M, Regular Yeetin~ of the City Coeolission was called to ®rder by,Mayor H, r. rfeiffer, with the following members present: Coru~i.ssisners Lawler, Brown, ant Osborn, Special Counsel Jn®. S. Kiibler, Supt. W.A. Arthur, and City Clerk Frank G. Baker. Als• present were Guy ~.obertson, George Counts and Walter Roberson. Minutes of the last meeting were read and approved. Carried. J~ Mr. Guy Robertson appeared before the Commission to discuss a rifle ranfe for the wall boys that usually play with his boy. rermissien for sale was refused, Jud=e Counts discussed the problems that his Court is experiencing, and asked the Coa~mission to dive him copies of traffic ordinances that per- tain t® cases that come before his Court. Attsrney Kiibler will prepare ordinances that City does not have at this tine, cofering traffic violations. Walter Roberson appeared before the Coxmi.ssion to discuss the problems that the Zoning Commission has pertaining to attendance. He felt that the C~aimission should stress this importance t• a prospective member on Zoning Board before placing they on the Bears. Motion by Osborn, second by Lawler, that the City fol].nr the recsmmenda- tions set up by Schosl Tax Assessor Osborne, City Assessor Baker, Attorney Kiibler and Ernest Brown, Jr., pertaining to the collection of delinquent taxes. Carried, M®tion by Osborn, sec®nd by L~ler, that the City Clerk be authorized to advertise and receive bids on January 15, 1'Ge, for the garage apart- ment fonerly occupied by the paid fireman. Carried. that rolice Commissioner be authorize) Carried. ~„ '`'~' /37 DELINQUENT TAXES La Porte Independent School District and City of La Porte T0: `The Members of the City Commission of the City of La Porte and The Board of Trustees, La Porte Independent School District Gentlemen: Mr. John Kiibler, Sr., Mr. Richard Osborne, Mr. Frank Baker and Ernest Brown met this morning to formulate a course of procedure to be jointly followed by the School District and the City in an effort to try and collect delinquent taxes and to improve current tax collections in the future. At this meeting the following items were considered and agreed upon: (1) No effort will be made to make any list of total delinquent tax- r payers in either district. (2) Mr. Osborne and P'ir. Baker will prepare a record of all delinquent taxpayers shown on the 1950 tax roll. It was concluded that initial steps should be directed towards people who are delinquent on 1950 taxes, or prior years, and on subsequent years. After taxpayers on the 1950 roll have been exhausted, then it is recommended that we proceed to the 1955 roll and then come forward. (3) The 1950 rolls will be compared and each Tax Department will at- tempt to mail a letter (Letter No. 1) to those persons shown as delinquent on both rolls, the purpose being to try and have these taxpayers receive a letter from each taxing authority at the same time. (!~) Letter No. 1 is to be drafted by Mr. Kiibler, with the help and L_J cooperation of the two Tax Assessors. This letter will not make reference to either a lawsuit or to the fact that this item will be referred to the attorney but will state that the taxing authority intends to use due diligence to enforce collection. (5) At some reasonable time after the mailing of Letter No. 1, the Assessor & Collector in each case will submit to his Board the names of persons who have received Letter No. 1 and have not paid their taxes. At this point the City Council, or the Board of Trustees, will determine whether or not these delinquents should be sued. If it is their opinion that suits should be filed, then the Assessor & Collector will send out a second letter (Letter No. 2). .e'~~ (6) Letter No. 2 will advise the delinquent that unless taxes are paid within 30 days, then this item will be submitted to the attorney and the attorney will be instructed to carry this matter through to a suit. It is the intent that at this point the district officials will determine that a suit is to be filed, it being the consensus of opinion that no threat to sue should be made until it has been firmly determined that suit will be filed. (7) The attorney is, of course, to be authorized to take all appropriate steps. However, it is contemplated that he will send out a notice advising the delinquent that his delinquent taxes have been turned over to him for court action, if necessary, and that he intends to proceed with such action without further notice. r (8) It was determined that at this point we would deal only with delin- quent taxes within the city limits of the City of La Porte, and that all action on these items would, as nearly as possible, be simultaneous and that all expenses would be paid 50~ by the City and 50~ by the Schools. (9) It was determined that at least for the time being delinquent taxes due the School District by those taxpayers outside the city limits of the City of La Porte would be treated separately by the School District which will follow the same procedure outlined above.
