ayor H. P. Pfeiffer .with the following Commissioners present: Frank R.Boyle, John Lawler, Tom Osborn, -and Odell Broyvn; Mr. ~.A. Arthur, Supt. of Public ~lorks~ Special Counsel John S: Kiibler, and Ruth Huddleston, ~;ss~t.City Clerk. Also present were the follow3xjg: E. fl2. Colliery Houston Post, Pete Liddell, Houston Posts Preston Pendergrass, Baytaran Sun, Glerm~Lowry, Baytanrn Sung T. C."Adams, La Porte Liberal, .Chester Rogers and I,~rs. ?9f.A. Stabs, .Houston Chronicle. L~linutes of the last meeting were read and approved. A..sewe~ extension for the Church of Christ in Block"133, La Porte, was dis- cussed. Five property owners have indicated that they are willing to parti- cipate in the .cost of construction of this line. The City will pay for fialf of the cons~Cruction of the first 500 feet, and the property owners vrill pay the balance. The Ii~ayor anal 11~r. Arthur instructed the City Clerk to proceed.with ,. the collection of 'money from .the property owners, so that this line can be constructed. - A, letter from I~~r. ~w'harton i7eems to ~.~r. Frank G:' Baker, Tax A,ssesscr ~& Oollector, was read. P.~r. Y+Ieems stated that he has been paying taxes on a number of pieces of property that he does not own, for a number of years, through a mistake in "his records. He further stated that he was of the opinion that payments made on lots that he does not arm should either be reimbursed or applied . on the payment of other taxes which he does awe the City. After discussion, and upon advise of ?;1r. Kiibler, motion by Boyle, second by Osborn, that no refund be made on any tax payments made prior to July 1, 1958, and any payments made in error by IvIr . ~t~de ems on or after July 1, 1958 on property which he does n of arrn si1a11 be refunded to him upon return of his receipts, and provided that rio tax certificates have been issued thereon. Mr. Tord Osborn brought up the fact that the Benson Tractcm Company has a good used ditching machine for sale for X3,750.00. He stated that in his opinion this equipment was badly needed by the City, and that it would pay for itself in a short time. ~~otion by Osborn, second by Boyle, that the City purchase this machine on a lease-rent deal, at X200.00 per month, the first payment being clue and payable ~5 to 60 days after delivery, subject to the legality of the City purchasing equipment costing this much without taking bids. Carried. • . Commissioner Tc~n Osburn stated that Boys Harbor eras in bad financial 'difficulty, due mostly to the loss of the- help of Bill 1'di_l.liams. Nfr. Kiibler brought out the fact that this organization was outside the city limits of Za Porte, and did not I~ow'if Ure could legal7,y help them in this way, or not . He also stated t'r~at we might be s eating a pre- cedent by doi~ig ` so; as ether places of this type, namely Happy Harbor, etc., would also want a-~d expect reLiof. The matter of free water to churches was brought out and discussed. I~11r. Kiibler was recite sted to check into the legali-~y of tTv_s, and also the matter of giving wee water to Boys Harbor. He trill report on this at a future meeting, h2r. Bruce ~.ngel requested permission to shell a plot of ground that he awns back of the Alley behind his washateria on hest I~~ain Street. I~~'1'. Angel wants to use ti~is ground as a parking space. The property in qz estion is bacl: of the Alley in 31ock 53, ~La Porte. After dis- cussion it was agreed that to jive hi:n permission to do this vuo uld encourage cars to nark in the A11ey which is parallel to the rzrrash- ateria, and it is unlawful to block an Alley, which people would probably do when parking there to use the washateria. Commissioner Osburn moved that Ordinance No, 550 be approved and passed by the City Commission of the City of La Porte on its first reading; the motion eras secono.ed by Comr~~.ssioner Lawler. The motion carried by the following vote: Commissioners Brown, Osburn, Boyle and Lawler voting rrayerr, and none voting crno4r. A letter from Head ar.~l•Lyle, !attorneys, of Corpus Christi, Texas, was read by Its. Kiibler. These attorneys stated tha i, they vuo uld represent the Celanese 5~5P~ation at the hearing on A ~~ust 15, 1958, in regard to Ordinance No. s Mr..!Lrthur asYed permission of the Com•nissian to send ?':'Tr. Lyman Cunnir_gham to Austin, to take the Plumbing Inspectorrs examination. PTotion by Osburn, second by Boyle' that this request be .granted. Carried. Rlayor Pfeiffer stated that he had requested and accepted the resignation of R.T. Lindsey, Chief of Police. r,~otion by Osbarn, second by Brcr~rn, that the resignation. be accepted. Carried. The appointment of Goss Neill as Acting Chief of Police, effective immediately, was unanimously approved by all members of the Comr~i.ssion. Upon recommendation of T,2ayor Pfeiffer, and unanimously agreed by all other mem- bers of tree Co?mnission, K. T. The h~Iag~u' announced that Doss I~1ei11 would accept the appointment as .~,eting Police Chief on a temporary basis, until it is decided That will be done about hiring another man.
